About 7 years ago we filed bankruptcy just to get this company to stop harrassing us. The origianl loan was for 11k. We were able to pay that down a bit before coming on to some hard times. Anyway, the phone calls stopped, and we let them go for 7 years. Just to make it clear, this was a second mortgage loan. Now we're selling our home, and offered them the 11k that we origianlly owed them. Well, Clyde Hawley is their negotiator, and when this all started, he told us that they were really easy to work with, they wanted to help everyone concerned, and to just not come at them with 1000 dollars, because they wouldn't take that for sure. We explained to him that we're in the process of buying another home, and needed 10 percent down, have closing costs... Well, Clyde tells my husband that he feels confident that they'll take the 11k, and to call back tommorrow. Well, my husband calls him, and his tuned changed. He then tells my husband that we now owe them 18k because of interest, and penalties, and we're making 34k in equity on our home. My husband told him that we're giving him all of the money minus what it will take to get into another home, and fees envolved with that... He said that he'd see what he could do. Well, now he refuses to answer our calls. I've been totally sick, and a mess over these people. I guess they don't have the guts to tell me that they don't want the 11k.

UPDATE!!

AUTHOR: Karla - (U.S.A.)

POSTED: Thursday, July 20, 2006

Our realtor spoke with Clyde Hawley of Home Eq this morning. He says they will not take a settlement, and that they want all of the $18,343.00 dollars, and he was sure to tell her that it's going up every single month we don't pay them. She asked him to fax her the payoff this morning early, and still he hasn't faxed it to her. Does anyone out there have any clue as to how to handle these people? Mr. Clyde Hawley has been less than honest with us on this from the get-go. I don't understand. He tells our real estate agent that we should of paid our payments on time, but yet he's collecting for a company "The Money Store" that filed bankruptcy.

I'm the lady that filed this report. I mentioned that Clyde Hawley for Home Eq says we owe them 18k, but they've/he's never given us a payoff. He just keeps saying that we owe them somewhere around 18k. That sounds so fishy to me. Why can't we pin this man down to a payoff?
