My brother, sister and I bought my parents a popcorn maker from Familyrecroom.com for Christmas 2006. The popcorn maker had not been delivered by Christmas Day, so we gave them a picture of it. Three days later they left for Florida for the winter.

When the popcorn maker arrived a few days after they left, we put it in their house where it sat until April when they returned. When my dad finally had the time to open it and put it together, he discovered that the motor did not work. I gave him the email address for the company and he sent them an email describing what happened.

This was his first reply from George Borowski, CEO: Its well past the time we offer a return or warranty. Try contacting the manufacture. Sorry.

After a second email from me explaining the situation, this was his second response: "I am sorry there is nothing we can do past 90 days. Try contacting the Helman Group for technical support."

Again I contacted him and told him how disappointed I was by his company's lack of customer service and that I planned to file a report with the Better Business Bureau and other consumer watch groups. This was his reply: "Its standard retail policy. Try returning something to any store after 90 days and they will tell you the same thing. Most people inspect their items when they purchase it and do not wait 6 months later to report an issue."

How many people do you know buy something for 300 plus dollars and does not open the box for 5 months after it was delivered? Sorry, but I do not know anyone but you and I have been in internet sales for 10 years now.

How is it my companies fault that you did not inspect the unit at time of delivery and supposedly waited months to open it for inspection? We have shipping insurance on all our items at the full replacement value since they are inspected before leaving and are in mint working order. Feel free to check with UPS/FedEx as we have less than a 1% damage claims on file. I do not know what happened to your machine while you were on "vacation" for 5 months, but no company is going to allow a full return a half year after the fact.

Once again if you were to call the manufacture or write a detailed message to us we would send a replacement part at no charge for up to 1 year after your purchase. But 90 after purchase we do not accept full returns. This is clearly posted on our website. This is a nothing out of the ordinary and is in accordance with visa and master card terms. This is why your credit card ruled the chargeback in our companies favor.

We are very sorry you did not open your item and were on vacation for months, but we did our part. We sent you a brand new popcorn machine that was new in box. It is up to you to inspect your purchase at time of delivery and not claim it was damaged during shipping months later.
