In a Nutshell:
Poor Ethics: Fiberglass Pool Resurfacing (FPR) hid behind a loophole in the law instead of taking responsibility for damage made to our pool equipment while performing warranty work during ESCROW

Poor Follow Up: It took a complaint against FPR via the Better Business Bureau to finally get a response from pool worker, Jared, when we had questions as to why our pool was suddenly leaking after the warranty work was performed.

Unprofessional Communication: Office manager, Jennifer Farrell, made personal attacks towards me and the real estate agents, such as calling my real estate agent that I have worked with for years, inept and ignorant.

The Story:
While our soon-to-be home was in ESCROW in August 2012, Fiberglass Pool Resurfacing based in Martinez was scheduled to do some repairs under warranty. When they resurfaced the pool last year, a crack was either left behind or formed later on.

In order to repair the crack, FPR had to drain the pool and fix the crack; after the work was completed, the pool was left drained for days, supposedly while the equipment was still in operation in the middle of a very hot week in August. 

A few days after we moved in, I got a call from the pool service guy saying our pool was suddenly losing a serious amount of water and had to be filled twice that week by Wednesday. 

I ordered another inspection on the pool which revealed that there was a clear relationship between FPR draining the pool and a leak forming in an underground pipe, as well as some small leaks at the equipment site.

It took a long time just to get FPR to respond to the issue to find out how leaks had occurred after complete pool inspection had just been performed in mid July revealing no leaks. Filing a complaint with the BBB finally got the Jared, the person that performed the work, to respond.

I learned that FPR did not draft up any paperwork to have the repair done and did not warn anyone involved that there were risks in draining the pool in hot weather. No one was told to make sure the equipment was off either.

Designating someone, such as a realtor or the property manager to do these simple tasks could have easily avoided the crisis. With FPR refusing to pay for the damage, my husband I and I were left to pay $1125 in repairs on the underground leaking pipe.

I pursued a complaint against FPR again with the CSLB and learned that FPR was able to hide behind a loophole in the law that says when the home is in ESCROW and if no contract is made between the homeowners- to -be and the company, CSLB has no jurisdiction over making the company pay damages.

The only effort FPR made to resolve the matter was to repair the skimmer that was originally installed by them; however they were not willing to go into a contract with my husband and me regarding the skimmer being repaired. We simply wanted the contract to include any provisions or risks regarding the repair and a description of the repair.

With FPR not willing to have a written agreement with us, we strongly felt that if any damage was caused during the repair, we could end up with a similar issue with them and did not trust them enough to move forward with a skimmer repair on
their terms.

The last resort would be to take them to small claims court but with a baby due in 4 months, it simply wasn't a good option.

Instead, I warn anyone planning pool work on their home to avoid FPR. They are an unethical, rude company with no regard for their customers and with no honor in being accountable for their actions.

Stressful for all involved!

We were contacted by Doug's Real Estate Agent to repair a crack in the pool we had fiberglassed years ago.  It needed to be done before the close of escrow as our contract with the previous owner of the house is non-transferable.   We did not even have to do this repair, but did also not want to be blamed and subject to lawsuits from Real Estate Agents if their deal falls through and they don't get their commissions.    Both Real Estate Agents (Seller & Buyer) were extremely ignorant when it comes to swimming pools.    Doug's Real Estate Agent was, in fact, annoying, as she was the type who, just because she was sitting in traffic with nothing to do wanted to have long conversations with me while I had plenty of work to do so we took it to emails.  I have 30 pages of emails from her and on one she even admits "I'm a newbie to pools".   Anyhow, through the course of the sale neither Agent was taking care of the pool.    When Jared went to repair the crack the water was already below the fill line and the equipment was still running so he turned it off.   He repaired the crack and left.   Doug's Agent was going to have "La Bella Pools" refill the pool and do the chemical start up as their price was lower than our's to do so.    I notified all Real Estate Agents (emails to prove it) when work was complete and to let the work dry a day or two before filling up the pool.     Doug's wife called shortly after moving into the home wanted to talk to Jared.    She would not say why she wanted to talk to him.   Jared is an owner of this company and runs 3 crews.    He, admittedly, does not like talking on the phone.    After a few weeks of Doug's wife calling but not being willing to speak to  me we were notified from BBB (where we have an A+ rating) of their complaint.   Jared then called.  He did not call until then as often when people buy a new home with a pool they simply want to pick our brains as to how to take care of it and he just doesn't have the time for that.   The battles commenced from there as noted in their complaint.   Both the BBB & The California State License Board dropped their complaint.   I do believe the Real Estate Agents dropped the ball for their customer.   We came in, did a repair (a free repair at that) and left.    The email wars and hassles were stressful for all of us.    I was never rude to anyone and in fact was extra gentle with Doug's wife as I could not even imagine going through an escrow and a pregnancy at the same time and was concerned for her health!  I do stand by my comments about her Real Estate Agent.    However, this situation was the straw that broke the camel's back for us to ever assist with a pool that has a vacant house.   We learned from the License Board that we do not have to honor any warranty once the owner vacates a property.   Again, it was stressful for all.   We wish the young new homeowners and their new family the best.   Sincerely, Jennifer Ferrall, Office Manager, Fiberglass Pool Resurfacing, Inc.
