To whom it may concern;

I want to start with explaining to you the occurrences of what happened on the day of June 10, 2013 (the day I called Catholic Charities and Neighborhood Center pleading for help and could not get a hold of anyone who matter because Sherry was away on vacation and the Neighborhood Center was in a meeting).

The morning of June 10, 2013 I woke up like every other day, got my son ready for school and was waiting outside for his school bus when two women started to argue and looked as though they were going to be getting physical. I called the property manager, and he failed to answer his telephone. So I asked the women to Please take their argument somewhere else because I had to put my child on the bus. One of the women then proceeded to started screaming at me and started walking towards me. I quickly started to walk around the back of my building to get into my apartment banging on my window as I walked by in hopes my cousin would hear me and open the door. I was scared some woman I didn't even know was going to harm me or my son. When I got into the back door my apartment manager was standing by my apartment door and he started screaming at me. And at this point up until this very day I STILL don't know why. But he put his finger on my chest and poked me and spit on me and managed to spit IN MY MOUTH! My apartment manager is a six and a half foot plus intimidating black man. I pushed by him and dragged my son into my apartment where I then called 911. The police came and talked to all parties and left without giving me any relief. I called the apartment manager, Tiffany Samaroo and explained the situation and told her I had never been so disrespected in my life and wanted to put my 30-day notice in. I then tried to leave my apartment to DRIVE my son to school because he never made it to the bus. But I could not leave my apartment because every time I looked out my peep hole the apartment manager was standing by the door waiting for me. I asked him if he could move so we could leave. He took a few steps away and I opened the door. Then he ran at me and started screaming terrible things about my disabled fat mother not knowing how to take care of her kids. Telling me I am nothing but a crazy fat slob. And He's not giving me the paperwork for a 30-day notice. That He's going to get me evicted and make sure I do not get my security deposit back. I closed the door and called 911 yet again. Also I called my father. While I'm on the phone with my step father He's screaming through the door that He's going to get me evaluated. He's going to get me arrested. I just told my step father to please come help; I'm stuck in my house. When the police got there they knocked on my door and I made the come inside and locked the door behind them. Then they asked me why I pulled a knife on the apartment manager Harry Grant. I told them I didn't pull a knife on anyone that I was the one who called police for my own safety. That I was being threatened and he was trying to get me evaluated or arrested. And they said well if the police come here again because you pulled a knife on someone you WILL be evaluated. They escorted me out of my apartment where I then went to retrieve boxes to start packing my belongings. When I came back to drop off the first load of boxes the 30-day notice form was under my door. I immediately filled it out and had my aunt Carlie Heysham FAX it from her work at Slocum Dickson. Where we received a confirmation stating that the fax was received (but I No longer have this as my sister scrapped her car the form was left in). I then picked up my son from school and went home with my cousin's girlfriend, Yolanda Esmurria and another load of boxes. I was inside for 5 minutes making my son lunch when the police officer knocked on my door. When I opened the door he threw a handcuff on my left wrist. And by instinct I put my other hand in the air resisting arrest because I had been given No reasoning to why he was even there let alone why he was arresting me. He then grabbed me by the other arm with so much force that I had instant red marks. All of this took place right in front of my son. He then threw me against a wall where I let him cuff my other hand because he was hurting me and I couldn't take No more. After he had me cuffed he threw me across the hallway into the window and then pushed me over and over to the police car. Where he tried pushing me down into a mud puddle directly behind the car but I refused to go down. He pulls me up and starts calling me names over and over "you fat c**t, you disgusting Fat pig. You are nothing but a fat b***h." Then he threw me into the police car where my head smashed on the door on the way in. And I was sitting in the back seat when the apartment manager Harry Grant came out to the front of the building and looked at me and laughed. I then sat in jail for TEN DAYS. I was then served on June 12, 2013, a ten day move out notice. Effective June 10, 2013. I went to jail on 3 charges, 2 of them false. Menacing, resisting arrest and harassing an officer. I plead guilty on the resisting arrest, and the other two charges were dropped. That was June 30, 2013. As soon as I was released from Oneida County Jail I went home cleaned the apartment my family packed and then brought my furniture to the dump. Keeping nothing but dishes, clothes and my sons toys because the apartment was infested with roaches after they promised there were No infestations because I told them my son was allergic to fleas, bed bugs, roaches and mosquitoes (my mother, Karen Balanean was present at this time and can confirm this conversation). I placed one mattress on the dumpster behind my building because there was No room for anything else. I am currently residing with my mother on a temporary basis because I'd be homeless otherwise. I went through the apartment with another manager named 'Chris' and he said everything looked good and he'd send the apartment review to the "boss" where I'd then receive my security deposit by Check form through the mail (also these specific words were said by manager Tiffany Samaroo as well) . I called every day and No one ever answered finally the "BOSS" answered and told me I was not receiving my security deposit back because "you’re a scum bag, you destroyed the apartment, you turned the building into the ghetto and you threatened the manager your nothing but a Fat c**t you failed to leave the apartment I'm pristine condition and you never gave a 30-day notice" I told him I did none of those things and that I had pictures of the apartment and I would send them to him. He hung up the phone and has failed to answer ANY of my phone calls since. Also, he refused to give me his name and I have never heard him referred to anything OTHER than, "the boss".. [continued below]....


I have plenty of pictures taken from the day I handed my apartment keys into manager ‘Chris’, I took the pictures in his presence after he took a walk through of the apartment with me. The bath rail which was missing was priorly given to Maintenance/Manager Harry Grant because I was dangerously loose and falling out of the wall since the day I moved into the apartment. As well the floor tiles by the entrance door were ruined prior to me mobbing in and is obviously considerably older than one year, and I had only lived in that apartment for a little over one months’ time. Also I’d like for it to be known I was showed apartment 5 in the building located at 312 Blandina St. Utica, N.Y. but the day I showed up to move my stuff in he handed me keys and led me into apartment 2. And I asked why I was in 2 and not 5. He said it had already been rented, but I had paid the Security Deposit on apartment 5 and had not previously been told until I showed up that I was not going to be getting apartment 5. Apartment 2 was very disgusting and I was completely unsatisfied. I expressed this concern and disgust with Harry Grant and he said ‘well, if you don’t want to live here you have 72 hours to leave.’ I then said I can’t afford to leave I paid a nonrefundable security deposit. Tiffany Samaroo said that the deposit was nonrefundable if I chose NOT to move in. he then stated ‘well, I SAY, you have 72 hours to leave WITH a guaranteed security deposit return’. I had nowhere to go so I had to stay. The carpets were disgusting and stained with rust and god knows what else. The thermostat was chipped, the cupboards were almost falling apart in the kitchen, there were holes all over the bathroom wall, the tiles by the front door were dirty, old, raggedy, and had holes going inches deep beneath them, which caused me to trip and fall quite a few times forgetting it was like that. The paint in the kitchen by the stove and a few other random spots was dirty and stained. I asked Harry Grant for paint to cover the spots and he willingly gave me a brush and a gallon of paint for the kitchen, as well as for the bathroom. For which he had previously given me putty to fill in all the holes. Unknowingly I painted the walls, not realizing until the paint was dry that it was just a tad bit darker than the paint on the rest of the walls in the kitchen. It was a match to the entire house including the bathroom, but was a hair different than the kitchen. Harry said he didn’t realize that the walls were darker in the kitchen because he previously painted them darker because the girls that previously lived there had the kitchen so stained from grease that the lighter shade would not cover it. He then said that he would get me the correct paint by the next day. He never got me the correct paint and now they are trying to say I ruined the walls. When, in fact, I was GIVEN the wrong paint by the MAITENENCE slash MANAGER Harry Grant, and he FAILED to correct the issue HE had caused. Also I’d like to state the paint was FLAT ceiling paint that covered the whole entire house, causing the paint to look completely alike to the previously layed paint…until it dried. My bathroom toilet had been pulled up and switched on 3 different occasions until I finally got one that didn’t overflow from the seal of the toilet which meets the ground. But I still had considerable amount of flooding from the toilet and backup into the tub of feces, dirt, grime and who knows what else, due to poor plumbing of the building. I had Harry Grant come inspect my apartment and the rugs umpteen times due to this issue that everyone in the entire building had on almost a daily basis. I ruined almost every single one of my towels soaking up sewage time and time again. I suffered through the agony of watching my sons face swell up on an almost nightly basis due to the roach infestation as well, which Harry Grant insisted on many occasions there were no roaches in the building. As well as the fact that they had a professional exterminator service the complex once a month on the 3 rd Friday. Not once had I seen an exterminator, and Harry Grant came into my apartment ONE TIME, with an unknown, unlabeled bottle and sprayed for roaches.

Another tenant Rhonda Jordan had many of the same issues as I did with the apartment. But on the day of June 20, 2013, Rhonda tried stepping in on my behalf and had spoken to the officer that had come to the apartment building and told them that I had NOT pulled a knife on Harry Grant. And that I in fact, was the one who called 911 BOTH times. Rhonda Jordan and her son Omarion were also given a ten day eviction notice on June 11, 2013. One day AFTER she tried to help me out with the situation I was wrongly accused of. We believe we are being singled out undermined and discriminated against because we are the only Caucasians in the entire building. All other tenants are black and they stuck together, and the remaining tenants are Cambodian I believe, and do not speak English whatsoever and stuck to themselves. Rhonda Jordan was also denied her security deposit back. Their reasoning for her was she did not give a 30 day notice. But she was wrongfully evicted and was given a ten day move out eviction notice. And when she moved out they then began to pull the same crap with her they had with me.

I am now on the verge of being homeless once again and county alone is not sufficient enough to cover rent at any of the apartments I have found so far my cash allotment for me and my son is $498. I have No furniture of any sort or beds for me and my son to sleep in. And I am unable, by Dr's orders to work. I lost my rental stipend through Catholic charities due to the fact that I had been evicted and that is grounds for termination of their services. I feared for the safety of me and my son Christopher Keiser Jr. And put my 30 day in, but because they evicted me I lost these services. Harry Grant failed to give me a copy of the lease. I have a Check. Copy proving my security deposit was paid in full on the date of March 27, 2013, and deposited directly to gardens of Eden realty’s account at bank of America.

I am suing for the following items with an approximate money value and the following money amounts;

DVD/VCR combo -$30
full size bed set with frame, headboard, and mattress -$400 full mattress & twin mattress (from my sons bunk bed) -$300 stereo -$100
Towels -$50 (10 at $5 a piece) sectional -$600
Computer stand -$75
2 TVs approx. –$100 ($50 each older fat style)

Money for security deposit in full plus interest -$625 + $610 ($10 a day for 61 days and counting)

Compensation for monetary services provided by Catholic Charities that were lost due to eviction. (-$418 a month indefinitely)

Rent proration for month of June 2013 as I moved out on June 20 and was not living there for 10 days even though my rent was paid -$208.33

Rent back for duration of time I stayed there with an infestastion, and the problem not being resolved in amount of 21 days for month of May 2013, and 20 days in month of June 2013 (since prorated rent was alreadymentioned above I removed ten days, and I noticed the infestation on day 7 of me staying at this location) -$826.61

A total of $3,924.94 As well as $418 a month indefinitely

I'd also like to State, i'm having the SAME issues as the filer located above me because i CANNOT sue from Utica, NY as they are located in NY, NY. And they have no actual address, nothing other than a P.O. Box and i cannot sue someone without an address. Fortunately for me i have found the BOSS's name, and the other manager Chris's Last Name. and i WILL be Finding them!

On June 10th 2013  we received a call from a tenant claiming that Ms Heysham and Ms Jordan were bullying another tenant, using profanity and racist slurs.  Our superintendent intervened upon hearing the argument where both tenants Ms. Jordan and Ms Heysham then proceeded to direct their anger towards him, again using profanity and racist remarks.  Several tenants, not involved in the arguments gave the same story as to what occured, except for Ms. Heysham and Ms Jordan.  When our building superintendent tried to stop the argument Ms. Heysham went into her house got a knife and tried to attack him.  The police was called and she was arrested for Menacing in the 2nd degree, resisting arrest and harassment in the 2nd degree with physical contact.  We then had Ms Heysham and Ms Jordan served with ten day notices for violation of their lease agreement including disturbing the peace and quiet of the building and engaging in illegal activities.  

Following the ten day notice, Ms Heysham called our office stating that our superintendent had spit on her, to which no other tenants who were there could attest to, she also proceeded to say "now a n***a spit in my face, I may have aids cause a n***a spit in my face in my mouth".  My We proceeded to tell Ms Heysham that she can no longer stay on our premises and must comply with the ten day notice. Our building superintendent, regardless of the disrespect that Ms Heysham displayed towards him decided not to press charges against her.  He also stated that he felt unsafe and was always in fear for his life due to recent attempted attack on his life.

We would also like to add the we do not discriminate against any tenant for any reason.  When she left we inspected the apartment and noticed that things were broken, paint was peeled of the wall the carpet was a mess. Eventually Ms Heysham left and proceeded to write untrue and lengthy statements with no actual fact. 

She also threatened to sue us for supposed items in her home that were lost due to her moving without proper receipts or cause.  We would also like to state that we have Orkins visiting every apartment every month, we cannot force tenants to let Orkins into their apartment then have them complain about bugs or roaches due to unclean conditions of their apartment.  If you create a breeding haven for pests, they will find their way into your home at no fault of our own.  We encourage all tenants to keep their apartment clean and let Orkins inspect and do their job.  We address all tenant issues in a timely manner, but we will not have tenants trying to attack our superintendant or disrespect other tenants.  Our goal is to create a safe and clean environment for all tenants.
