HCC Surety 625 The City Drive South, Suite 130 Would not pay surety after providing all info as to the Contractor abandoning job and Contractor be found guilty of fraud to others as to us San Diego, California

We hired a Contractor to remedy water and drainage problems, as we got further into the water intrusion we continued to pay more money, the contractor who had their surety bond with HCC began hiring people who didn't know what they were doing, ruining my home, I received a material lien on the home, work men were coming to me and saying they wern't paid. It went on and on, I found 2 newspaper articles that stated 1 of the partners of the company went to jail for 11 months for 19 felonies. He would have received 15 years but he paid $200,000 restitution to get the deal.  I provided all this to HCC, they still made me junp through hoops, their answer was "No" I hired an attorney to 3rd party me and to help me keep my sanity.  The maximum they were to pay was $12,500.  2 weeks ago an independant adjuster told my attorney he wanted to speak directly with me to verify info (the bills, liens and checks weren't enough) and then he would cut check, I called and told him the story, he said he had to get info to HCC, I said "No" I was promised if I spoke with the adjuster he would cut my check. I called Adjuster back and left messages for 2 days, on the 3rd day I went off on the voicemail, advising I had been doing this since September 2010. Enough was enough, forget paying me I was now going to court for Trebel (3 x's the $12,500) I had been more than patient.  Someone from Corp called my atty and said they were going to pay me, give them 2 weeks.  I am still waiting for check.

This is horrible, according to Corp, the Contractor denied all, HCC has made me beg for what they had insured the Contractor for, certainly liens, paid checks for appliances, material and work not completed would have been one to pay quickly.

As dar as I am concerned this is in the realm of criminal behavior. They are on the NYSE thing they can just shove us around
