 I went to Fredy Kia on December 5, 2016 in search of a vehicle and I was convinced to purchase a 2006 GMC Envoy Denali XL that the salesperson Johnathan stated was in excellent condition with no major issues and all the dash lights were off which was a good sign and it test drove okay so I decided to purchase it buy paying a $900 down payment with a $400 car note. Before my 1st car payment was due the check engine light came on and I contacted Johnathan who insisted the vehicle had no engine problems and that it just needed a gas cap so I purchased one from Orielly's and once that one didn't work I purchased one directly from Chevrolet; however the check engine light never went back off. I contacted Johnathan again and he stated as long as the check engine light wasn't blinking it was not an engine issue. I purchased new tires and a new spare tire for the truck for $500 because the tires on the vehicle were starting to dry rot. I also paid three car notes totaling $1200. I spent $174.25 for parts for a new radio along with $166.68 for the new radio and $101.73 for headphones for the tv in the car for the kid. I also got the oil changed for $69 at Strickland Chevrolet a couple of days before the truck broke down on me. My uncle a mechanic checked it for me after I left Chevrolet because the lights were still on and it had all the correct amount of fluids in it. On Friday, March 31, 2017 I called Johnathan because the truck started making a weird noise while I was waiting at the bus stop for my daughter and the overheating gage appeared to no longer be working. He stated he could set me an appointment for April 27, 2017 at 8am to have a diagnostic test done on the truck which was the earliest appointment he had so I took it, but upon driving home from picking up my kids from school I heard a loud popping noise and it cut off after giving off so much grey smoke that I thought it was on fire. I called Johnathan back and he sent a tow truck to pick up the vehicle and drop the kids and me off at home. On Monday I went to the dealership to sign paperwork for the diagnostic testing and advised him that they sold me a lemon because I've only had the vehicle for three months and I've kept up with the maintenance and barely driven the vehicle because I've been on bed rest since I purchased the vehicle due to my high risk pregnancy because of my chronic hypertension and my heart condition called cardiomyopathy so I only drive to take the kids to and from school. He assured me the vehicle wasn't a lemon and they would repair it. I called a couple of days later and Johnathan advised me that the truck needed a new engine and it was ordered from California and would be in on Wednesday April 26, 2017 and they would repair the vehicle. I contacted Johnathan on Wednesday April 26, 2017 to check the status of the vehicle and he informed me that the vehicle was ready, but the repairs cost $2995 and in order to get the vehicle back I need to pay $400 for the April car note along with $750 towards the repairs and they'll setup a payment plan at $50 a month that will be added to my car note until the balance of the repairs are paid off. So basically they sold me a lemon that I already spent $3111.66 on and now they want me to pay them an additional $3000 for repairs for a lemon they clearly knew had engine issues stating the vehicle was sold as is which by law implies that the vehicle will be in working order not that it will breakdown in 3 months after the purchase and they also want me to continue to pay my $400 monthly car note. This place Fredy Kia is a rip off and no one should shop there for anything used!!!!

I'm truly sorry for your terrible experience.

I was hoping to offer a little advise for potential future purchases, hopefully your next experience will be more pleasent.

First, I would like to clarify the meaning of the term "As-Is".  Under warranty law, "As-Is" does not mean that the product, this case being a GMC Envoy, is in perfect order, nor does it even guarantee that the vehicle is even safe or legal for use on public highway.  The term "As-Is" under warranty law, means that the purchaser, which is you in this case, accepts the product with any and all faults, apparent or not.  Please review your Purchase Agreement with the dealer to see if the vehicle was sold with a warranty, or As-Is. 

If it is As-Is, you agreed to purchase the vehicle with any and all faults, apparent or not and in doing so you agree to hold the seller faultless for the cost of any current and future repairs.  Once you sign the agreement, the seller then owes you a car, and you then owe the seller money, whatever amount was listed in the Agreement.  As the Agreement is a legal binding document, you must continue to honor your promise to pay for the vehicle, even should it fall into disrepair.

As for the cost of the repair, did you sign a Work Order?  If not, was the work performed without your consent?  If you did sign a Work Order, what were the terms of the Order?  Did you agree to an amount that you would pay?  Did it state any warranty for the repairs performed as indicated in the Work Order should you experience a similar failure in the future?  Does the warranty indicate or limit your available remedies in the event of failure?

Please read any and all paperwork next time you purchase a car or have work performed.  Take note of anything that the salesman promises you and ask him to include it, in writting, in the Purchase Agreement.

I really would like to know where you got your definition of "As-Is".  Because that is the first time I have ever heard that As-Is implies a 3 Month warranty.  Can you please provide us with a source for your definition.

Because "As-Is" in terms of a Used car means As-Is and NO warranty.  Where once you buy it anything and everything that goes wrong with the vehicle is 100% your responsibility.  Sometimes a dealer will offer a warranty, but unless you have something in writing that says the engine was covered you are responsible for the cost.

The fact is you bought a 10+ year old car with probably well over 100K miles on it.   Where while the check engine light is on what do you do?  Well you do what every other normal person would do...spend $442.65 on the radio and headphones.   Sure makes total sense after all you were on "bedrest" and barly drove the car so the radio is of course the more important repair and takes priority over eveything else.

By the way I just bought my kid a very nice set of earphones designed for children for only $29.99.

The real question is where was your Mechanic Uncle this entire time?  Where was he when you were buying the car?  Where was he during this 3 month period when the check engine light was on?  He could have easily scanned the computer codes to determine why the light was on.  Even if he didn't have the tools, just about every major auto parts stores will scan your codes for free.  Yet all he did was look at the fluids? 

One other thing that is a bit weird.  Just how could you have taken your car and have it totally repaired 3 weeks from now?  As you had all of this done on the 26th and 27th of April and it is only the 11th.
