To Whom It May Concern:

This letter will give a brief description of the events starting Oct. 2001 involving John Adams, IV, of F. C. Tucker Real Estate Company.

My house, which was also an income property, had been on the market and the listing had expired, the realtor had not collected her sign. Two men approached my grandson, Blake Ford, inquiring about the house. My daughter, Josaun, saw the two men; Adams and Scott Kraege, speaking with Blake and immediately ask what they wanted.

They expressed interest in viewing the house. My daughter then came to my door (a multi-family dwelling with 3 units), and began telling me of the conversation she had with Adams and Kraege.

While Josaun was telling me what the men wanted, I said I thought we should call the realtor. Adams was standing outside the door and over heard the conversation. Adams opened the door and handed me a pictured business card. He said, I am a realtor and would like to see the property---you don't need to call the agent, (ERA), I can take care of this---I am a realtor with Tucker.

We spoke briefly about the house. I said I was reluctant to show the house without my realtor but since was an agent; I would let them tour the property.

Blake gave the men a listing sheet compiled by ERA agent and broker, Jeri d**k Balintine.

Josaun, and Blake accompanied the two men on a tour of the three units and attic.

After the tour was completed, Adams said they wanted to make an offer on the property but they had a third partner whom they would have to discuss this with. He said since the listing had expired he would like to list the house and be the agent for both himself and his partners and also represent me.

My response was, I have a friend who will represent me, she has helped me through everything on this house, if anyone gets the listing it will be Hazel.

He responded with, I brought you the buyer, I think I should have the listing. I will cut back the commission to you --I will represent both of us. I said, You're the buyer and Hazel will take care of everything on my part in this.

They looked at the furnishing and commented on how well the designed the contents (I am an interior designer), and house came together. I had considered selling the house as a turnkey and made mention of that to the two men. We continued talking about the house. Adams said he would live in the front upstairs unit and be an on site manager.

Adams said, I would like to buy some of the items--my mom will help me chose the things that I will need--if we come to an agreement on the house.

The two men left saying they would speak with a third partner and would make an offer to purchase.

In the course of events, we came to an agreed price and conditions of sale.

Inspection; I requested repairs be made after closing and he would not agree so I was required to repair $2,200 of minor improvements. My realtor made inquiry about financing and was told by Adams that everything was fine. He wanted all repairs complete before closing. Although I requested leaving the funds for repairs in escrow and he could schedule the repairs since they were 90 % cosmetic;

Repairs to be completed before closing; While the contractor, Hornaday Residential and Commercial Services, was at the house, Adams ask him to do other minor repairs, which I agreed to and paid for. Adams then instructed the contractor to do additional work which he said he would be charged to him and the contractor performed those additions;

Entire premises to be vacated by day of closing; I continued to sell off many items I would not have sold if I had known the finality of this; helped my sister who rented one of the apartments find and move into another dwelling; redecorated the two upstairs units as a good gesture so Adams and partners would be ready to rent/lease the units.

Occupancy given on day of closing; I stored the remainder of my belongings in 3 separate storage units because I didn't have anywhere to move. I had 2 cats and a large Akita dog, I have since lost my cats. I contacted Diane Pruitt, a realtor in Tennessee, and we worked trying to find a suitable house to purchase--nothing was available for immediate possession. I purchased a travel trailer for a short term fix to the problem.

Adams wanted to place a sign on sight, offering the units for rent/lease. I allowed him to do so and people approached me wanting to see the units. I showed the units and could have leased them. I told the interested parties to call Adams for the amount of deposit/rent/lease conditions, etc.

Russell Hornaday, the contractor, doing the required repairs, was at the house and received a call from Adams. He said Adams had asked him for the key to my house before closing. Hornaday said Adams wanted to speak with me, handing me his cell phone.

Adams said, I need a key to the house. I replied, John, closing is next week and I think that we should wait until then before you have a key. He said, I think I should have a key now--I am the owner--I am buying the house--I want a key! I again refused.

I called Hazel Cooper and told her of the conversation. She said, Adams has contacted everyone who has a key to the house and no one will give him one. I said, Tell him I will talk about the this with my attorney if he calls again.

I spoke with my insurance agent about the situation. He advised me not to consider allowing Adams or anyone a key because I would become liable in case of an accidental fall or the like. There were four sets of staircases on the premises.

Adams again called Hazel about obtaining a key. She said in talking with me that I was going to speak with my attorney about the situation---END OF STORY. He did not ask/demand again.


I followed all the requirements and the day of closing was November 28, 2001. Just hours before closing I received a call from Hazel Cooper. The closing was postponed and hoped to rescheduled for December 7, 2001. I proceeded to make adjustments including utilities, another trip to Tennessee, re-adjusting my plans. Adams set the date again, December 21, 2001 and then called to ask Hazel if we could close earlier. The closing was set for December 27, 2001.

Everything was continued as planned until 2 hours before closing, I again received a call telling me Adams had to postpone again.

Hazel called Stuart Brown of the finance company and he assured her there was nothing to worry about and to tell Ms. Logan, I will be bring her a check for $174,000 on January 2, 2002.

On the third scheduled closing date that he had set, he was in Florida with his family for the holidays--he set the closing and knew he would not even be in the state.

January 4, 2002, Hazel called me and she had had conversation with Stuart Brown, the finance officer, he was furious because Adams. He would not close the transaction. Brown, the loan officer, was going to move into one of the units and had vacated his dwelling. He had nowhere move.

Hazel talked with her manager, John Breck, who was aware of the situation and had helped Hazel through some of the questionable aspects of the entire transaction. He had made a call to the Tucker manager and asks if he was aware of the mess--the manager did nothing.

January 4, 2002, John Breck spoke with Adams who said he was withdrawing his offer because he could not obtain financing.

For the sake of condensing the rest of the story; I had to sell the house at auction or stand the chance of foreclosure, I depleted all of my assets paying for moving, repairs, storage, contracts I made based on the contract; my credit is ruined, I am being sued by two companies at this time.
