Unprofessional, deceptive practice, unethical, ill intent business:
I have called this company in late May 2016 to obtain a quote for concrete slab and sunroom addition. I was coerced to give a deposit of 20% ($ 4,400.00) the same day  in order to keep the offer; and was informed if  I changed my  mind a refund will be  provided and was given a date when they will deposit the check on June 2nd. And was told the check had to be cleared in order for the General Contractor Joe Hermann to come and obtain basic measurement for drawing of the project. A day later, I started receiving call everyday from the salesman asking if it was okay to deposit  check in order to send GC for measurement; and was once again reassured refund will be provided if need be; and said "Joe the owner is a

military man, honest with great reputation, and never had any problems."  After the company had cash my check, the general contractor came two weeks later and took measurement.  One to two weeks later, they emailed a drawing that did not reflect  what was agreed with the salesman. When brought to their attention, I was asked to pay more money to have what was promised,  and did not agree. And later, I had trouble contacting this company via phone.  In less than 30 days, I requested a full refund of my deposit, I was told the owner was in Panama vacationing for weeks, and was assured by the manager Laneha that I will receive the refund when Joe returned. After Joe was still away for more than

two weeks, I was told the salesman  Al Chambers was responsible  to make the refund and will be contacting me. A week later,  I was told he had a massive stroke and was in hospital. Then finally I was able to contact salesman using a different phone number, and he had stated  "I am just the salesman, and not responsible for refund...etc."   As of today this company has refused to refund  my money, and was recently told by HomeAdvisor dispute resolution dept. (on Oct 9,2016) the salesman had  offered $ 1,000.00. However, I had never heard from anyone from Herrmann Brothers Enterprises with a proposed resolution.  And as a compromised, I had asked for the concrete slab to be completed.

Finally, Joseph  Herrmann had responded negatively. He had claimed that I owed him or should pay him $ 22,000.00 the full quote price for the contract due to the cancellation. Even though his company had deceived, coerced, and requested  more money to complete project, failed to abide with promise of refund, not following through, and refused to install concrete slab as a compromised. They have lied about need for permit, lied about  refund policy,  swindled same day deposit in order for basic measurement to be taken. This company did not  start or complete any work on my behalf,  did not spend money on project, did not apply or pull permit, I did not even get to the point to approve a drawing. Herrmann

Brothers had simply stolen  $4,400.00 for a supposed free estimate. A company with no customer service who requires 95% of funds before completion of work, who failed to inform customer upfront of their policies, and use deception to obtain contract.  Beware of deceptive tactics and unprofessional practice. Joe Hermann has responded to my email on 10/31/16 and said he will not refund my money, will not compromised. Therefore he is willing to steal $ 4,400.00 for work that he did not complete. This company has made no attempt and had full intention of coning people. I will not rest until justice prevail. I work very hard for every penny, no man or company should be allow to steal or take advantage of others, and keep unearned money from others.

Rebuttal to Mrs. Vassor's Report

Herrmann Brorhers Enterprises gave Mrs. Vassor a quote for a sunroom enclosure. She then signed the proposal and gave a deposit turning it into a contract. The contract was very clear abour what Mrs. Vassor wanted to receive. Mrs. Vassor said she wanted to oull a permit as the homeowner, when I (the Contractor) went to her home for the pre-site. She stated that she wanted to get the permit after the structure was built. I told her that could not be done and that a permit is needed and that we will pull it. I explained to her - to do it her way was wrong and would cost her additional money in fines. 

On the contract, the salesman wrote June 2nd as an addtional time line if she wanted to cancel and checks were not deposited until that time. We sent the customer approval drawings and she wanted to add glass. We explained to her that could be done but at an additional cost and then had the drawing redone. After the new drawing was resent to her; the homeowner stopped communication and we did not hear back from her for weeks. 

After weeks had gone by; we then received an email asking to cancel. We explained to her the cancellation policy which again is on the contract clearly spelled out. The salesman did have a stroke while I was away; out of the country. During these circumstances; my office manager was in full commincation with the customer. At no time did we tell the homeowner she owed the full contract amount; we only said we follow the terms of our contract for cancellation. 

A quote or estimate would never require a signed contract or monies. The homeowner purchased a sunrom and gave deposit. The homeowner is well within her right to cancel as we are well within our rights to enforce the cancellation policy since money has been spent with the draftmen and engineer as well as time, etc... 

The homeowner has already threatened my company; yet I will stick to the contract. There was nothing unethical or unprofessional done. We have a contract and will continue to abide by it. The refund policy again is clearly spelled out, permits are required but must be done properly which is explained by the contractor at the pre-site. The price of the contract did not go up, the customer wanted to add glass. 

Unfortunately the homeowner's complaint is far from truthful but as stated numerous times we will follow the contract and terms. 

 

At no point did I tell the home owner she owed us full contract amount for cancellation as the cancellation terms are on the contract in print. The salesman did offer $1000.00 refund through home advisor and homeowner refused looking for $4400.00 so we told her that we would stick to the terms of the contract. 

Then the customer emailed our of the blue asking to pour her slab. I wrote her an email back letting her know that I would not do business with her since she has been less than honest from the beginning with her emails and demands. She canceled that contract and we accepted the cancellation. I had told her to find another contractor. 

Myrian Vassor signed the contract on May 29th and sent an email to cancel on July 3rd. The contract also has a payment schedule as all contractors have and we do require 95% of funds when 95% is complete as it should be.
