I sent a set of Barbri books to a customer who had won them on eBay in upstate New York from Jersey City, NJ around January 6th. They arrived, overnight I might add, via FedEx Ground (the only applause I can give them) and the driver allegedly collected a check from the buyer. I state allegedly as the actual drop report online states 'left at door' in the comments area. This seems to cut against any claim that they were met by the buyer.

So. Either FedEx failed to collect the check, or, as they claim, they mailed it to me WITH NO TRACKING INFO by placing it in an envelope and slapping a .42 cent stamp on it. I have never received payment as of 04/01/09. I have called FedEx on numerous occasions and have been told that this is their policy and that as they never took actual possession of the funds (i.e. cashing the check and issuing a new one, it's my tough luck). I have filed a claim with them and been told, in writing, the same.

Soooooo I guess I'll be suing FedEx in small claims court. This is total horseh*t. I just shipped a parcel via UPS COD last week and lo and behold THEY USE TRACKING BECAUSE IT COSTS THEM NOT A d**n THING TO DO SO AS THEY'RE ALREADY COMING TO MY DOORMAN BUILDING EVERY F*CKING DAY ANYWAY AND IT JUST MAKES MORE d**n SENSE TO DO IT THAT WAY!!!

Wake up FedEx. DHL is dead for a reason; you've not looking too good yourself.

That all said; if I never received it, why wasn't it delivered back to them via the return address? There are about 8 Chen's in my building (21 story high rise) and I'm not discounting that it was mis-delivered and tossed by someone other than me. STILL, if that is the case, the point remains valid. Use your own d**n proprietary system with tracking to ensure delivery. You're charging $9 for COD, DO SOMETHING TO EARN IT. Again, I can't even be sure that the driver was paying any attention to the label and actually collected the funds.

The buyer, who was to take the NYS bar exam, has terminated all contact. His mother was to buy the books for him and was providing the funds. Guess who else is getting sued, and guess who else is going to have a devil of a time in front of the Committee on Character and Fitness when he tries to swear in?

I have filed this under 'unusual' --> 'dead beat customers'; but it might be more appropriately filed under 'drunks' as that's my only explanation for FedEx sucking so badly on this one...

Saw another dude on here with the same issue. Hope if more of us speak up they will begin to see the error of their ways.

I sent something COD and they brought me back a fake cashiers check.  I want to sue then but dont want to waste my time.  I am wondering the out come of your situation?

First of all, you have a legit complaint with Fedex. Your complaint, however, is confusing. In your first paragraph, it is indicated that you'd shipped a package to an adjacent state. Then later it's stated that you yourself never received a package. Are you refering to two different shipments?

All carriers send COD payments back via the USPS service with no tracking, not just FEDEX. If you had never received the check, it can be cancelled after a period of time and re-issued. What's peculiar here is that your tracking states "LEFT AT DOOR". That statement indicates that absolutely no COD was collected by FEDEX. Period. FEDEX can not say that any COD was collected because of that fact alone and it is no coincidence that the check never arrived to you.

Shipments between NY and NJ are in the same zone, and Ground service is always a one day service. That's no special feat. It is a little known fact that FEDEX Ground (and Home Delivery) service is not done by FEDEX themselves, but rather by self employed protocol and responsibilities due to that fact, but FEDEX owes you a refund plus any insured value.

It is unclear what this 'Chen' package is about, but no carrier ships to a name anyways. None. All mailing and shipments are done to an address only. The name is just a reference for the person(s) on the receiving end.

Your efforts will be better persistently spent with FEDEX over the phone. Suing anyone out of state is virtually impossible for a petty issue like this. You'll have to sue FEDEX or an individual in the state and county in which THEY reside. I'm assuming the time and expense would far outweigh a few books.

On a side note, regardless whom you want to take on, you may want to improve the flow of your logic when conveying a point. Perhaps your anger muddied the explanation. And the irrational insults and language only reduce a persons credibility. Either way, FEDEX made an error and does owe you some change.
