I was a chef(not owner) of a restaurant in Florida, which closed after the oil spill.. I personally saw to it that all the equipment, including our check machine, was returned to the merchants. The check machine was through First Data Global Leasing. I was assured at that time that all services were terminated and that all debt was settled. I even made follow up calls with them to be assured of this fact.. Keep in mind I did not even own the business, and was only an employee.. So 7 months later I was in the middle of trying to buy a home when the bank tells me I had to low a credit score to get qualified.
I was stunned as I should of had great credit, above 700... When I checked my credit report, there it was a derogatory charge off from first data for $748. It dropped my credit over 80 points. I contacted them and after moving through their channels all day finally I was directed to a collection agency, which told me that the charge was actually over $1300 after their collections fees, and the original charge was an early termination fee.
They said that even though I did not own the restaurant, or even that it was not my responsiblity, that I MAY have signed a personal guarantee. I had no idea I signed anything like that... So even though I never received a single notice nor where they sure I ever signed anything that I was responsible for the debt... So the credit I have worked on my whole life is partially ruined and even if I pay the ridiculous debt then it will not be repaired for several years because of this.. I am taking legal action against them. I cannot buy my home which I will lose. I believe this to be unlawful!
