in march of 2003 notices were sent telling myself and gmac that my homeowners insurance was due on may 8 2003 if it wasnt paid on time that the policy would cancel.

i called gmacs escrow/ insurance dept told them this and sent them letters as did my insurance agent. they assured me that it would be paid dont worry.

well they paid it all right a day, LATE and as a result it was cancelled. the old policy was $482.00 a yr and was guaranteed not to be higher if paid on time. the new policy is now 1333.00 a yr thats $851.00 more a yr and i am responsible for that. i don't think so. they made the mistake and should be responsible for correcting it.

I tried for months to tell them this, sent them letters, called them, faxed them my agent also called them, we had two hurricanes comming ( my home is in kew west fla) and no insurance THEY DID NOTHING, now they are foreclosing on my home, this they are doing because they know i have evidence to prove my point its in their own words entered in my escrow account record.

also they say i have not paid them when in fact they have cashed my checks and it shows in that report also as of june 30 2004

i will be homeless. my home of 16yrs will be gone i can not afford to buy in key west again as the prices have reached an all time high and gmac has ruined my credit as they have reported a foreclosure to all credit reporting agencys.

if anyone has had this problem with gmac or any attorney wants to sue these bastards please contact me. this is a million dollar case and its winable.

Due to this Memorial Day holiday I wasn't able to get the information of who was servicing my account. But I do believe it's Balboa when GMAC had my loan. My home equity loan was taken out on Feb. 2004. My loan was sold 4x's between, Feb. 2004 to August 2004 when GMAC took over my loan. Countrywide was only servicing our loan for about 3 months prior to selling the loan and transfering the servicing rights to GMAC on August 1, 2004. Countrywide says that they sent a check for my insurance premium in June 2004, but it never was received by Exclesior Insurance.

By the time I found out about the pending cancellation GMAC was already the servicer and would have nothing to do with my complaint of the pending cancellation and would do nothing to help me get the premium paid to save my homeowners insurance from being cancelled. I called Countrywide about this as well when I found out about the pending cancellation and they told me it wasn't their problem because now GMAC is my loan servicer.

According to them, (2) weeks after my homeowners was cancelled they put a stop payment on the insurance premium check and they said they sent the funds to GMAC. I find that odd my insurance company was never paid because as I investigate this insurance procedure, I was told that when mortgage companies send insurance premiums to the insurance companies for their clients, it's done in (1) large lump check for many of their mortgage holders. For a while I was going back and forth between the (2) companies. Countrywide would say talk to GMAC, GMAC would say talk to Countrywide. I was bounced back and forth like a ping pong ball.

Then on Sept. 21, 2005 GMAC sent me a notice that they obtained insurance coverage from Balboa Life and Casualty. It seems bizarre to me that they are all working together. But in a way it makes sense, as I feel this is collusion between the two companies. As hard as I tried to get GMAC to fix this, with faxes and phone calls nothing got done. Not one of these companies would step up to fix the problem or take credit for the mistake. I still blame GMAC because they could have done something to prevent the cancellation, they had plenty of notice.

to anyone reading this case, every thing i have stated in here is the way it happen to me and is my interpitation of the events as i have witnessed them. i have kept records with times and dates, i have proof of every thing i said, anything i have stated in here is provable with documentation.
my case is so very different than most on here in fact i only know of one other case thats in the courts now, what i find most interesting is the number of attornys reading or making up reports in here(and you know who you are) if you are an attorny reading one of these why dont you find these victums of gmac and help them out, take their cases and help put an end to gmac rampage of foreclosures and causeing people to be homeless remember david took down golith we may be little but we can out wit you if we all stick together.

some of you know that my mother passed away last yr after a 4yr battle from cancer and now im dealing with my 71 yr old father whos heart has been broken and has started and has the symptoms of alzhimers,i plan on spending as much time as i can with him before he cant remember who his kids are, on top of this i recieved news today form one test that i have nerve damage from my spine down to my left arm possibly from a mild stroke that i suffered last yr the stress of losing a parent and dealing with gmacs bull *&*& the home i lost in key west was to be my retirement dream now that will not happen its gone and can never be replaced. i will not be posting any more to this site until this case is finished at which time i will let you know the out come, to virgina,joesph,ann and the rest good luck i will be watching thanks for your support your friend dan

well the first hearing was held.. im sorry i can not tell you more but lets just say gmac sent two people down. flew them in got a hotel for them rented a car and paid for these two to be there they then made me an offer that was so out ragious hell it cost them more to fly these two in than what they offered me so i refused their offer and now we have a new trial date and they have to come back an midigate again

i can not belive this company but of course they have billions of dollars to spend so who cares on the other hand i will say this gmac has a weakness this attorney stated all sorts of dates times and facts about monies that i paid to gmac ALL OF THEM WERE WRONG! so if you want to beat this corp make sure you have records of every thing its very important so make sure will keep you posted on any new news

The Mysterious Fee

We also got a fee added on to our account after we thought we were done...to the tune of $1600. We have also been trying to get ahold of this "lady"..everyone at GMAC says we need to talk to her. She has refused to respond to any of the many voice mails we have left with her.

When we were in court with our dismissal this week (a month after went sent them their blood money) we told the judge about the $1600. He said the settlement agreement WAS THE FINAL agreement...that GMAC has no right to add any additional fees after the settlement agreeement, which GMAC provided, was fulfilled on time.

We told him they had been unresponsive on what the fees were even for. He advised us if they did NOT drop him before they were due to contact his office. If you look at the 30 cent error foreclosure report, like I said there, he was NOT amused by GMAC or their foreclosure mill attorney (Stern in S. Fla).

Good luck!! READ the settlement agreement carefully!! It says both parties agree.....

In Jan of this year, we were infomed that our home had been placed in foreclosure due to non payment. According to GMAC, we were 5 months behind on our payments, but our records indicated we were only 3 months behind. GMAC worked out a repayment plan with us, one that was full of hidden and illegal fees. When my husband questioned these fees and informed them that the laws in our state say they can only collect $600 in attorney's fees, they changed it again. Their repayment plan was a joke. Instead, GMAC said we could pay the entire $7350 owed in the month of February and get entirely out of foreclosure altogether. We scrimped, saved, begged, and borrowed to get that money to them to save our house.

We sent the last payment of $3653 to them on Feb 25 and it was supposed to bring our mortgage current. Now according to my calculations, 5 months of payments would only be $5415. WE paid an excess of almost $2000 to them, only to shut them up and save our house, with the intention of getting an accountant to audit our loan at a later time. I knew GMAC was shady because of this website and I was already well versed in their tactics.

So I go to make my March payment and see that they've added ANOTHER $361 in fees!! What fees, I asked? They had no answer. I left a message with the woman (and I use that term loosely) that I had worked the arrangement out with and she has refused to return my calls. I called GMAC's main number again to see about these fees because I wanted to make my payment but did not want to pay these fees. I was told that they "had started an investigation into those fees," and that "it doesn't seem right to us, either and we'll get back to you." Well that didn't mollify my husband, who has been breaking his back to meet GMAC's impossible demands.

In truth, I think they were banking on the fact we wouldn't be able to come up with the money in time (we did) and the reason they added those extra fees at the end was because they could.
So my husband called them up and told them their fees were illegal in my state and that we do have recourse, so this needs to be taken care of immediately or we would have no choice but to hire an attorney and an accountant to audit our loan and if anything was amiss, we WOULD sue them.

Still haven't heard a word. I made my payment this morning and saw that the mysterious fees were still there. I did not pay them.

What GMAC did to us was despicable. If it turns out that those fees are illegal, then I am going to file one hell of a lawsuit, just like all of you. Or perhaps I could join in with some of you guys.

GMAC tried to take our home (beaucoups equity in it, of course because it seems those are the only homes GMAC wants) and when we were able to meet their impossible demands, they got even more upset and started tacking on MORE mysterious fees.

GMAC is an unscrupulous company. They lie, cheat and steal on a daily basis and it's time someone put a stop to this!!

I have been myself the victim of Homecomings in Florida. And I have a very strong case. My Attorney in Miami started a lawsuit against this company. Homecomings applied a prepayement penalty when i sold my house in full contradiction with the documents they have prepared and that i signed which clearly says that no penalty is due when property is sold, and I have more. They have denied on the phone this document for months, i faxed it, mailed it, how many times, they always did has if nothing happened. We have started a lawsuit but they need to be stopped.

I WILL SAY THIS GMAC WAS NOTIFIED FIVE TIMES ( I HAVE COPIES OF THE NOTICES) FROM THE INSURANCE COMPANY THAT THE INSURANCE WAS DUE THEY HAD PLENTY OF TIME AND THE FUNDS WERE IN THE ESCROW ACCOUNT THEY ALSO WERE NOTIFIED BY MY AGENT AND MYSELF SEVERAL MORE TIMES EACH TIME WE WERE TOLD NOT TO WORRY THAT IT WOULD BE PAID AS FAR AS THEM PAYING THEY PAID THE INSURANCE LATE SO IT WAS CANCELLED I THEN BECAME A HIGH RISK WHICH IS WHY THE INSURANCE WENT UP THIS WAS NOT MY FAULT THEY HAD AN AGREEMENT WITH ME TO PAY ON TIME AS FAR AS THE FORECLOSURE HERE AGAIN GMAC INSTATUTED IT BY CLAIMING THEY HAD NOT RECIVED PAYMENTS WHEN IN FACT THEY DID AND I HAVE THE COPIES OF THE CHECKS TO PROVE IT
SO WHAT GMAC NEEDS TO DO IS FACE THE FACTS IN MY CASE WHEN THEY CHANGED SERVICING COMPANIES IN 2003 SOMETHING WENT WRONG VERY WRONG AND INSTED OF THEM CORRECTIING IT THYE JUST ACTED LIKE NOTHING WAS WRONG TO THIS DAY I KNOW OF THREE CASES IN 2003 WE DONT KNOW HOW MANY OTHERS WERE AFFECTED BY THIS AND HOW MANY OTHERS JUST GAVE UP BECAUSE THEY COULDNT AFFORD OR FIND AND ATTORNY I HOPE THIS ANWSERS SOME OF YOUR QUESTIONS MY CASE WILL BE VERY INTERESTING

Hello daniel:
Thanks for doing what you are doinf about gmac mortgage. Since the last time I posted I am $30.000 or $40.000 now behind since dec of last year since the last time a wrote to you. Boy talking about being messed up.

Today I got a 72 hour telelphonic notice of my house of being reposession by gmac I have called the veterans adminstration up about this they say they will look in to it since it is a va home loan. My lawyers tells me to pay $1.072.00 a month went from $840 to that.

Then my attorney called me to hold on everything since now I was in a chapter 13 like I mentioned before. You see what the $30.000 behind was then I get a call from thand that I didn't make april's payment I did of course until she told me to hold off attorney said I have 72 hours to come with $3000. That they didn't recive april's payment I did send april's payment until my attorney told me to hold off.

Wow one thing after another from last dec how do yoy get $30.000 behind un real since I am a permanent diasbled veteran whick nowadays don't mean much. Do I have rights in hear. These guys do the unbelivable and think that the consumers are dumb. Daniel if you like to contact me be free to do so. If there is still anyone to help or give me infomation I will be helpful if I'm still here and daniel thanks for all you did gary.

ANOTHER RIP- OFF BY GMAC

some time back i wrote that i had another mortgage with a company named greenpoint well they then transfer it to gmac against my wishes and then would not take it back even though we were in court since 2003 ok so i have been paying the bill as per my attorneys instructions (conflict of interest here ) im sueing them etc today i get the may payment on it there is a $25.00 charge that states it is a fee assessed???????????? when i called them i was told this was an annual service fee that was due say what they have only had this account for 4 months what the hell is this crap then i was told by a very rude customer service person named jason that its in the contract which he then said he would look up and get back to me so now im on hold he then comes back and said its in paragraph 6 ok so now im confused i looked in my contract and couldnt find it and just where the h**l does gmac have my contract stored in their system that he could look it up so fast so the point of this is really that gmac has their head up their butts and they really do not know what the hell they are doing except stealing money from pepole and taking their homes because they have gottin so big they dont know what their right hand is doing from their left keep fight them people they are slowly going down like a sinking ship

well it has been since sept 2005 that my attorney and my self has heard from gmacs attorneys
so on friday feb 24 i spoke to my attorney and said just what the hell is going on its been 5 months just how long does it take to get depositions from these asses he told me he has tried to contact them several times and got absolutly nothing i have now instructed him to file charges against them and to inform the judge that they are not following his orders and or the courts gmacs attorney is donna glick she works out of david sterns office in plantation fla so miss glick you had better get off your butt and start doing your dam job because im comming after you and your office and i will not let your client gmac get away with this bs any more and the longer i wait the more this is going to cost your client to everyone else call 411 get strens number and start calling them ask for miss glick let her know what kind of dirt she works for
FYI david sterns office is one of the largest attorneys that work for many mortgage companys that foreclose on people

keep telling your friends and anyone that will listen and tell them to pass it on DONT DO BUSSINESS WITH GMAC dont buy their cars trucks suv or anything else dont do mortgages with them or any of their sub companys -ditec -homecommings etc if you see anywhere the letters gmac in their name boycott them this is the best way to kill this giant and make them go away good luck everyone and thanks for your encouragements

this will make you laugh on friday dec 2 as i was driving to work i got a call on my cell phone from gmac.the message was from their default dept and said i should contact them asap. well this is where it get good you see back in nov a mortgage that i had with greenpoint mort was transfered to gmac .this is what the letter said anyway so i call gmac and gave them the loan number oops its not in their system yet and to check back. now on wedsday nov 30 i called them and told them i wanted a pay off figure because i dont want these blood suckers to get any money from me. so back to the phone call as i spoke to the customer service person she wanted to know when i was going to pay because as of friday they were going to implement foreclosure SAY WHAT how can they foreclose on something they dont even have in their system and first off the account was just transfered over to them, it seems to me that gmac makes up the rules as they go they pay no attention to hud or the respa laws and their personel must be made up of the most stupidest people on this earth . PEOPLE WE HAVE GOT TO TAKE THIS COMPANY DOWN WE HAVE GOT TO START SPREADING THE WORD DONT DO BUSINESS WITH GMAC OR ANY OTHER COMPANY THAT IS UNDER THEIR NAME I PERSONALLY WILL BE MAKING UP BUMPER STICKERS SOON TO HAND OUT FREE AT THE NEXT HOME SHOW HERE IN FORT LAUDERDALE FLA I WISH I HAD A AWAY TO GET THEM TO ALL OF YOU KEEP FIGHTING

Hello All

My husband and I are in exactly the same situation as all of you have been. Except Dan is the old timer hear. I hope you "Give em a can of Whip A--". We should have Roy Mercer call the GMAC and broadcast it Nationwide. Our home was just forclosed on. I put in our appearances and have talked to an Attorney. She seems very intersted in helping and she is going to look at the documentation I have. I want to thank Dan as well as the rest of you. I was beside myself and finding this site has helped my husband and I both realize "It really was not our fault" I have been running around in circles to Shawanna who sent me to Amanda who sent my to Shaleeza Rivera who did not return my calls, Then Shannon sent me to a Tohm who did not return any of our five calls. Then Shaun sent me to a Ron Coin or O'Coin who did not return any of our three calls until the end of October 2005 and he said I could not pay a house payment and unfortuanatly lauddy da da da. I have about had enough. I called the Attorney General and I am filing a complaint and I have called a lady from Indiana that is from the Nortgage helpline. They both say something is wrong and to file a complaint and get an Attorney. I hope she can help. If not I will keep on truckin with the rest of you. Thanks for the encouragement it was needed and is appreciated

I am trying to refinance & get out of GMAC, but they have reported that the house actually went into foreclosure, when it did not, and I am unable to refinance!!!! If anyone has any information to help me, PLEASE reply to my report. first joe funny isnt it gmac iam sueing them and they dont know well now they do and yes when i sighned with green point mort i gave them a doc from the closing attorney that they were never to sell my mort to gmac ever i will pay it off before i ever giv tem monies again

now i finally got a person at gmac who did their job she was very nice and yes she did call me back and so did gmac legal dept the minute that they found out i was sueing them lol from where i see it they may have figured out that they had better fix their problems because they are soon going to go under as there are way to may law suits comming at them thanks again joe

I guess I have one point to ponder, when we sign new home loans, can we put a clause in the contract that "This loan can not and will not be sold to GMAC!"

HERE WE GO AGAIN

WELL YOU WILL NOT BELIVE THIS ONE

I HAD A MORTGAGE WITH GREENPOINT MORTGAGE COMPANY UP UNTIL NOV 1. ALL OF A SUDDEN I GET A LETTER FROM OUR BUDDYS AT GMAC TELLING ME THAT MY ACCOUNT HAS BEEN TRANSFERED OVER TO THEM (YOU HAVE GOT TO BE KIDDING ). OK SO I CALL GRENPOINT AND ASK WHAT THE HELL IS GOING ON THEY TELL ME THAT I SHOULD HAVE REVEIVED A LETTER TELLING ME THAT GMAC WAS NOW GOING TO SERVICE MY ACCOUNT .WELL I DIDNT GET ONE . I INFORMED THE GIRL THAT FIRST OFF THIS IS A VIOLATION OF THE HUD AND RESPA LAWS AND THAT SECOND OF ALL I AM IN A LAWSUIT WITH GMAC AND THEY CAN NOT TAKE MY ACCOUNT AND I WILL NOT LET THEM EVER GET ANY MORE OF MY MONEY.

SO NOW I CALL GMAC AFTER THREE DAYS OF CALLING AND FAXING THEM ONLY TO FIND OUT THAT THEY DONT EVEN HAVE MY ACCOUNT IN THEIR SYSTEM YET I FINALLY GET TO A SUPERVISER. SHE TOLD ME SHE HAS MY FAX AND THAT SHE WILL BE TURNING IT OVER TO THE GET THIS " LEGAL DEPT" AND THAT THEY SHOULD BE CALLING ME SOON.

OK SO NOW IN THE FIRST LETTER FROM GMAC THEY TELL ME THAT MY NEW PAYMENTS WILL BE $211.60 AND IS DUE ON NOV 1 I SAID REALLY WELL ITS NOV 9 AND I JUST GOT THE LETTER.

NOW ITS SAT NOV 12 I GET A SECOND LETTER FROM GMAC SAYING WERE SORRY BUT WE MADE A MISTAKE AND THAT YOU PAYMENT IS GOING TO BE $224.12 I HOPE YOU CAN ALL SEE ME LAUGHING RIGHT NOW BECAUSE EVERY TIME I READ IT I CRACK UP.

WHAT IS REALLY FUNNY ABOUT THIS IS THE FACT THAT GMAC HAS THE BALLS TO PUT ON THEIR LETTERS AND I QUOTE " GMAC MORTGAGE CORPORATION IS COMMITTED TO PROVIDING SUPERIOR SERVICE TO OUR CUSTOMERS! "
NOW I HOPE YOU ARE LAUGHING IF GMAC IS SO DEAD-ACATED TO US ,THEN DONT YOU THINK THEY SHOULD HIRE SOME PEOPLE THAT HAVE A BRAIN AND CAN COUNT ,ADD AND SUBTRACT, READ, WRITE AND LAST BUT NOT LEAST BE ABLE TO PULL THEIR HEADS OUT OF EACH OTHERS BUTTS LONG ENOUGH TO FIGURE OUT THAT THEY ARE ALL A BUNCH OF REALLY DUMB ASSES AND HAVE A F-IN CLUE AS TO WHAT GOING ON .

GMAC FINALLY ADMITS TO SOMETHING

well we finally have it in writing at the last court hearing the attorney for gmac stated that gmac did not have an escrow account for the mortgage with me nor were they responsible for paying the insurance out of said escrow account also gmac said they were not responsible for for the servicing of said account well now we have it in writing and in the court docs
what really funny about this is the fact that gmac states that this was all my fault for not providing them with the proper insurance documents and policies this woman must truly have her head up her but in the 6 yrs that gmac has had this mortgage i have never had to show them or provide them with insurance docs and they never asked for them
then gmacs attorney claims that i was to pay for the insurance then what the hell was i giving them monmey for to put into and escrow account
she also claims that this was a contractual agreement and there for the economic loss rule does not apply if this is true here again why in the world was i giving them money to pay taxes and insurances da lets face it boys and girls gmac has lost this case i i belive they now know it after all i have way more proof and most of it is in their own words and account records keep your fingers crossed on this one thanks

so heres some advice
you say you have an attorney well if hes not calling you back march your self right into his office and ask what hes doing about this
second when you get the flyers in the mail just throw them away and dont anwser the phone to these scum bags tring to help you out they will only make it worse and you will lose your home
now as for gmac you say you paid the other mortgage company go get copies of that check from your bank and any other copies of payments send them to gmac and make them see that you paid also get the other comp to tell gmac that you paid the mortgage and they should be giving the funds back to gmac your attorney can look into this
all i can say sarah is dont give up i have been dealing with this crap from gmac for over two yrs now they took my home and iam fighting them back they will not win as long as as we keep fighting them good luck

I thought I was alone

Today is the day i have been waiting for. I have been floundering for a year, fighting this company. My problems started with the sale of my mortgage from RBMG to GMAC. RBMG cashed what should have been my first payment to GMAC in April of 2002. Funny thing: the notice I recieved from GMAC telling me of the sale was dated April 4, 2001. In this letter, I was told my first apyment should be made to them as of April 2nd! Odly enough, I had started sending my payments to RBMG EARLY as an experiment when i saw they were not cashing my checks until AFTER the the late date.

As it stands now, I have come to the end of the road, my house is up for auction on October 21...which I learned from the local vultures (ie:let me buy your house....avoid forecloser....etc). I have been contacting my lawyer and have not had a response. Well, actually, two weeks ago he told me my house was NOT on the block because there was no final hearng (It is schduled for november 11th according to the court records.

I feel so overwhelmed right now. Is there any hope? I am a single mother of ; the youngest will be 18 in february. I have worked two fulltime jobs returned to college to get a teaching certificate, quit the one job because of school and made it through and even managed to save the mortgage payments from last september to right now. I am back at the job I quit in Oct. 2002. I make $13.50 an hour as a teaching assistant at my day job and work customer service at Kroger for $8.00 an hour almost 30 hours a week.

I feel lost and abandoned. This house is the only thing I have for my children if something should happen to me. And I feel sooo ashamed for how I feel becasue I haven't lost anything compared to what those people in the South have lost.

update court sept 6 2005

so as promised heres and up date on the court hearing
we met in judge jones chambers this time and of course gmacs attorney donna glick made her usual phone apperance to which the judge said we normally do not do in the case of where gmac is tring to have this case dismissed again( i guess mrs glick cant affornd the gas lol)
anyhow mrs glick then stated her case as to why this case should be dropped she went over and over again about how the proper doc were not attached basically the mortgage agreement to which my attorney stated that it was if she would just read the complaint she then went on to explain that gmac does not and is not responcable for an escrow account gee if thats true why were they taking my money and then paying the insurance she has got to be the stupidest attorney i have ever heard she then blew her case by stating that gmac may not be responcable for this mistake and that the servicing comp is at fault to this judge jones then asked what the heck was a servicing comp?
then mrs glick went back to her complaing about this needs to dismissed because of the economic loss rule then jugde jones said that she seems to be pulling at the same wild hair on her butt and she needs to let it go
now its my attorneys turn mauel garcia was great this time he blasted mrs glicks every statement he even went as far as to state some supreme court cases which mrs glick had never heard of he also then introduced the letter from hud and respa showing the yes gmac was in violation of their rules also
so heres where it stands each side was given until sept 16 to turn in their final evidence and then we will meet on oct 7 for this
judge jones then said he wants to get this case into court he is very interested in hearing how this will play out and what discoveries will be found he also stated that it seems that there is more going on here than meets the eye
i hope this gives you all hope that we can beat this company at their own game so please put good carma out there that the judge grants me a case as it will benifit all of us that have been screwed over by gmac

if you file a complaint please be sure you put it in plain words mrs glick tried to convince the judge that there was no proof that the insurance was canceled and that it stated no where in our complaint what gmac was to pay for the judge then told her she had better go back and read some more or get better information from her client (gmac) because it is in our complaint (LAWYERS THE TURD IN THE LITTER BOX OF LIFE )

i know how you feel gmac has to be the dumbest corp i have ever delt with i say lets put them up there with god since they do no wrong its funny that you say the federal thrift bank is watching them do you have a phone number for them? what really burns my butt is the fact that hud and respa sem to know about gmac but yet all they do is write letters to them and tell them to fix their problems but still nothing is done all we can do at this point is make sure we tell everybody anbout this site and what gmac has and is doing to homeowners also dont buy their cars dont invest in their stocks etc i now have a sign that i put on my truck when im driving around town warning peoiple about gmac the deaf dumb and blind corp thanks

My-My GMAC Continues Their Unfair and Deceptive Practices

This is my little story about GMAC: They also cashed and lost one of my checks and I had to run around to cure their mistake; of course, you never get the same person so it took quick awhile to correct.

Then,when I refinanced with another nightmare company, Beneficial/Household (I went from the frying pan into the fire). In any event, back to GMAC: When I refinanced GMAC, took upon themselves to down pay my loan w/ my escrow w/out disclosure.
Thereafter, I tried to work it out reasonable w/ both Bene/GMAC to return my escrow and up my loan.

I've never spoken to such corporate idiots in my life. To get to the point it took me a year, I started with the Consumer regulator in my state and then, I wrote to HUD (Federal Housing Auth.), they let GMAC know that they violated RESPA. Even after, they were told to return my escrow, GMAC still refused to admit fault, they did finally reimburse my escrow and then telephoned from Waterloo to say we need to send it back to them! I let them know that you don't get to violate RESPA and be compensated. In the end, GMAC, is being watched by the Federal Thrift Bank who oversees them to assure their complaince. It is sad that GMAC cannot bring themselves to act fair and reasonable and/or admit when their wrong. However, the law prevailed in this case, although, it took along time, I guess, that's politic's! well 9/6/2005 will be trip number four back to court it just proves that the big corp thinks if they stall long enough the little guy will go away WRONG im here for the fight
so heres some up dates as to what has happened
first i now have hud and the respa office involved and they have sent several letters to gmac and their attorney stating that gmac has violated several of their rules and regs
next gmac sent my attorney a check for about 800.00 for what the house was sold in june of 2004 seems that this is about half of the 1448.00 that they claim is in an escrow account say what what account shouldnt they have returned the monies to me a long time ago respa agreed with us that gmac should have returned the funds at the closing of the sale so here again we have them by the nuts next gmacs attorney donna glick started to wine in front of the judge that really pissed him off so he granded us an ext to provide more evidence like we need more i already have one brief case to carry into court the final straw for gmac will be comming soon i have called zt sterling about getting copies of my escrow history with them and the exact dates and times that they were fired from being the serviceing company for gmac and balboa life and casualty took over in 2003 if you rem this is when all of gmacs troubles seem to have started so thats all for now i will let you know what happens in sept till then keep fighting gmac

well today i got a little bit smarter
i finally got copies of the checks that gmac said they never got and thats why they started to foreclosure on my home
so now on the back of the checks it shows that (get this gmac was holding a check for 24 days before they cashed it) wrong wrong wrong so everyone go get copies of your checks and see if they were holding your check after the due dates and if so you may have a good reason to call the hud office of respa in washington good luck oh and one more thing it seems that gmac was giving me money on my account summerys they say they were collecting $818.00 for p-i when in fact it should have been $785.72 where do they get their numbers and people from

back in dec gmac was to turn over the proof that i was the one that cause the problem

well guess what gmac didnt respond to the judges request so my attorney file a default against gmac

now comes march 23 it seems that gmac has hired an attorney name donna glick from an office in plantaion fla

mis glick has filed a motion to dismiss with prejudice then she goes on to state that there gmac never signed or agreed to

escrow funds can you say contract miss glick ps i have it dont you ) miss glick then sited the economic loss rule and

then she tried to bring in a case a.f.m.corp v southern bell telephone and telegraph company the judge ruled that the economic loss rule is old law and doesnt apply in this case so after some more debating

my attorney wanted to ask for an extention this is when miss glick started to whine and cry it wasnt fair and how much longer was this going to go on (poor miss glick)

the best part of this story is that miss glick states that her client gmac doesnt have a copy of the mortgage agreement but that the plaintiff does now i ask you what kind of company gives away monies and doesnt keep record of it GMAC thats who

so to sum this up we now have a 15 days more to file a complaint against gmac and make it stick so miss glick get your guns out and get your proof because i have mine

well after haveing to call the ceos office i finally got the requested info that i needed in my account summerys for the yrs 2002 and 2003 it clearly shows that gmac screwed up in paying my insurance in 2002 they paid it on time in 2003 they messed up big time this is in their own words and their own book keeping records
now for the best part it seems that they have about $1448.70 dollars in an acount that belongs to me when i called them they said it would be return i then asked where did it come from the operator said i dont know ok i will tell you part of it is the insurance payment that was returned to them and the rest of it is the oct mortgage payment that they say they never got and this is why the tried to foreclose on the property well as i said before gmac i got you with your pants down and this time by the balls watch out because here i come after you

Daniel,
I've read so many of your postings I'm beginning to think we are brothers!
But seriously I also am a victim of GMAC Mortgage's crap. I'm willing to do anything and everything possible to take this corporation down! But first I need to save my home, and only have until December 8th to do this. I'm looking for some information I saw at on one time via a link from www.thebadbusinessbureau.com. I've seen you everywhere that there's a complaint about GMAC so you may recall it.
This link took me to a sight all about foreclosures, and for the rest of you out there that needs some time if Daniel can help me he may also may be able to help you to buy time. But only use that link to buy you time, and not get out of the problem until a future date; this company needs to be taken down period. I want this link to get reinstated with no cash, but will work with ANYONE that is willing to take this company out. I've showed my evidence to my local lawyers and they agree that I have a case, but they all have an excuse not to take over the case except for one, but I don't think he is realizing just how many people GMAC is doing this to, him along with the rest I believe is to scared to go up against a major corporation like GMAC because we are in a small town of only 2200 people.
I know the rules about email addresses and websites here so hopefully if I tell you that I have my own website and click on the link GMAC you will be able to contact me. My farm and website is called platoridge you will have to add .com to it. (Wink) So any and all please feel free to contact me through that website using the GMAC link or my phone number listed. That email will be created within 2 hours of this posting.
But Daniel, this link I was once talking about took me to a site that had a bunch of repo information on it. One part of it says that we will pay your back payments IF you are more than 2 month's but less than one year behind, up to a maximum of $25,000.00. They will then put a no interest lien on your property that is to be paid off at the end of your mortgage term. I thought this was HUD, but I checked today and I can't find the information there. I went through all of GMAC's complaints about four times today, but cannot find that link again.
My GMAC nightmare (trying to keep it short for now) is On December 1, 2001 we signed the papers on our dream home December 18th I got laid off due to the 9-11 incidents. With a payment of only $1091 it wasn't a big deal, we were expecting a payment of $1200 (new build, estimating taxes and insurance) Prizm Mortgage sold my loan to GMAC and that's where it got started! They jacked our payment up to $1386.00 per month due to taxes. Stupid me did not do any investigation at that time, but we got behind and was forced into a repayment plan of $1608 per month. Less than a month later I get a letter from GMAC that basically said We're sorry, we screwed up, and your payment should only be $1286.00 per month not the $1386.00 previously calculated!
Once again stupid me did nothing! Needless to say (I'm still laid off, with no job above minimum wage (I was making $30.00 per hour) is in this area, there is nothing above $10.00 per hour!) We got behind with the $1608.00 payment by 2 WEEKS and the foreclosure started! (The day the payment was in the mailbox the papers were delivered)
Guess I need not say I finally woke up and looked into it! Now GMAC is refusing to inform me why my payment is $1286, let alone $1386 at one time, when all the paperwork shows that my actual payment should only be $1214.86 per month. (Looks like a typo to me huh?) After some arguing they did credit me $1551 for the excess I did pay at the $1386.00 payment, but still left us behind.
One week after our first court date (getting it extended,) GMAC called me and wanted over $7000.00 down and over $1900.00 per month Because they miss-read my financial statement sent into GMAC for the Hardship option (over a month prior) I believe they got scared and tried to scare me into signing more paper work that I could not afford.
On our second court date GMAC's attorney asked for an extension instead of waiting for my lawyer tied up in another case. THE JUDGE SENT ME HOME! Do you believe that?
Our Next court date is December 8th; I would like to find this link to see if GMAC will allow me to do this (GMAC has to file the information to get the help, according to the information on the missing link
Daniel, I will continue to go through each and every one of GMAC's complaint's looking for that link, please rack your brain to help me out to get re-instated for the time being, I will be here to do what-ever I can to take GMAC down!

To everyone else out there fighting for their rights, whether it's against GMAC or any other company, use your word programs for spelling, and keep the foul language down! You can copy and paste your letters into this website. Let's just try to look a little more professional! Maybe we can be recognized just a little more!

it was announced on nov 12 2003 that fairbanks capital was fined by the ftc and hud for illegal practices in servicing of loan they will pay $40 million dollars and the ceo will pay $400,000 dollars (this is not enough) you can find this info online under fairbanks look for the lawsuit site

heres a update as to what happened in the court hearing back on 11/3/2004
seems that gmac claims that this problem was all my fault and they have the proof
for the life of me i can not undersatnd how i caused this to happen when they had the funds in my escrow account and under their agreement with me they were to pay the insurance
so this is what gmac has done
now they have requested that a MOTION TO DISMISS be filed what this states is even though the facts may be true gmac can request to a judge that the case be dismissed say what you say you heard it some one in this county made up this stupid law that claims i am not intitled to a day in court because some big a*s corporation said so so now we have another date in court on 12/7/2004 pearl harbor day dont know if this is good or bad so after this i will let you all know what happens again now for the juicey stuff monday morning i call BALBOA LIFE AND CASUALTY this is the comp that was hired by gmac to service their escrow acounts etc
again i asked them the same question that i had been asking for months now

For contacting the attorneys at GMAC, you will have to go through the main GMAC office which is located in Horsham, PA. The Waterloo office will try to give you an advocate address or phone number. Be persistant and keep asking for their attorney's or home office phone number. Any letter correspondence that you send to the Horsham office will be reverted back to the Waterloo GMAC office.

well in understand that fact however when gmac took my payments the p-i and broke it into smaller amounts and then listed them as misc and penaltys for two months for no reason they broke the contract i have with them you see i own several properties and all my payments are made for one month in advance so i know the funds were there and i know all about contracts this ones call breach of contract for one you see what gmac doesnt know is i have all the proof in their own letters and bookkeeping records as according to the contract i can request this info at any time of course when i did they gave me a hard time until i read it to them in their own words from their own contract they had a sudden change of heart so i have copies of my escrow records for the last three yrs and copies of where all the funds went for the last three yrs these records clearly show that GMAC attempted to and was tring to cover up their mistake in not paying my insurance out of the escow account and the best part they lied to me for eight months that they never changed their servicing company from zt sterling to balboa life and casualty fyi they are owned by countrywide mortgage i have this in a letter also from their own customer satisfaction rep so what i would suggest to all call gmac demand copies of your statments tell them is in your contract and then take them to an accountant as i did who caught the dirty little lie that gmac was doing it will be interesting in court as to their anwser for whats in these records and their letters keep fighting people these are our homes

For those of you that are having problems with your payments being posted to your mortgage, first of all look to see if your payment amount has changed due to escrow. A little thing that GMAC does is even if you send the monthly payment without the escrow amount on it, they consider that to be a partial payment. When you send the next months mortgage payment, they combine the two and apply it to the previously posted amount to complete the previous month's payment. Then the remainder gets applied to late charges. Your credit report then shows a 30 day late. Even if you ask to speak with a supervisor, they will tell you that have to make the elevated payment amount, even if it is not your fault, until the problem is resolved. If at all possible, do not have an escrow account.

gary i feel sorry for you haveing to deal with gmac i know how this company is heres a few suggestions (1) hire an attorney, dont give up find one.it took me awhile but i found one and my first court date is 9/15 for round one with gmac.

also there is an attorney in san fran francisco that called me he is looking into gmac for a class action suit

(2) print this page up hand it out to everyone you know tell people about this site give the print out to realistate agents mortgage brokers bank tellers etc get the word out im haveing a sign made up for the side of my car to tell people about gmac the rip off home stealing company

(3) DONT GIVE UP FIGHT THESE JERKS AS LONG AS YOU CAN and make sure you have all the info you can get and make sure its the truth and you are 100% right that they messed up they took my home from me they know it and im going to fight them tooth and nail till they pay one last thing to all who read this start writing letters to the news media exspecially 60 min they contacted me and im sending them the store for airing soon good luck

I am so sorry to everyone who has trouble with GMAC Mortgage. I was an employee there. I left because of their practices and procedures. I think that people are not being told the truth on what is going on there and should have some investigating done on that business.

Being that I was an employee there, I can not go into great detail on the total picture, but there is definitely bad charma there.

My Aunt would appreciate the information about the attorney from San Francisco as she is currently facing foreclosure from GMAC because of GMAC Mortgage Financing returning her payments in order to obtain her home. She and several property owners in her area are under attack because a large land development company is purchasing all the property in their area for a "special" customer. This is all the property she owns in the world and she is willing to fight for it by any legal means possible. If you would post their name it would be appreciated.

well as of wed aug 4 2004 gmac mortgage has not responded to my counter suit that was file by my attorney so now we have file a default with the courts and are requesting a court hearing also to all who read this take heart i have received a call from a lawer in san fran telling me they are now investigating gmac for some of their practices seems they are holding peoples mortgage payments for ten days past their due dates and then charging them penalties and late fees some people they are then forcing into foreclosures they are looking for others so they can launch a class action suit against gmac as soon as i have more info i will pass it on

im sorry to hear that gmac did this to you also right now iam waiting for a responce to a suit that my attorney has file againt gmac they have 20 day to reply it wil be interesting as the house ahs been sold and they have been paid off so far they havent sent any doc to me or my attorny fixing my credit or the deed to the property i have told my attorny about your rebutial and i hope he will use it thanks again

Hi, I was very upset to find out GMAC did this to you, because the same thing happened to me as well. I even tried to offer a repayment plan per hud for the payment that they do now show because it was credited toward late charges.

I took my case pro-bono to a consumer rights attorney, and he is suing GMAC and the law firm that covered my foreclosure. I ended up keeping my house and paying the fines up front. but there were unlawful fines that I paid which allowed me to also bring a law suit against the law firm that handled my foreclosure. I never even spoke to an attorney at the law firm, they allow paralegals to practice law, which is ilegal in Colorado.

Good luck with your situation, hopefully it will be resolved. Also good luck trying to fix your credit report, that's my next battle!

yesterday 05/26/04 i finally got a responce from gmac concerning the information i had been screaming at them for.

it seems that in feb 2003 gmac was using a servicing company named zc sterling on feb 1 2003 they changed to balboa life and causalty the other company was then terminated.these companys are under the gmac umbrella and are responcible for paying bills out of customers escrow accounts.

i called them and they comfirmed this. i then asked them why in 2003 did they not pay my insurance on time they said they did and had a date of payment as may 12 2003 excuse me but thats 4 days past the due date.

i then asked for records containing my accountthe operator then said he needed a superviser. he got one she said she would have to research the problem and get back to me.

this morning i got a call from the superviser .she stated that she had to turn this problem over to gmacs legal dept. this is the smoking gun i needed now gmac knows this and they have been caught again with thier pants down. ps thanks monica for the rebuttal it helps to know people are reading this site and gives me some hope of fighting back some more.

How could someone or a company do this to an individual, with no means of starting over again or to buy a new home? I don't know the whole story, but even so, this is terrible. Its like throwing away money invested plus interest and throwing it literally in the trash can and then telling the homeowner to get out. I am not very smart in these subjects apparently, but these type of stories can't get any more complicated. I don't know law either, but Daniel perhaps you can call local lawyers and ask if they will take the case and do "Pro Bono", I think that means free or of very little charge. You might be able to call your Legal Aide office and just ask if they help in these type of cases. Don't just wait on an attorney to call you, also do some investigating and see what can happen. I'm open to criticism from anyone else on my comments and maybe my suggestion might help even a little. Well, good luck and I wish you the best, I just again think this is terrible how they can foreclose on something for their error for being A DAY LATE.
