After fedex assured me they would deliver my packages "next day" from St Petersburg FL to a marine transport company in Miami FL, they breached the contract, did not deliver as promised - not because of the weather, and not because I made any mistakes.

Fedex had packages for other customers to be delivered to the same marine service to the Caribbean.  One of those customers had PAINT, a hazardous material, to be shipped.  Fedex did not provide a document called an IMO as required under 49 CFR Parts 100-185, to King Ocean, so King Ocean refused to accept the entire truck contents.

The driver had to make a trip back to his/her base to get the document, but before he/she left the marine shipper facilities, (s)he gave the King Ocean receiving clerk an ultimatum namely, that King Ocean will be charged for the return trip.  Meanwhile, one of Fedex female clerks called me several days later, asking where exactly are my pacakges being shipped to, even though the packages were labelled inside and out (and did not have to be re-labelled at the ocean shipper.

Fedex female (by name, date and phone #) volunteered the name of the King Ocean receiving clerk who refused the shipment, as though he was responsible for Fedex breach of contract.  She neglected to tell me about the IMO mistake FEDEX made.  I had to track that down through the ocean shipper administration (names, phone # with extensions)

Fedex tried to extract the cost of the return trip from King Ocean, but when King Ocean refused, Fedex decided to bill ME for a return trip.  I did not have any hazardous materials in my packages and did DECLARE that I was shipping Christmas presents for kids in the Caribbean. 

When I asked for a refund for breach of contract five (5) days after the contracted delivery, I was screamed at by a supervisor (names of contacts + phone #'s + city) who practically told me which lake I should jump into, that I wasn't getting a refund.  Then, to add insult to injury they changed the WEIGHT of my packages to an outragious # of pounds (320), at a location different from the location to which I delivered them.  I was able to obtain the Dock Receipt from the ocean carrier.  The dock receipt weight (247) and fedex "pretend weight" differed substantially.  I must note that nothing was missing from the packages at their destination, but the packages missed the ship date.

I brought that to the attention of FEDEX and the supervisor (name + phone#) reversed the phoney weight charge, but continues to bill me for an "additional trip charge" (while still calling it a weight charge) month after month after month, because they think I might be the weakest link.

In a letter dated 11/30/16 Fedex admitted ALL THAT, decided to refund the difference between priority and standard fees, as well as the what they call "outstanding charges", but Fedex has yet to deliver on that promise.  Fedex just keep billing and billing and billing. 

I believe I am due some punitive damages because of their harassing, because of their threatening me with court action.  If I were a betting person, I would wager that EVERY CUSTOMER in that shipment was also billed for that extra trip Fedex negligent employees had to make. 

This all started 12/14/15, and I have tried several times to get Fedex to stop harassing me, but they're bigger than me, and is trying to ruin my name and reputation.
