I am so sick of dealing with these rude, threatening people. I was told today that my account was "in jeopardy" because I was ONE month behind - ONE month! I had been working with someone named Kay. I spoke with her two weeks ago. I made a payment over the phone which I told them to go ahead and take out immediately. The payment didn't come out for 5 days yet it was URGENT when they called. The repo man was "on his way'! So I agreed to call Kay back in two weeks to make another regular payment and then obtain a two month extension so we could have a little breathing space to catch up on other bills and get back on track.

Since Friday evening, when I was out of town, I have been getting threatening phone calls. They stated that "if you don't call today, it is out of my hands" and "your account is in jeopardy and you have 48 hours to respond or we will foreclose immediately." I was out of town - it was the weekend!!!! I was told to call today which I did and lo and behold, NO ONE had ever heard of Kay. And their 'system' has suddenly changed - AGAIN!

Every time I call I get the same excuse... they are using a 'new, improved system'. Makes me wonder if I really am behind on my payments at all. Every time I ask, they can't give me and exact answer. Now I am waiting on a call back from Linda, my NEW account manager, to see if she will give me the two month extension that Kay promised me. Juliette, Linda's lackey, said that Kay must have worked for GreenPoint and that GreenTree has now, just recently purchased out contracts. Kay told me she was with GREEENTREE in Baton Rouge. Now I don't even know where I am calling... probably Memphis. All of this crap over being late ONE month!

Also, in the past, GreenPoint AND GreenTree have both called members of my family leaving threatening, rude messages on their answering machines. My mother-in-law finally had enough of it and called them back and threatened to get a lawyer if they didn't take her phone number off their records. I will know today if she has gotten any more calls from the Linda/Juliette team.

How can they possibly keep it all straight when they are constantly reassigning accounts. By the way, I mentioned this to Juliette when I called and she stated that "we are not giving you the runaround...we have just been assigned your account effective as of February 1st so you should have been dealing with us in the first place." Liar!!!

When I spoke with Kay on January 28th, she did NOT mention any new account assignment. She also stated that she was with GREENTREE... not GreenPoint. So frustrating!!!

thanks for your sugesstions! How are things in Japan? We have come to the conclusion that this is going to go on his credit! The good news is now that I'm working, and after I've been there a year i can get a home in my name. Since the MH was not in my name at the time, and we were not married then. What bothers us is that we done everything right. conseco messed up! But if there is one thing I have learned! "what goes around comes around"! We are a little sad, but he's alive, and we are happy!

Phyllis,

Please keep in mind that since GreenTree too over GreenPoint things have probably changed since I worked for GreenPoint. Regarding the paperwork about the assuming of the loan to another party. If there was not a Surrender of Secured property signed, then yes, they are correct. You all are still responsible.

However since I'm assuming from your last post that you all never signed one since they said it was not necissary I have only 1 tip. You can not imagine how many loans that we had while I was at GreenPoint. It consisted of a huge warehouse where we kept all the original files on the accounts...well some of the accounts. There was probably 40% of the accounts that there was no original paperwork for. Meaning all those original loan documents, the original title for the home, everything....all gone.

The only suggestion I could offer for that is play the "well where did you all put it" routine. if you can convince them they lost it, which is not hard, they will probably waive the whole thing. Saw it tooo many times.

Now regarding the repo. Under state laws, especially TX, there are not many legal rights protecting the homeowner of a Manufactured Home if the customer becomes in default of the loan at any time. Default on a loan is defined as missing at least 1 payment. So in reality, a lender or "lienholder" can come and repo a home whenever there is a default. Most choose not to at first because they would have a million homes and not know what to do with them.

Please keep in mind this only applies if at the time of your loan you have signed a "Security Agreement." A security agreement simply means if you sign it and default on your loan then you've given them permission to come and repo the home. Most people have no problem signing this because when you buy a home you never think if something happens and I can't pay they'll take it.

Now there are some states that if you do NOT sign a "Security Agreement" then they must file a suit against you to reclaim any property. These I do not know but you can verify which states apply to this by looking up Article 9 of the UCC (Uniform Commercial Code). Another tip is if the actual company that owns the home is calling the state repo laws apply. If it is a 3rd party calling, such as a "servicing agency" like GPC and Greentree then state AND federal laws apply.

Thanks so much to you for clearing alot of things up! however thare are alot of complaints about Greentree, to many for them not to be crooks. However although it seems to Greentree that they are well within their rights.

my husband was ill will cancer and relized we had to move out of the MH! so we called conseco to let them know of our situation. They said since our MH was only 6 months old that they could have someone assume the loan so our credit would not suffer! We asked conceco if their was paperwork to be signed for us to do this, an were told no! 5 years later its on our credit that we are paidon 1 and the other two that it was assumed! Now after trying to buy a new home it still shows in good standing, but just recieved a letter from greentree that the lady who bought or assumed the loan has abandoned it and now because conceco did not have my husband sign a Surrender of Secured property letter he is still responsable!why doesn't Greentree who used to be conceco take part of the blame in this for not having all the paper work done right? It's our fault for not double checking!

But because it showed on our reports as paid as agreed with thought everything was ok. now we are in a race with Greentree to get the closeing done on our new home before it shows on our credit! Question? How many notices does a lender have to send before they can repo? And how long will it take to show on our credit? Aparrently the lady is 5 months behind! But we just recieved our 1st letter! witch was A Surrender of Secured property? They along with that sent a letter saying that we discussed this matter before, and we have not discussed anything with them until this past monday wich was the 17th the last we spoke was with conceco in 2002! We haven't gotten a formal repo letter yet! We thought about saving the house, cause it is not dammaged bad, but it's not a windzone 2, and we can't go back to Dallas,We can't sell it cause of whats owed, and no one will rent it. Hi I am an ex-eployee with GreenPoint Credit. Was there during 2002-2003. At that time it was in no way affiliated with GreeTree. I want to start by saying that I am not defending nor bashing GPC, just hoping I can give some info to help those of you out who are having problems...and with doing a google search, there seem to be plenty. I was a Lien Release Specialist for GPC so I'm sure I never spoke to anyone on here. I signed the title/liens after an account was paid off or when an original title was lost after many many years. I was 1 of 2 employees in the company that did this if this gives you an idea of the workload. I can't answer any questions about the rudeness of the collection callers, but I can say if you are getting nowhere or being harassed by them then don't call them or any number they give you back. Any number they give you will be to the collection center. Instead look for a customer service 800 number for acct inquiries or accts paid off. There you will find a call center employee out of Poway, California that is 9 times out of 10 more informative an not as anal. Also another tip that most people do not know about is those that have received calls to their employers or their places of work. This is only legal if at ANY given time you have provied the number to them. If you did then they are within their rights to call. If you might have done this mistakingly or want them to stop the easiest way is to call them up and tell them you want to update your information. Give them another number (real or fake). As long as that info is on file they will continue to call. If you are affiliated with the military, active duty or reservist, they can NOT call your base or work center. This is against the Soldiers and Sailors Act and once you mention that they will hang up on you because they've been busted. What 99% of all GPC customers never know is that their loan is not even with GPC. GreenPoint Credit is a "servicing agency" for other lenders and banks. Any of you that have gotten your title to your MH should see that it is signed by a GPC employee "in lieu or for" another company. Usually stamped. If you fall into this category and most do, then call your original bank. Most banks that the loan started with were sold up to 10 times already. Call around and find out who sold what bank to who and once you find the latest tell them what problems you are having. That straightens alot out. Since you encouraged that person to file for a job in the tech department if they expect things to be "flawless",Might I say,I wish someone that could do it would!Greenpoint did the same thing to me and I know it wasnt Feb 1st,how do i know this?Because i sent my payment and they cashed it.

Then I was informed in March by greenpoints oh so rude employees that I was supposed to be sending payments to Greentree from then on.This was after I sent my payment in March and got a threatening call saying I didnt send it.They didnt notify me they switched my account.

Thats not exactly expecting perfection to expect to be notified they changed my account,furthermore,i'm in Kentucky,the other person is in another state and several more that have posted here is in other states.

Thats far from even efficient.If apparently noone was notified. If you want to defend your company kudos but get your facts in order first.

The rep was in fact correct, Feb 1st marked the date conversion of the Greenpoint accounts received were put into the Greentree system. Before this date, Greenpoint associates were working these accounts as well. It depends on whether your specific account was assigned to a specific region within Greentree or to a center in Greentree as to who is in fact in charge of collecting on your loan. The deal to receive these accounts marked more than $8 billion in transactions. If you expect this conversion to be flawless I encourage you to apply for a position in our Tech dept to help further our transistion in servicing this extra $8 billion in loans. Furthermore, any promised help option from any greenpoint employees are no longer valid as we bought greenpoint and now have the say in what we will and will not do to assist our customers in being current. Please post any further q's.
