More Info. vs. Hanna

It looks like Rip Off Report redacted my links on how to fight debt collector lawsuits for Hanna and Zwicker, and for help blogs.  For help with the lawsuits you can do a Google search for a book and website by Allen Harkleroad titled Stick it to sue happy debt collectors.  The help blog I linked is Next Level Unlimited Credit.  I do not have any stake in any of these sites, I am just posting to try to help other consumers.  I do understand why Rip Off Report redacts links however.

Info. vs. Hanna

The Georgia Supreme Court says Hanna is a "law firm," so you have to submit a bar complaint vs. them (and not a consumer complaint with the state OCA or federal FCC -- but fine if you do that too anyway).  You may submit a bar complaint vs. Fred Hanna (the owner of the "firm") and any atty. that may have contacted you that also violated bar rules for atty.s:

This is my formal notice that I am disputing this debt, and requesting immediate validation under Section 809 of the Fair Debt Collection Practices Act, 15 U.S.C. § 1692g, of the debt from your office.  I am requesting that your office immediately send me a copy of the following documents: (a) the name, address, and phone number of an employee of the original creditor that can validate the debt, (b) proof of who is the current legal owner of the debt, and that you represent the original creditor or debt buyer, and (c) the original signed note, contract, credit agreement, or instrument creating the debt.

Did you receive a summons to appear in court...and if so, did you show up? Not showing up in court means a default judgment against you...even if you do not owe the debt. If you did not show up in court...there is nothing you can do now

If you did NOT receive a summons:

It should always be a matter of concern when bank accounts get frozen without any prior, advance notification. Judgments cannot come out of the clear blue sky and debt collectors cannot assess judgments on their own. Only a court can do this.....A process has to be followed: Officially serving you a summons....this is usually done by a sheriff. A court date is established and on that date you face your creditor. If they win and a judgement is assessed...only THEN can they freeze checking accounts.

Many bottom-feeder debt collectors have figured out that if they "accidentally" serve you a summons to an old/incorrect address where they know that you won't be there.....that you will be a "no show" on the court date because you weren't aware of it.....Then.... boom....an automatic default judgement is assessed against you. This is how these bank account freezes usually occur out of the clear blue sky. When the time comes to assess the judgment, they have no trouble finding your "real" address.

It is illegal to deliberately serve someone at an incorrect address. This tactic is called a "sewer service" summons delivery. If you can document that you were improperly served, you may be able to get this judgement vacated.

Missing info in your report

1st of all they cannot get a garnishment without a court order - which means they have to sue you first - Did you get served? If yes, Did you show up to court? If you were not "PROPERLY" served - you can have the garnishment overturned.
You have to get the paperwork to find out what happened. - get that from the courthouse the case was heard in.

If you were served - Not showing up results in default judgement.

This Collection Agency is one of the worst,for filing falsified court docs, not serving people correctly - yet claiming they did. They also break FEDERAL LAW regularly -
