We originally submitted our claim for repair of builder defects and resulting damage to our new home's warranty company, Home Buyers Warranty, (backed by National Home Insurance Company which is located at same address as HBW), in August 2000. This company eventually sent one engineer, (who agreed with the two we'd already hired), then many months later after more stalling, sent more engineers. ALL the engineers agree. HBW/NHIC has accepted our claim in writing, but the only offer they made, (which was jointly with the builder's insurance company, Great American), was not enough to repair all the defects and damage. These companies told us they didn't expect us to accept their first offer and were waiting for a counter offer. We made that offer the minute our engineer finished his updated report. They recieved it approximately two weeks ago, and have not responded.

We have spent a great deal of our money and time trying to get this claim settled, and it seems like these companies are just stalling and playing games while our house falls apart, and we can't fully utilize the house because of waiting for repairs/replacement of parts of slab, roof, etc.

By their own expert's estimate, the house needs over $70,000 in repairs, and that does not take into account any damage or defects that'll be found when the roof is torn off, etc, much less loss of value. The builder himself is doing nothing that we can see, though he has claimed he is.

(Richard Fuller Homes) Thank goodness for a couple of homeowner advocacy groups that provided the info we needed to even get the claim accepted. ( www.hadd.com and www.hobb.org ) As a result of submitting our complaint about this builder and warranty company online, we have found many others who are unhappy with these companies, too.

Please email me at cschnackel@fourteen.net if you have had problems with any of the above named companies.

#3 UPDATE EX-employee responds

Lied to employee

AUTHOR: Emily - (U.S.A.)

POSTED: Monday, August 21, 2006

I answered an ad on Monster.com for a customer service position. I called and in a few days received a phone call from outside Denver Colorado from woman who was returning my call regarding the csr ad for employment. She asked several questions and I was told a man by the name of Jerry would call. And that he was the manager of the Cincinnati Ohio office.

About 2 days later Jerry called and again asked several questions to me about last employment and what kind of experience I had. He set up and interview for the last week in June 2006.The job was very close to my home and working days which Ihad been working 3rd shift. The pay as $11.00 per hour.I went to the interview and signed papers for the company to pull a background check and filled out an application.

He was seated in an office which I thought was his.. He spoke with other employees like he had known them all his life. I came to my first day of training along with several other females and a male. We met our trainer who had no idea about living or working in Cincinnati. We sat for an entire week in a conference room listening to a bunch of garbage on how to turn the claim down when a repairman should call to get authorization.

We did not do anywork except read from a book. We was constantly reminded that the end of training we would take a test and if we passed we could keep our jobs. If we failed the test we was history. On the third day of training we lost 1 person in class. The fourth day we lost another person. I kept asking questions about how this works or why does this happen. I was treated like I was an outsider.

I have owned my own home for 26 years and know how appliances should work.WE had no use of a drinking fountain , no badges, we had to eat our lunches in our cars. no access to any breakrooms as this was not HBW's business . They had rented space from a telemarketing company in Blue ASh Ohio. A very small room was to be the call center. My class was the 2nd training class. The first class had almost all quit. They had 4 employess left and 2 of them was supervisors. We finally got access to the break room were we can get water, food, microwave. As the 2nd week was ending we finally got some training on the computers.

I had asked why can't we sit with people and listen in on the calls. They was trying to train us while 2 other ladies was taking calls all sitting beside each other. we trained first how to reject claims.then we trained on how to authorize claims if and if only they met certain criteria set by the company. I went into work the middle of my 2nd week and was told that " had no job, that this was not working out" Jerry said and escorted me off the property, no rhyme or reason as to why. All I did was ask questions on why we was turning down claims but yet customer service was taking the applications and the real estate agents was selling these warranties to unsuspecting homeowners.

The trainer kept side tracking and never really answering any questions. I called the home office in Denver to askwhere is my paycheck. I was owed for 63 hours at $11.00 per hour. I was told to call the same person who fired me for no reason and ask him. I called Jerry on his cell phone which by the way was a Colorado Cell phone which was a long distance call and the man was supposed to have lived in Cincinnati for over 2 months starting up the business. I was told to call Denver that the HR there in payroll was handling the matter. I had made a total of 4 long distance phone calls to find out where my check was. But I kept getting the run around.

I had contacted the Wage and Hour divisional office and I had emailed Channel Nine News I-Team.We had no phones set up not even to call home to check on our children or family. No one could get ahold of us unless the called a Colorado phone number. But we all live in the city of Cincinnati. I firmly believed this company was a big fake. All that was being told to us was not real. I was released from my job for asking too many questions and I was not a YES man. We all was being trained to turn down claims when the repairman would call for authorizations.

There was some claims that was authorized. But please read the itsy bitsy fine print on the warranty. It will be used against you. We had no way to call into work unless we wanted to make a long distance phone call. We had to use our cell phones for emergencies.Home office in Denver never knew what was going on or so I was told. After 3 weeks of being off work, I finally got my paycheck. This company is a real joke. Anyone that works for these people should leave and leave now. Find a real job. cause all you are going to have at the end is nothing

Case Resolved!

My husband and I wanted to update our complaint on Fuller Homes and HBW/NHIC and let you know we finally, and satisfactorily resolved this complaint with all parties involved in June 2005. We got a lot of helpful information from HADD.com along the way, too. Thank you Rip off Report!

Still playing games three years later

AUTHOR: Cindy - (U.S.A.)

HBW has still not paid the offer it made to us nearly three years ago, an offer we only got after months of persistence and expense, and only because we found info thru hadd.com that let us get out of their incredibly biased arbitration procedure. Do not be fooled into thinking your new home has a "warranty" just because your builder bought a policy from one of these warranty companies...getting them to accept a claim and then pay it is a joke, it complicates your case, and both your builder and the warranty company get out of being held accountable quite easily. There is a new report on the truth about home warranties at hadd.com and I wish we'd found HADD and the Rip off Report before we bought. The Better Business Burearau is worthless to consumers for the most part, and even our state agencies keep complaints secret so consumers can't find out the truth before they buy. BEWARE!
