Fifth Third Bank - Dowagiac made two instances of egregious error and refused to acknowledge them.

1) Allowed an automatic bill pay on a closed account. Paid the bill and then assesed overdraft and insuffucient payment fees to the account.

This went on for several months without any notice to me of the issue. The fees the bank allowed to accrue was $256.

The first notice I received that something was wrong was a bill from a collection agency.

I protested the action to the bank. They refused to help since the collection agency now owned the account (it was out of their hands). I disputed payment to the collection agency. They refused to help and demanded payment. My credit history had taken a hit so all I could do was pay the collection agency rather than have my credit continue to be damaged.

2) Implemented an overdraft account (ironic - isn't it) without my authorization in 1998. I never received a statement for this account - nor was any record of this "protection" displayed on my normal checking statement.

The bank has been issuing a monthly fee for this account plus assesing late fees for non payment of the monthly fee since inseption. Total fee amount they assesed was $2,928. Yes folks - this is just FEES.

The first notice of a bill was 30 days after I closed the checking account. The Bank has admitted that they do not have any evidence of my signing up for the overdraft protection account. However, they are demanding payment and are threatening to send this to collection if I do not pay.

Sure could use some help with this.

Statue of Limitations

I would check with my states Statue of Limitations Laws regarding this collection account..Since it has been since 1998.. My question is why didn't you stop the automatic bill from coming thru when you closed the account? That's not the banks fault, that one is yours..Also you state that you never knew nothing on what is going on but yet state that you got a notice 30 days after you closed the account..You have to had something sent to you in all these years from the bank or another collection agency..Did 5/3's collection agency call you or sent you any source of letter or communication? Also if the account was still going on, did you get a monthy statement? Is it 5/3's collection department or is it an outside collection agency contacting you? And as far as having an overdrafct protection and not was notified, my bank did the same way and sent to me a letter letting me know that they have given to me $300.00 overdraft protection..They did not get my John Hancock either..I qualified for it due to being a great customer and a long time one..But since I have it , I will take care of it and never use it..It never shows up on your statements, nor do the banks send you a monthy statment on the overdraft protection..I suggest you take a good look at your accounts..They may have sent to you the information according to federal law, but like many of us think it is junk and throw it away.

Another thing, if it went to a collection agency, your credit has been ruined and your credit scores dropped because if it, even if you paid them..

You have to do both agencies as FTC compiles complaint data and OTS works on your behalf to MAKE THEM FIX IT!

As you read most complaints about banks and credit cards is they never are willing to correct the errors they make - making you the consumer responsible.

When the complaint comes to them via the OTS - they cannot ignore it - like they ignore you.. THEY HAVE TO FIX IT!

I also have a rip off report filed on Fifth Third Bank. (ck out Fifth Third bank in rip off search) They have done crazy things in the 14 yrs we have been with them, but I will say that it has gotten beyond crazy the past 8 yrs. I have personal accounts at another banking institution, and let my husband deal with 5/3.
In your case, they are absolutely WRONG for doing what they did, and you have all the physical proof you need. You can get statements online from that account (i still could and we had closed the account) but if not, all you have to do is request statements prior to closing the account, and through the months following the closure. I would do it at another branch, not your main one. It will show on the statement that the account is closed, and then the next month it will show it was reopened to make a payment, and of course all the fees associated with it. You should also have the fees for the overdraft protection showing on there as well.
Please don't feel as if you don't have a case, because you most certainly do. It is ILLEGAL for any institution to OPEN an account in YOUR NAME without your CONSENT, and then to make PAYMENTS????!!! And then to sign you up for OVERDRAFT PROTECTION, which of course requires your signature as well. This is outright IDENTITY THEFT and it by all means is prosecutable! You most definitely will win this case against Fifth Third and should do it. It will be worth it. Let them pay your Legal Fees too. After all, they signed you up for stuff and wanted you to pay all their fees. SUE THEM.
