This is regarding a plumbing leak that I request
service from first american home buyers protection
to cover, but can not get it resolved.

Around december 15th (I can not remember exact
date), I found water on garage floor while my wife
is using the sink in laundry room. I called FAHW
and they told me that someone will contact me shortly.

A plumber came in and open up the
dry wall from laundary side under the sink. He
located the leak which is around the area that pipe
intersects with the floor. He said that it will be a big
project. He can not fix it from crawl space because
he can not put in the new pipe due to limited space.
His proposed fix is to remove water heater and water
softener and open up the wall from garage side and
cut off leaking pipe and put in new one. He will
contact FAHW to verify their coverage.

I waited for a week since I think its holiday, maybe
people are not working. At the same time, we can
not use the sink. I called plumber and
FAHW around 01/02/2008 and I got answer that
they do not cover "making access". I have to remove
water heater and softener and the box in order for
them to repair. The repair itself will be four hours
of labor and $140 parts. total around $400. But
including remove water heater and later on install it
will be total $1400. FAHW will only reimburse me
$325. I asked them that I think they can do it from
crawl space without touching water heater etc, and
I requested second opinion. Their representative
(her name is Martha, extension 3265) said that they
decided and there is no need for second opinion.

There are many phone calls I made to FAHW and
straight plumbing on this issue afterwards to ask
for alternative ways for fix, because I believe it can
be done.

On 01/12/2008, I then called another plumbing company
(randomly picked up from yellow
book). A plumber came and looked at it. He said
that yes, he can do it from crawl space. He then
worked from crawl space and cut off the leaking
pipe from crawl space and also cut off pipe from
laundry room wall. Remove the leaking pipe and
insert a new pipe and connect together. There is a
crack in the leaking area. His charge is $850. I
finally have it fixed.

01/14/2008, I called FAHW lady Martha ask for
reimbursement of $850. She ask me to fax my
document to her and she will review it. I fixed it to
her.

01/16/2008, I called her again. She said that my
plumber also made access because they open up
dry wall so they won't reimburse. But the my
plumbing contract says "customer already opened
dry wall", which is opened by FAHW's own
plumber. She then said she will talk to her
superviser and call me back before end of the day.

01/17/2008. Of course she did not call back. I
called her again. She said that it is a modification
and they do not cover modification. What is the
modification? Fixing leak is a modification? She said
she contact my plumber and she was told it is a
modification. I called my plumber but they told me that it is not a modification that he would think of. I called Martha again and explained to her that there is
misunderstanding between my plumber and her. I
ask her to call my plumber again to have them explain
more in detail, or send someone over to take a look. I still have the old pipe and they can compare.
Again she refused to look and refused to reimburse.

I am totally pissed by these people and I think this
home warranty is totally a scam. Never ever buy home
Warranty from them. They just treat your premium as
donation!

I am now seeking lawyer to do this and if any one have a class suit going on, please let me know.
