Foxmoor at Galloway Foxmoor Real Estate, Vincent Simonelli, Foxmoor Estates Kept my deposit money despite our contract... and judgement in court Galloway, New Jersey

A $5,000 earnest deposit was given to Foxmoor at Galloway for a newly built home. Our contract clearly stated that we would get our deposit back in case we didn't secure a mortgage. I provided a decline letter with a request for my refund to Vincent Simonelli, the builder we were doing business with, with no response. Several months later, I got a call from someone from his office asking if we could be paid back in "installments." I declined as I had not paid my deposit in installments and had just depleted my savings burying my mother, which was unexpected.

Subsequently, I won a court judgement for my deposit monies to be refunded. To this date (8 months since court judgement),  I have had no response from Mr. Simonelli, Foxmoor, or his attorney. This company remains in business and continues to sell homes. When asked through the courts to give financial information, they sent me a response with their name, address and telephone number only, everything else was "not applicable" or "none," which I know is a flat our lie as I have watched continued construction...building of homes.... and for sale signs go up and down in this same community.

I am infuriated that I worked so hard to save my money to buy a home and this man/company will not give it back despite a court judgement. I feel like there is nothing besides shuffle paperwork through the court systems that I can do to attempt to get my money back. My next step is seeking the medias help in an effort to at least stop this thief from ripping someone else off or seeing just how how many others may have been ripped off as well. My advice - DO NOT DO BUSINESS WITH THIS COMPANY OR THIS BUILDER. SEEMS NICE BUT HE IS DECEPTIVE!
