I ordered printed napkins for a Superbowl party for $25.00 plus an expedited shipping fee of $25.00 for a total of $50.00.  The napkins were guaranteed to arrive on February 3rd.  They did not arrive until after the Superbowl on February 7th.  Since they were printed specifically for the Superbowl they were essentially worthless.  I contacted the company and they said they would resolve the matter.

They sent and e-mail stating that when I place another order I will have a $25.00 credit.  I contacted my credit card company to file a dispute.  They put me on the line with the President of ForYourParty.com, Sarai, who spoke over me so that I could not be heard, refered to me in an insulting manner to the credit card representative and finally hangs without completing the call.

I have no interest in doing business with a company which handles itself in such an unprofessional manner.  I have already suffered the loss of $50.00.  To force me to place another order and spend additional monies in order to receive a $25.00 credit is self-serving and unprofessional.

Sorry, guys, but I am with the seller on this one. The order could have and should have been placed earlier and the shipping charge would have been much lower. 

The seller did their part by getting the product to UPS on time.  It would be nice if UPS would refund the shipping costs but under contract law a seller is not liable for damages that arise due to an act of God.

Just give her a refund?

How hard is it to give her a refund? You promised to deliver a product on a certain date and you failed to make good on that promise. Don't blame the weather, god, or your dog eating your homework.

It unbelivable that you would come on here and make excuses as to why you do not have to issue a refund. It's pretty obvious your customers do not come first and your poor excuse for customer service is deplorable. People would be wise to stay away from your product.

Call your bank and issue a charge back on your card. Then she can explain/make excuses to visa/mc/whoever when they take the cash back.

Pamela,
Your order was sent out in plenty of time to arrive on time per UPS. Unfortunately, the massive storm hit and engulfed virtually the whole continental United States. ForYourParty.com, as well as 
any website who ships via UPS or FEDEX, as well as UPS and FEDEX, is at the mercy of Mother Nature.  Being from New Orleans, you should have an appreciation for what Mother nature can do! Anyone who has ever bought anything online knows that delivery dates are never guaranteed. All UPS or FEDEX will do is refund the cost of the shipping if it is their fault. Unfortunately, in the case of the storm that swept the nation, UPS and FEDEX do not refund the cost of shipping in these situations.
ForYourParty.com sent out all of the orders that needed to be shipped by that Friday on Tuesday, February 1. Had the storm not been so devasting, you would have received the napkins ahead of your need-by-date.
We are deeply sorry, but there are shipping disclaimers throughout the website. ForYourParty.com is no different than any other website in guaranteeing delivery in adverse weather conditions.
Offering you a $25 credit was above and beyond what we are required to do, per our disclaimers, that, once again, are all over the website.

Merchant Is Responsible

Even if it is UPS' fault, I'm pretty sure the merchant still has an obligation to compensate the customer appropriately. Then the merchant has to go after UPS if they feel it is UPS' fault.

The customer's contract is with the merchant, and the customer paid the shipping fee to the merchant. It was the merchant's choice to use a particular carrier and shipping method.

So a post from the merchant blaming UPS is actually an admission of guilt.

UPS Shipping Issue not US!

This customer Patrica Stegg did order product from us for a party on SuperBowl Sunday. She ordered personalized napkins on 1/27 late in the day and wanted them on 2/3. We made and shipped her order exactly as she requested. The order shipped UPS Air on 2/1. Unfortunately, there was adverse weather conditions and UPS was unable to make the delivery on time. UPS takes no responsibility for acts of weather and will not reimburse customers for shipping costs. Because of this, we post information exactly about this in our FAQ's (see below).

We contacted UPS and asked them to reimburse our customer for the shipping charges but they refused. Because we felt bad about the situation, we issued the customer a store credit for the cost of the product she purchased $27.00 but since the shipping cost when directly to UPS it is up to them to credit her for any losses which they will not do.

We provided the customer with excellent customer service, call backs, a store credit for the amount she spent with us and yet she called screaming on the phone and disputing charges and would not listen or discuss this with us.

We feel we have done all that we can to make this customer happy by giving her a store credit for the amount she spent. 

The information below is CLEARLY posted on our site FAQ's:
