GMAC ripoff Waterloo Iowa

I too have been a victim of GMAC. I lost my home Nov 2005. Let me tell you a little about my case. First of all my husband and I filed bankruptcy in 2001. At the time he lost not one but two good paying jobs. So we did get behind on our mortgage payments. However GMAC was NOT our mortgage company at the time. While in bankruptcy we never missed a mortgage payment but during this time, our mortgage was sold to GMAC and right from the start of this ordeal they said we needed to bring our account current. Every few months they were hauling us into court saying we were behind. I took money out of my 401k to pay. It was always &1500 or $2000 or $2500. I got so tired of this I started losing the will to fight.

Each time, our attorney would tell the bankruptcy judge that this was ridiculous. Each time we ended up paying the money and GMAC's attorney got our money! None of this money was ever used on our mortgage. We grew so tired of this that finally my husband told our attorney to have the bankruptcy dismissed and we would take our chances.

As soon as the case was dismissed GMAC came after us with both barrels. We came out of bankruptcy in July 2005 and in Sept 2005 they started the forclosure proceedings. We started the process of looking for another mortgage company to take our loan. At the time we had $20,000.00 in equity. First mortgage company we contacted took our information, said they could probably do a loan and within a few hours we received a phone call from this mortgage company asking if my husband was trying to play a joke. He assured them he wasn't and asked why, the mortgage company said "you are deceased" and how can I give a dead guy a loan. After further inquiry it was GMAC that had reported my husband deceased to 3 major credit bureau's.

So you can see why we couldn't do anything to save our home. GMAC had us over a barrel. It took time to get this cleared up and we are just now getting one of the bureau's to take the "deceased" off the credit report. Two of the bureau's stated that this was done fraudently. They removed the entire forclosure from our credit file. We are having a little trouble with Experian but we will get it off eventually.

Does anyone have an attorney to go after these scum bags yet? I am willing if someone will let me know what type attorney I need!!!!!!!!!!!!!!! I will start the ball rolling.
