My brother and I were considering an apartment in the same building I was presently living in. My brother submitted an application, along with an application fee of $700.00 that was to be applied to the security deposit if accepted.

We informed Gilbert we were not interested, as we had not heard if we were accepted after several weeks. The only thing I heard from Gilbert was him inquiring why my brother has a different last name. I explained why and he said he didn't foresee a problem. He never supplied us with a copy of his lease agreement; my brother has to this day never seen one, and the only one i have seen was from the previous unit a couple of years ago.

Formal acceptance and being provided with a copy of a lease are both required by state law. Despite not living up to his legal obligations, he is withholding the $700.00. He did however inform me that his brother is a layer that they will make it too cumbersome to get our money back.

I have also submitted a complaint with the Wisconsin Department of Agriculture, Trade & Consumer Protection.

Here is Gilbert Frenn from Frenn Brothers Real Estate's side of the story.

Morgan did file a complaint with the Wisconsin Department of Agriculture Trade and Consumer Protection. This agency investigated and decided to dismiss Morgan's complaint.

Morgan and a friend were tenants in apartment 102 of our building for over a year without any problems. He came to me asking to move into apartment 110 with his brother. I informed him that his brother would have to fill out a rental application and the apartment would be his.

It is our policy to ask for a $75 payment with a rental application. Once the application is approved, the balance of the security deposit is due within two days. Morgan submitted his brother's application and the full $700 security deposit because I told he could move into the new apartment, even though he and his brother had not signed the lease yet. He submitted the application and check by placing it in the mailbox outside my office. Morgan and his brother were to then come to the office during business hours to sign the lease. They never showed up.

On the first of the month, the day they were to move to apartment 110, Morgan informed me that they decided to move to a different building. I had stopped showing the apartment to other prospective tenants, and ended up without a tenant for that month. This is why I did not return his security deposit.
