Exactly like many others I was a few months behind on my house payments. I applied for a remodification and after 22 months of sending in document after document because they lost them or claimed they were never sent in, refusing to take payments but not having an issue with reporting the payments as late, never getting to talk to the same person, i receved notice i was going to be forclosed on.

To say the least I was furious when the judge sided in their favor,  not holding them responsible for holding up their end or doing their job corectly, even with documentation shown to the judge he ruled in their favor.

I hired a firm to represent me and try to work with them on the remodification, but to no avail they did the same thing to them as me, gave the run around kept requesting the same documents over and over again.

When they sent me 3 other options to save my home, they refused all offers given to them on a short sale. They had no intention of every letting me keep my house from day one.

I am seeking an attorney to at the very least get the intertest and the court fees and any other outragious attempts to rip me off and ruin my credit removed from my record as well as all 3 credit reporting agencies.

I will seek damages for ruining my credit and the mental and emotional damage it has done to my life and my families.

These Federal employees should be behind bars as last time i checked..theft was a felony.

Please be aware that the CFPB just fined Flagstar 26.5 million and are divying out the proceeds to all the people who lost their homes in foreclosure to Flagstar.  Please look this up people. Google CFPB and type in Flagstar and it talks about all of the decieptful business practices this bank has engaged in.  Contact your state rep and your state consumer protection division as well.  I haven't paid a dime for an attorney, but rather told my reps that if this bank or any bank is allowed to practice in deceiptive business practices that they should capitalize and fine them.  Keep concise records. Either your attorneys are on the take or the judge..but legislative representatives are above judges; congressmen, senators etc...We are American's We have the right to amend contracts, all business transactions can be amended or modified.  

Businesses do it every day.  The problem is that banks get money because they are federally insured (FICA) so they recoup their money regardless if you keep it or not, then they sell the house collect money, then they come after you for the difference.  It is called triple indemnity.  If they changed the laws and only had them collect from one of those three options they might have more incentive to work with homeowners.  Unfortunately, there is not incentive to do so.  So your only option is to contact state reps, your attorney general, and CFPB and file a complaint to have them keep fining them so that they have to start working with the homeowners.  But, don't give up, perseverance pays off.  Hope that this helps you.
