On March 25, 2009 I went to F&D Auto Sales in the hopes of purchasing a reliable vehicle. I met with Fred and we discussed my credit and I notified him that I had very poor credit at the time and had visited many dealerships who denied my application. I let him know that due to the loss of my job the previous year I had my previous car repossessed. However I did have $1000.00 I could put down if he would be willing to finance me. Fred stated that he mostly has higher end cars, and I let him know that I would not be able to afford a car payment over $200.00 and if he could not help me I would go elsewhere. Fred stated that he had a 2005 Chrysler Town & Country minivan for sale in the amount of $2500.00. I let him know repeatedly that I did not want a car that I would have to repair over and over again. He told me that the car was reliable and the only thing that I may need to repair, were the tires. He stated the tires would need to be replaced in a couple of months. I was financed with payments in the amount of $146.00 a month approximately with a 30% interest rate over an 18 month period. I picked up the car approximately March 30, 2009. The car was sold As Is and I signed due to the fact that I was told that only the tires may need to be replaced.


On the afternoon of April 4, 2009 the sliding door of the van completely fell off and onto the ground as I was opening the door. I notified Fred of this and he told me to come down that evening to his dealership and he would take a look at it. I met with Fred at the dealership and he looked at it and told me to bring the car back to his shop the next day so he can assess what needs to be fixed.


When I went to pick up the car April 6, 2009 he assured me that his mechanic had looked at the car thoroughly and that it was safe to drive. He did not give me a receipt of any kind or anything in writing as he stated he needed to find the part to fix my door.  The next day I was told by a friend that the tread in my tires were shot and I should not be driving this car at all. I took the van to Sears Auto Center located at 1511 W. Sunset Rd. in Henderson, NV on April 8, 2009. I was told that the minivan that Fred sold me should never have left the lot and that it was unsafe when sold to me. I have documentation to prove this statement. I notified Fred of this and he stated that he would be willing to give me the $1000.00 I put down if I would return the car but he would not reimburse me the $158.05 I had just paid to replace the tires. I told him that I really needed a car due to the fact that I am a single mom and needed to pick up my child in one hour.


Ten minutes later Fred called me back stating that he felt bad for selling me a car that was in that bad of shape and he would fix it. Due to my work schedule I let Fred know I would call him when I was able to bring it by so that he could fix my door.


In the beginning of June 2009 my air conditioner stopped working and my car was emitting fumes that were making me vomit and wheeze. There was also a loud clanking sound coming from the engine and my car would smoke each time I would stop driving. I notified Fred of this and he again told me to bring it by his shop. He let me know that the air compressor fell off and that he would fix it which I assumed he did. In addition he stated that he checked everything else out at that time including all of the fluids and that I would need to get the transmission adjusted soon due to the fact that it was slipping gears.


In early September I notified Fred that the transmission (which he told me was replaced) was still slipping and that I needed to trade the car in for a reliable vehicle. I submitted an application for another vehicle and Fred stated that he would let me know the outcome when it came back. I never heard from him regarding this nor did I receive anything in the mail notifying me of a denial.


On November 20, 2009 the engine starting to make a very loud noise again and every time I drove it, the noise became louder and louder. I took it to a mechanic that my boyfriend knows and he did a complete diagnostic on the car. He notified me that the engine in the van was dead and that it would cost $2000.00 for a new engine. In addition to the engine failing, the gauges failed, and the transmission was stuck in 2nd gear. I spoke with Fred in November 23, 2009 notifying him of the problem and told him I would be at his shop the next morning at 9am to see how we can resolve this.


On November 24, 2009 my significant other and I spoke with Fred and tried to negotiate purchasing another vehicle due to the many problems that have occurred with the vehicle he sold me. We explained to Fred that due to the fact that he did not disclose every defect of the car it would only be right to allow me to exchange the minivan for a reliable safe car. At that time Fred became irate and stated, I am not going to sell you another car under any circumstance. I asked him about my previous application for the other car that I filled out in September and he stated immediately that I had been denied without looking at any papers. I asked him why he did not call me to notify me and he had no answer. I never received any letters notifying me of this denial. F & D Auto Sales sold me a car that was unsafe to drive and in doing so risked my life as well as my four year old sons life. F & D did not disclose the full defects of the vehicle when purchased. Within a period of eight months the door fell off, the compressor fell off, the engine failed, the gauges failed, the transmission went out, I replaced the spark plugs and the cd player radio broke.
