Please see my emails below that were sent to the company, they sum up the issue.

Monica,

I have forwarded my emails that have been sent to the Creekwood email address during the past year. As I explained in our conversation, I also made many phone calls during the past year in which I was told the repairs would be made the following month. Each time, no repairs were made to the roof. Your company has had one year to complete these repairs and yet, they have not been made. At this point I have given more than ample time for your company to correct this issue. I would like to end my lease effective January 31st, 2008.

I look forward to receiving your response which during our conversation today, you stated would happen via telephone tomorrow morning after 10:30am.

Thank you,

Nicole

It has been over one month since my last email. After my last email, I was again told that the roof would be getting fixed. Now that there is snow on the roof and mold already starting on the ceiling and windows, it is clear that the roof will not be fixed this winter. I have been extremely patient waiting for one year for your company to complete repairs that were promised to us. I am absolutely frustrated with the lack of response that we have received. Today I received a work order stating that the mold on the celing and windows was cleaned. There is still visible mold in both of these areas. One spot on the bedroom window is large and "fuzzy" in appearance. It appears to have not been treated at all.

I have given ample notification and time to allow your business to resolve the roof leak that is causing this problem. At this point I would like to end our rental agreement effective as of 12/31/07. Your company has had ample time to make the nessecary repairs the apartment, and has not completed these repairs. This is a breach of our rental agreement specifically the Mold Prevention Addendum.

I have taken additional pictures of the mold growth that has occured this year as well as pictures of the mold after it has been treated by your staff.

I have also complained of our door being left unlocked in the past month by maintenance who had entered our apartment. Going forward, I would like 12 hour notice of any persons entering XXXX Apartment #XX. Either I or my husband will need to be present when our apartment is entered.

Please contact me via telephone at XXXXXXXXX on Decemeber 20th, as I would like to further discuss these arrangements.

Sincerely,

Nicole

It has been nearly one year since we began experiencing issues with mold in our apartment. Last winter we were told by the maintenance employee that this was due to a leak in the roof that could not be fixed until the spring or summer. We were assured that it would be repaired when we signed our lease extension. I checked back this summer and was assured it would be fixed by labor day. The day after labor Day it still hadn't been fixed, so I called, and was told that they couldn't get to it yet but that it would definately be fixed in the next two months. It is now November and still no repairs have been done. I will not live through another winter of wiping down windows daily and removing mold from my ceiling, because your company chose not to complete the nessecary repairs. We signed the lease extension with the understanding this would be repaired this summer, and this has not been done. When is repair on this roof scheduled?

Thanks,

Nicole

Eric-

I have attached photos of the mold that I discovered yesterday. I first noticed the mold above the patio door, but upon further inspection I found mold in each of the window sills as well as on the patio door. As directed by Angie, yesterday, I used bleach to clean these areas. Also per our discussion today, while inspecting our apartment for mold, I found the source of the puddle in the kitchen that has been reported several times. The drip pan in the back of the refrigerator actually has a hole rusted through it allowing the water from this pan to leak onto the floor creating a puddle.

Sincerely,

Nicole
