I had a judgment placed against me in 2003 for an auto loan that had been repossessed from me. During the time of the loan going into default, I was married and a stay at home mother and my husband handled the finances. He kept from me that he was not paying my car note. I subsequently went to prison shortly after that and was officially released in 2013. It was not until my release that I was made aware that I had a judgment against me for the true balance of the vehicle as well as interest accrued at a rate of 6% during that time. I made contact with Hiday and Ricke, PA to resolve this matter and stayed in constant contact with Melissa (Hindle) ext 157. During our correspondence, Melissa sent me a letter asking for further information regarding my current financial situation. I supplied a copy of all bills, bank statements, pay stubs, etc. and completed and returned a financial worksheet sent by Hiday and Ricke, P.A. I also sent in a good faith payment to show that I was serious about setting up a payment plan and coming to an agreement on the balance that should be paid.

In the letter I received, it states clearly in the closing that "Keep copies for your records and return the form as soon as possible. AFTER REVIEWING THE INFORMATION, WE WILL BE IN CONTACT TO DISCUSS FURTHER...I LOOK FORWARD TO A MUTUALLY AGREEABLE RESOLUTION TO THIS MATTER." That is the last correspondence that I have received from Hiday and Ricke, P.A. It has been 9 months since that time. I assumed that it was a long process and that they would do as their correspondence stated and get back to me when the time came for them to make an arrangement. My phone number has not changed and my address is still the same so they have had ample opportunity to contact me as their letter stated.

Last night 4/29/15, I went to withdraw my rent money and my debit card came back with an error message of UNAUTHORIZED CARD USAGE and to contact the bank. I called the 24 hour customer service line and was told at that time that I had a judgment freeze on my checking account in the amount of $17,356.30, which consumed my rent money leaving a deficit balance of -$16,396.30. I have called for the past hour and a half to reach the person in charge of my file at Hiday and Ricke, P.A. and was finally connected with a secretary who simply referred me to the voicemail of a Margo Caverly. I am a single mother and full time college student and I am doing the absolute best that I can. I have no problem coming to a mutual agreement and monthly payment amount. I have been trying to do that with them for a year and have NOT avoided this situation.
