I feel behind in my mortgage payments. I contacted the housing authority via the internet and somehow Hays and Associates got my information and contacted me. I thought I was talking to  a member of the HUD home assistance program which should be FREE of charge until I asked if there would be a fee for this service.  The representative then disclosed that she was staff of the law firm Hays and Associates and began convincing me why it would be a good idea to hire an attorney as opposed to other avenues. I've paid them $3999 in three payments.  I thought these people were on the ball so I gathered all the information they asked for and they had a notary out to my house to sign the contract and collect the documents within 1 week. I was contacted by no less than 3 people informing me that they were my case manager, then I finally got someone who was new and didn't seem to know what he was talking about.


They did the usual protocol of taking an application from me to see if I would even qualify for a modification and to see if they would accept my case. The representative informed me that my case was accepted.  This was in October 2009 and to date, my packet has not even been submitted to the lender, its the last week of January!


After they received my last payment, they stopped returning my calls and e-mails, knowing that I am  now in panic mode regarding my house.  Instead of paying my mortgage, I paid this company over $3000 thinking my situation would be resolved by now.  Now I'm more than 4 months behind in mortgage and receiving foreclosure notices back to back. When I confronted them about their rating of "F" on BBB report, there was no response.  When I asked if my file had been submitted to the lender, I was given a lame excuse that the file was being held up because I had not submitted a copy of my 2008 tax extension.    This is the first step in my process of recovering from working with this company.  If they do not deliver services promised, I will be asking for a full refund!

Hays Law Center and Hays & Associates Same Company According to US Better Business Bureau

where the US Better Business Bureau lists several addresses for Hays Law Center in California and starts the list with "Hays Law Center aka Hays & Associates, PLC"

There are 6 locations listed in California including Foothill Ranch, Lake Forest, Irvine and Tustin.
My clients who were scammed by this company lost $2995 to them.  I am working to get it back. 

ALL locations have an "F" rating.

Attorneys also cannot charge up front fees

This is a clarification to the response I just left.  California Law prohibits real estate professionals and attorneys from collecting up front fees.  No consumer need go to Law Firms or mortgage modification firms because there is better service for free from advocacy groups; and HUD will verbally give you a list.  Do not respond to pop-up ads.

California Law Prohibits "Up-Front" Payments for Loan Modification

In October, 2009, Senate Bill 94 was passed and enrolled by the California State Legislature and signed by the governor.   This prohibits loan modification companies from charging up-front fees for mortgage loan modifications.  You can get this service for free from many advocacy groups and from the consumer's lender.
However, if the loan modification is construed as a retainer to an attorney the company can get away with charging up-front even if the lawyer does nothing but lend his/her name to the company.
Forensic audits are also unneccesary. 
The situation is so bad regarding mortgage loan modifications that the Federal Trade Commission issued a regulation that as of January 31, 2011, no mortgage modification company is the US can charge an up-front fee.  The kicker is that if a lawyer's retainer is claimed by the company then up front fees can be charged. 
Pop-up advertisements are used by these mortgage modification companies and are targed to consumers if they check legitimate organizations like HUD on the internet for information or help.
The consumer should never pay any fee until work is completed to their satisfaction and there is no need for any attorney involvement no matter what the mortgage modification company says.
I work with homeowners on fraud involving these companies.  The worst states for the scams are California, Arizona, Texas and Florida, although these scammers can be found anywhere.  They can literally make millions and then close before the law catches up with them.   For some that is 9 months for some a year, but if they have an attorney they will stick around longer.

Is there any way that you can have this report taken down or corrected to reflect just Hays and Associates and please correct the address? 


I want to make sure that you are taken care of through this process by the correct company.


We are fighting a battle to show that we are helping homeowners and doing the right thing on a daily basis and it is hard when there are erroneous postings out there.


There are people out there that may not always be happy with the end result but that is not what we are being paid for.  We are being paid to fight to get the very best outcome possible and that is reliant on people being honest with us and sending us all of the required info that we request in a timely fashion AND it requires people making their payments on the new modifications we negotiate. 


We are here to fight for what is right and to enforce the guidelines created by the US Treasury and president Obama. 


I would love to have a website created for all of the clients that we decline.  I tell so many people they do not qualify and we refuse to accept any money from these people.  The cases that we do take must go through several layers of quality control before we allow them to retain our services.


I ask anyone who is really in need of help and wants to talk about their situation to call me and I will always share honesty and truth with them.  There are no guarantees and no promises but we will always do our best to give excellent service to every person we talk to.

Thank you Jeff.  I did my research, how unfortunate for your company having similar information.  Coincidentally, I did receive a call from the "correct" firm today making an effort to move on the case now that I have received a sale date. I'll see what happens next, there's a little bit of hope but they have to make me a believer.

If you look at the website for Hays and Associates, it shows its address as 17321 Irvine Blvd, Suite 202 Tustin, California 92780. 

I think you have us confused with another office.  We are both in the same county, we both have the name Hays in the name and we are both helping with modifications. 

We have never charged anyone the fee $3,999.  That is not one of the fees that we charge. 

I am sorry that this confusion is causing you so much of a headache. 

Please find the website for Hays and Associates and contact them for your issues.

I disagree with the response.  All of the complaints from others have been similar to my own. The location of the firm is the same.  I think this is another way for this firm to stall.  I am still a client because I intend to get them to do something for the money I've paid.  I think Rip Off report should require verification from the respondent and request that the attorney Mr. Hays responds himself.  This is a scam.

We have researched these reports on this website regarding Hays Law Center (Not Hays and Associates which is a different company) and we have determined that these are not our clients.

 Please be advised that you can check out Hays Law Center and William T Hays who runs this office with the CA State Atty Generals Office as well as the CA Bar Association. 

 Please do the homework before you believe everything you read.

March 21st, still no contact or refund from Attorney

I have requested a full refund of funds for no work done.  Its March 21st and I still have no response or action from complaining about this attorney. I will contact the California State Bar.

It is now February and there has still been no contact with me regarding the status of my case with Hays and Associates except one call to ask for an updated check stub.

I decided to contact my mortgage company on 2/2/10, they have never been contacted by Hays and Associates.  My house is actively in foreclosure.  When I e-mailed the original person I spoke to, there was never a response.   I even requested a refund.

This company has done nothing for me but collect all of my personal information and debited money out of my checking account.  I expect a full refund of my money because I have had to contact my mortgage company and do everything myself.
