After being rear-ended, i contacted the driver's insurance, geico, to make a claim. it was quite simple and very much by the books. Armed with all the driver's information, even as far as the VIN # of their car, and the police report from the accident for which the driver was faulted, the claim went simple enough resulting in an appointment 6 days later with an adjuster for geico.

The day of the appointment, i received a phone call from Geico stating that they had canceled the appointment because they were investigating the situation as it appears the driver may not have been covered at the time of the accident. Still calm, i accepted the situation and was told to wait a few days for them to figure it out. I went ahead and made a claim with my company for uninsured motorist just to be ready.

It has now been more then 3 weeks later and geico still does not know if the driver was or was not covered and not only refuses to have their adjuster look at my truck, but also refuses to give me the letter claiming uninsured motorist so that i can have my company fix my truck, which i would gladdly do at this point. They won't fix it and they are actually keeping me from being able to fix it. Currently, my truck has no back wind shield and the breaks are messed up to the point that i am afraid to drive it. but i will tell you this: i have written in thick black magic marker: "geico sucks!!!" on the plastic which is taped to the back of my still broken truck.

Insurance = Frustration

Jame: I know how frustrated you must be. I practiced in the personal injury field for 5 years and I know how difficult it is at times to deal with insurance companies.

The law must have changed since as subrogation used to kick in no matter what coverage you had at the time.

I am personally insured with GEICO and have been for 12 years. I have never had an issue with them, in fact, they have been very helpful and service minded.

I am glad, however, things finally went your way. Good luck in the future.

Subrogation does not come with Liability only

As stated before, I did review my policy and also spoke with people in the insurance industry (including a couple of Geico employees), so I learned that if you only carry liability (and of course UM), your company won't go through the steps of subrogation - that is something that comes with collision insurance.

Being an excellent driver with a sqeaky clean record and driving a truck which was not valued too high, i elected not to carry collision, therefore, i did not have the ability to let my company take care of my car and fight geico for me. and, to answer your question, I have been with State Farm for 6 years and I have never had a single problem with their service.

BTW - Geico, after 1 month and 1 week, decided to take care of my truck. Now, nearing 2 months later I have received their "prompt" payment and moved on from this issue. Perhaps they should take a little time and effort from their quirky tv ads claiming to save you money in fifteen minutes, and focus on prompt attention to incidents such as this in order to perhaps gain marketability among those that are affected by their actions.

If I ever decided to switch my own company and Geico had responded to this issue promptly, I have no doubt that I would have chosen them. How's that for marketing?

Georgia Law

Georgia Law requires that you carry UM. Your insurance company should then compensate you for your loss under your UM policy. If the defendant did in fact have insurance with GEICO, which is unlikely at this juncture, then your insurance Co will file a subrogation claim against GEICO. Why is your insurance company dragging it's feet? What is the name of your company?

....when you took out your poicy did you decline Uninsured Motorists Property Damage? With the high number of uninsured drivers on the road today I would recommend always carrying both uninsured lia and uninsured PD.

I did claim with my company. Driving a 1992 Blazer, I do not carry full coverage insurance, simply because the cost would not be worth the gain being that i consider myself an excellent driver. I claimed with the faulted driver's insurance first and then spoke with my insurance making sure there was nothing I would have to do with them. Because there was a police report made with the other driver faulted and it made note of HIS current insurance card, my company could not move forward with uninsured motorist until HIS company sent them a letter. I did follow the simplest of rules and I do know my policy - perhaps you should do some research. If you do not have full coverage/collision, and only have liability/uninsured motorist, you company will not "proceed w/action against GEICO and the other driver" on your behalf.
Thanks for the recomendations tho.

You created a problem for yourself by not following the simplest of rules.
Whenever you have an accident you should report
it to your own insurance company within 24 hours.
They are the ones you give all the information to.

file a claim with your own insurance company under uninsured motorist

The best route to take in this scenario is to file a claim with your own insurance company under uninsured motorist. Leave it up to them to proceed w/ action against GEICO and/or the driver of the other vehicle. Why would your company require a letter claiming uninsured motorist before starting a claim? Do they want a letter from every insurance company that this person does not have insurance with?
