Frederick J Hanna voluntary dismissed Marietta, Georgia

My sister was taken to court this week by Hanna and Associates on behalf of Midland LLC.  There were several other defendants there in court.  Prior to the hearings, Hanna will meet with you to try to reach a settlement.  Admit to nothing and force them to prove your debt.  If you acknowledge the debt, you loose.  Tell them you neither acknowlege or deny the debt, but you require proof.  Ask to see the original...repeat original signed credit card agreement between you and the credit card company.  Mostly likely the credit card company wrote off the debt and Midland LLC represented by Hanna is a junk/zombie debt collector and they do not have these documents nor are legal representatives of the credit card company.   Again Google to learn how to protect yourself.

 Prior to the hearing the Hanna lawyer met with my sister.  My sister demanded proof of the original debt.  The attorney went balistic and started yelling.  Told my sister that in magistrate court, Hanna did not have to show my sister what evidence they have.  That was a lie.  My sister told the attorney that the magistrate court must be confused because the court clerk told my sister that Hanna did, repeat did have to show her evidence of the debt.  Don't accept anything Hanna shows from one of their employees.  That is third party info and not valid.  Again google to learn more on what to do and how to conduct yourself in court.

 The attorney told my sister that if she wasn't ready to settle, the attorney was going to voluntarily dismiss the case without prejudice and would refile in superior court.  This is a tactic/last ditch threat to get you to settle.  Don't let it scare you.  If Hanna had, repeat, had the evidence, they would proceed with their case before the current judge.  My sister said fine and returned to the main courtroom.   Shortly after, the judge called my sister's case and he commented that..."I see you forced a punt, good defense".  We interpret the judge's comment to mean Hanna bluffed and my sister didn't buy it forcing Hanna to dismiss.

(For those of you that want to complain vs. Hanna beyond Rip Off Report).  The Georgia Supreme Court says Hanna is a "law firm," so you have to submit a bar complaint vs. them (and not a consumer complaint with the state OCA or federal FTC -- but fine if you do that too anyway).  You may submit a bar complaint vs. Fred Hanna (the owner of the "firm") and any atty. that may have contacted you that also violated bar rules for atty.s:
