Four Star Homes Failed to disclose true info about home & kept my deposit after sale failed due to agent misrepresentation! They cashed my deposit & distributed it to agents-seller & office before closing date and will NOT refund! Port Orange Florida

I was looking to buy a manufactured home and went to several offices in search of one. I found a manufactured home thru FOUR STARS and made an immediate offer..it was immediately accepted..naturally when you make an offer you base it on what you are told and believe to be true. I made a $1,000.00 deposit based on what I was told and believing it to be true.

I went back to the home several days later without the agent to measure a couple of things and the seller was more then nice and had no problem letting me do this. When I was there I found out from the seller that in fact the things I was led to believe by the sellers agent's description of home (in writing in their ad) were in fact not so! I was led to believe dishwasher was new (i was told it wasnt hooked up and she had no idea how old it was..it was just in the space under counter never used!)..I was told the refrigerator was new (yep-was new in 1972)..I was told washer & dryer were new (again not true) and so on!

I immediately called the agent at Four Stars and was told different stories-excuses-so on. I said I based my offer price believing what I was told to be true and now found out in fact it was not. They wouldnt adjust price. They wouldnt refund my deposit. And actually..the closing date I was given was August 14th and the seller was told August 15th..(2 different dates? since when?)..as far as I know the law states that the deposit is to sit in escrow untouched till closing..my closing was to be August 14th however the bank statement says that the deposit was cashed out on July 24th..3 weeks BEFORE closing date! They wouldn't give me my deposit back after they misrepresented these things to me.

As a matter of fact the OWNER (of Four Stars) told my cousin (who is in real estate business) that they already distributed the deposit between the owner/the office & the agents! The OWNER (of Four Stars) said she'd consider giving me $400.00 but didnt feel she owed a thing since the deal failed. THE SALE FAILED BECAUSE OF THEIR MISREPRESENTATION -NOT me! Now they wont refund a penny! I want my deposit back!

They failed to disclose the truth and misrepresented this manufactured home in order to make a sale-as a matter of fact... their WRITTEN advertisement was changed AFTER I told them that I found out that what was represented was not true! (they had no intention of changing it to the truth if I had never found out on my own!)

Please help me get my deposit back! This is not fair!
