One person, against the big company. HOUSTON 06-08-2009
How much can a big insurance company put you through, in this case the company is LOYA INSURANCE COMPANY.
Story
Person backs car on a parking area in to my cars rear-end while I am parking on the opposite side; the car driver is sorry and gives me all information needed so I can fix my car through LOYA insurance company. So far everything is fine. I call the LOYA insurance company and give my estimate from my car dealer for how much it will cost (the car dealer tells me: that I probably will get in trouble with LOYA they have had a lot of problems for payments before from LOYA). LOYA gives me a claim number and wants me to wait 3-4 days so LOYA can send someone to take pictures of the part that has been damage and in return estimate the costs.
It took them 7 days and LOYA estimated the cost for half the price, now I am getting upset, who is going to pay for the rest. Now LOYA is starting to blame me for being irresponsible and LOYA suddenly wants me to,-pay more attention when parking so I have to take that.
I want LOYA to take their responsibility and pay I had nothing to do with the accident, I could of left the car and still it would have happened. But according to LOYA I should have honked or somehow given notice of my appearance to the other car.
I had had my car fixed at this time and it is now 2 weeks after the accident. I am supposed to get my car. BUT LOYA has not sent me any check. I call LOYA and LOYA has made a mistake sending the check to wrong address: how can you send my check to an address that I have not given you? Answer from LOYA clearly you gave us this address. NO why would I give you an address that I am not living in!!
LOYA promises to send a new check to my right address, nothing happens. I call LOYA again after 3 days now LOYA says that I have to wait till the wrong address check has been VOID so they can send a new one.
I ask what address they will send the new check to and LOYA gives me the wrong address again. Now I want LOYA to definitely change my address. I still have no check and no car.
Where is the responsibility from the BIG company, what am I suppose to do???
It is now 4 weeks and LOYA has done nothing my car is waiting for me, but how am I suppose to pay 1300$ just like that I am not rich as LOYA and I am very much innocent. I want everyone who has to deal with LOYA INSURANCE COMPANY to know about this event and let them be aware of what kind of insurance company LOYA is.
ONE lonely person who JUST wants justice against the BIG Company.

About a year and a half ago, my little brother and his girlfriend were hit by a drunk driver. The driver hit and run and my brother, (who thankfully was in a larger car than the one that hit him), followed her. They got to the drunkard's apartment complex and called the police.
The drunk party had Fred Loya Insurance. After a couple weeks, Loya called to say that they would not pay the claim because the drunk party "said they didn't do it".
I hate to sound like a nationalist, but Fred Loya is geared towards illegals and nearly-illegals. The drunk driver that hit my brother didn't even have a license but the policy was in her name. What kind of company grants someone without a license a car insurance policy. This was more than likely because she wasn't a legal citizen.
My advice is when an insurance company doesn't pay a claim, just sue the driver.
That way, the insurance company faces the possibility that the driver will drop them for refusing to pay claims OR you get a judgment against the driver and if they don't pay, you can place a lien on their property.
This may not do much for getting your car repaired but, in volume, it will send a message.
