RE: Contract #1023087

SALESPEOPLE: Cindy Dyer TN Real Estate License #279955
Brian Fares -- TN Real Estate License #308116 (EXPIRED)
Anthony Shusley -- TN Real Estate License NOT FOUND

To Whom It May Concern,
We have spoken on the phone several times to various representatives, in different departments,
within your organization. We wish to cancel our timeshare contract and would like to speak to the
person with the authority to get that done.
Here are some of our reasons for wishing to cancel.
In September of 2011 we attended a meeting in exchange for a discount vacation in Pigeon Forge.
We ended up buying a timeshare, to be used in even years, and were awarded a 50 percent discount on our points usage for any stay within six to 12 months of our purchase.
When I called the next April to make a reservation for the fall, I was told there was nothing available. We were not able to use our discount, not to mention that we were not able to use the timeshare at all during the first year we purchased.
The timeshare was, in fact, booked to the end of the year 2012. The first reservation we were able to make was for September 2013 two years after purchasing. When we called to complain we were offered a free vacation and a gift card, but were required to attend another presentation. This hardly made up for the fact that we had still been unable to use the timeshare. Our sales agent, Cindy Dyer, told us at the original presentation that we would be getting a spanking new timeshare, in a community of new units with a water park. She showed us the designs and convinced us to buy.
When we arrived for the second presentation we saw to  that only one new unit had been built and the promised water park was just a pile of dirt.Cindy wanted us to buy the odd year of our timeshare. We refused, and asked her what  with the promised construction. She told us they were having difficulties dealing with the town of Pigeon Forge. We didnt believe her what difficulties could they be having if one unit had already been built?
We asked Cindy to buy our timeshare, as she had promised. (In the original meeting she told us she wanted first right of refusal.) Now she said she couldnt help us with that. She gave us a number to call We called, and they said they couldnt help us and gave us yet another number. When we called that one we were told that selling our timeshare would be almost impossible, and that timeshares like it were listed for as low as $10. Cindy and the other agents had sold this as a great investment that would only increase in value. Cindy said she owned a timeshare there herself, and Anthony, the
other agent, said he owned one and was getting ready to purchase another. We doubt it.
We were told we would be able to go and stay where we wanted with the points wed earned with our
purchase. Whenever we tried, we were told wed have to buy more points to stay there.
We were told we couldnt use any of the services wed purchased until we got a letter of escrow. We
never received this. We were told we could make money and even win a car by referring people. But why would we refer
people to a scam like this? We were pressured by Cindy and Anthony to buy today, because the offer would be off the table

We feel the opportunity was grossly misrepresented, and that none of their promises were kept.
We refer you to the statutes listed below.
Tennessee Statutes
Chapter 32. Time-Share Programs and Vacation Clubs

the money we have paid. We look forward to hearing from you soon.
