In February 2008 I had moved to jeffersonville indiana from lincoln park michigan.  In February 2008 Got a job with dollar general in May 2008.  Worked my way up from a cashier/stock assocaiate to a manager. Started earning salary wages. In May of 2009 my wages were Garnished by Ford Motor Credit Company. I had a ford focus 2005 repoed. 3 months behind on payment couldn't catch up no matter what I came up with the interest alone was eating up every payment I made.  So I basically surrender the car. Called company told them car would be in front of my house to come get it. The car set infront of my house for 12 days. The collection company continued to call and harass me for payments. I kept telling them I did not have a job, the cars was available for them to come get. 

     So after my wages were garnsihed I accepted responsibility.  I knew the day would come.  In September of 2012 I receive the usual letter from court judgement and there was no amount written. Form had been signed by clerk court and agent/attorney.  
    I felt relief of no more garnishments of my checks. So I assumed payment had been made in full, after all they had garnished $9028.99 dollars from me.  Which I thought was weird. It was always my understanding that once the car was resold, that $ amount would be subtracted from the balanced owed and i would be responsible for the rest.  So total garnishment was $12486.97 - 9028.99=3457.98 so can someone tell me why on 01-08-2013 Did Ford motor credit start garnishing my wages again?  How can I find out how much car was sold for and how much more are they going to rob me of my wages??  The car only had 4000 miles on it.  I know for a 2005 focus they had to have gotten at least 5 to 7 thousand dollars for that car. 

           I am not able to get a car, get an apartment or even a simple line of 200.00 credit due to thei garnishment. Can anyone help me with this.?

 You are basically asking questions that can't be answered here because no one here has the information you have.

But first you have to be aware of a few things. 

If the original Garnishment order was for $12,000 that means that the amount your car was sold for was already taken into account.   As by law the car must be sold anywhere from 10-30 days(depending on the State) after the Reposession, and it would have been included in the original suit.  So for example if they did get $5,000 for the car at auction the actual debt could have been in the $17,000 range(but after you include things such as court costs and fees it was probably more).

You are also not including Intrest, as the unpaid balance of the judgment still will have interest assessed.   It is probably a lower rate than the original loan, but even so, in the 3 years you probably had about a couple thousand dollars of interest added into the balance. 

So it is possible that you could still owe at least $4,000-$5,000 and depending on how much they are ganishing it could be another few years to pay it off.


If you want to know the details as to all of the amounts, you are going to have to do some legwork.  You will need the original suit as that will have all of the calculations.    This can be done by contacting the Clerk of the Court.  You say you keep receiving letters from them so hopefully the actual case numbers will be on one of the sheets of paper you have.  If you really think they are wrong you may want to hire an attorney...they would probably charge you for a couple of hours of time.  Where depending on the attorney could be $100 or $1,000 or $10,000...but all would quote you in advance as to their fees.  Some may even give you a short consultation and let you know how you can do things on your own. 

 

As a hit to your income the Garnishment is causing you a problem, but it is not a primary reason why you are being denied for credit.  It is the fact that you have an open judgment and a Reposession.  Yes..even though you told them to come and get the car it is still considered a reposession.   And even if you paid of the garnishment today..the Reposession will still be on your credit report for 2-3 years.
