My husband passed away in Oct of 2005.I moved to Saint John NB in 2006.I bought a 2007 Saturn Ion Quad coupe.I had my payments taken directly from my account.Well in 2009 GMAC housing corp bought the apt building I was living in.I couldn't find an apartment in the city that would allow me to keep my dog.I decided to move back to my house in September of 2009.I had a lot of problems after moving back.I had to get power back into my home.That took a week to do so.I had to return to work which is a 45 min drive from where i live.Then my dog got sick with parvo and died,subsequentially my 2 puppies came down with the same sickness.All of this happened in Oct.I came home from work on Nov 20th and a gentleman drives into the yard and asks me if I am Mavis Fitzherbert to which I replied "yes".He informed me he was there to repo my car.He asked me if I was just getting home from work.He was very rude when I told him I wanted to see the paperwork first before I handed him my keys.I gave him the keys and he drove away.I contacted GMAC and this so called "lady" by the name ofNatalie told me I was behind in my payments and that they had tried to contact me and couldn't.They said they tried to call WALMART where I work.I work nights and they contacted the day people.Go figure!I never received a letter or a call while i lived in Saint John about the late August payment.I had no idea it didn't get taken out.She told me I should have checked my bank account.She informed me it i paid $1,290.50 They would release my car.I asked where the car was being taken and all I got was a phone number so I had to go on Canada 411 and find the dealership and address.She said I had 21 days to pay that amount.I borrowed money from my daughter and a cash store to get the money.I paid a car to take me down to pay the payment on Dec 04 of 2009.I asked where the car was because I didn't see it where it was parked on the 21st of Nov.They couldn't find it.They called Natalie up and she said I had to pay another $2,465.01 for baliff fees then I could go to Moncton another 3 hours away to get the car,They had taken it to the auction.Keep in mind i have lost 2 weeks of work because of this.Then yesterday I got a letter in the mail.The letter was dated 2 days AFTER they had already taken my car saying it was going to be repossed,but the letter didn't arrive until Dec.05,09.The letter stated that they NEVER intended to let me get my car back.That's not what they told me.They took my car so I can no longer get to work until I find something I can afford,they ruined my credit which I was trying to rebuild after my husband ruined it before he died.Is there anyone who can help me?I feel like I'm losing my mind.

Something I forgot to mention was in July I contacted Grey Power to get a quote for cheaper Insurance.I was contacted by a company who gave me a quote that i thought was too high so I told them I would stay with the company I was already with.What I didn't know was that they completely drained my bank account in August at the same time my car payment was supposed to come out,GMAC NEVER contacted me to let me know they didn't recieve their payment,I was in Saint John until the end of September.They did NOT phone me.Where I live now I am 62 km away from my bank.I had to get dial up internet which by the way took over 2 weeks to get which puts me 2 weeks into Oct,What you don't realize is that I work nights and I was trying to care for 2 sick puppies who had to be fed macaroni water to keep them from being dehydrated.They had to be fed by a syringe every 1/2 hour.I was under a tremendous amount of stress.I hadn't even gotten my drivers liscense address changed.The part I am upset about is that they lied when they told me I could have my car back if I caught the payments up when in fact they NEVER intended to let me have it  back at all.

You knew you did not pay your car payments. Also they can not notify you if you changed addresses and never let them know the new one. This could have be avoided if the note was paid and they had your correct address. I am sorry

Why would things that happened in September and October keep you from checking your account in August to realize that the payment did not come out?  Are you saying that you had absolutly no time to check your account at all between August and Nov. 20th?


Why if the payment did not come out did you need to borrow the money?  Since you didn't know it didn't come out, you should not have been spending it, thus you would have had it when you needed to pay them.


As for the actual repo, I can't speek for Repo Laws in Canada but if you may want to look into if they did any violations.  However, if they did not violate the law and it is like the US you would have owed those fees anyways and by not paying them they may sue you for the amount owed.  This goes for any deficency balance on the car as well.
