I recieved a billing from Westmoreland agency, "a Capital One company.
PO Box 85522 Richmond , Virginia, 232855-5523.

This address was on the billing demand.
The outer envelope's address is, PO Box 85149 Richmond, VA. 23295-0001 .

Westmoreland claims I made a charge 06/28/1999 in the ammount of $152.58 from FCNB - Spiegel. They give an old account number and also give a new account number assigned to me.

I have never had a charge card with Spiegel. In fact I gave up credit cards ten years ago. I've not had one at all of any kind. Today in the mail, I recieve this bill via a collection agency and Must reply by 08/20/04 and pay up the bill or call their 800-758-3036 phone number and make payment now, or wreck my credit status.

I've not responded yet to their demands. I'm not sure I should after reading the information on this site about this company. Any advice is greatly welcomed.

Melinda, if this bill is not yours you MUST respond to protect your rights. According to Federal Law, you have 30 days to dispute any bill once it is brought to your attention - it looks like time may be running out! I would suggest that you call the collection agency, and obtain their fax number. Fax a WRITTEN dispute that states you do not, nor have you ever ordered any merchandise from the creditor in question and that you insist this matter be immediately removed from your credit report if they have already put it on.

They then have 30 days to "substantiate" the debt i.e. prove that you ordered merchandise and agreed to pay for it. If they cannot substantiate that with an invoice, buyers order, your signature, etc..then they have to drop the matter. Follow up your fax with a certified letter, and I would also advise you to put a statement on the letter that indicates you expect a formal written response within 30 pursuant to Federal Law or you will report the matter to The Federal Trade Commission.
