I am rented a single family home from a property management firm in Orlando called FLA Rent. I signed my lease 9/2009. I was served with foreclosure documents on 12/2009 for the property. The documents state that the owner stopped paying the mortgage 2 months before I signed the lease. (Isn't that fraud? I have put a ton of money into this home 
between rent the deposit, first, and moving costs!) 


The foreclosure documents also say that per the owners mortgage, she is not allowed to rent the property. (It's in the second home rider) When I call the property manager he berates and belittles me, all the while telling me the owner is refinancing. I check the county civil docket every other day, and the owner did not answer the lender within the 20 days permitted, and now has filed an affirmative defense with claim to surplus funds. (No protection for the tenant's?) I
have tried talking with FLA Rent, and they refuse to let my family move. 


(FLA Rent did not even want a copy of the foreclosure documents, every time I call they berate and belittle me). At this point didn't  even have a valid lease since these documents have a second home rider. (Per Orange County Courts)

Many people are experiencing the effects of this economy and every one of them feels that this is unjust, but that is the way it is at the present.  A foreclosure from what we have seen takes a long time especially now, banks are renegotiation their loans in order to save the property and preserve a loan rather then take the house.  We cant break policy for you, as it would set a preference for others in your situation.  If this means you need sympathy, or soft hand Im sorry this is business and we conduct ourselves accordingly, we work for the owners of the properties and make every effort to keep a good business like relationship with our tenants.  I hope we have clarified this situation for you and you have a better understanding why we can not honor your request to vacate.

 This is predatory and rampant, and
putting families like mine on the street with debt up to our eyeballs 
with these incredible moving costs.
Why aren't property management firms required to check mortgage status 
on a monthly basis? Why are
tenants "locked" into leases once they are served with papers? As the 
tenant we should be refunded immediately
and given the option to move. Why are the blue collar young families, 
and college students the ones
that are being forgotten and left unprotected? I mean come on..How is my family 
supposed to survive with people actively preying on us and everyone turning a blind eye?
