I have had this company as a second mortgage provider for 10 years and am about to be making my final mortgage payment. A recent check of my credit report revealed a July 2007 payment as being "late". After numerous telephone calls to Evon, Josie, Michelle,messages to Jen, customer relations department and others Homeq has refused to send me verifications of this alleged late payment. A subsequent check of my reports revealed that HomEq is showing more late payments and follow up complaints to the 3 credit bureaus result in, "the account has been verified by the reporting agenct." This company has no customer service or "relation" procedure in place to handle my situation. This is obvious. After 6 telephone conversations that totaled 4 hours in "hold time", I filed a complaint with the FTC. Will follow up then if no satisfactory response-hire an attorney and sue in my local court for violations of the fair debt credit reporting act; eg 1) notice not sent of so called late, 2) subsequent late reporting not substantiated. 3) failure to provide loan documentation upon request, 4)unfair and deceptive trade practices.5) other issues. Am also contacting the Better Business Bureau.

What good is a "MOD" if you can't afford the original payment to begin with?

I am writing in response to the "employee" of HomeQ that so casually gave their suggestions as a "struggling" employee trying to keep their job in this "sucky" market as it was put.

First and foremost, I am one of those consumers having trouble paying my mortgage at this time. Going to debt counseling has given me some interesting insight and I must offer my advice to you also.

1. When you call someone's home three and four times a day, please be on the other end of the line when that person answers the phone, don't call them through an automated system and set
them in a hold pattern, especially when you are calling them.

2. Why not send out copies of the fair credit acts and review them yourself while your at it. Predatory attempts to "collect a debt" are not going to get you anywhere in this society, and in this ever failing economy. It only angers the consumer, hence the angry rebuttles by said consumers when they answer you as they do.

3. Take a course in people skills, you obviously have none. You are within the 98% of our society that thinks only of themself. Dog eat dog right??

4. Comments such as dig into savings: Savings depleted my friend, don't buy that 60 ' vizio plasma, I have a kids less than 11" barbie television in my living room, sell the house? To go where? Can't afford the payment, due to loss of three quarters of the income, leaving approx 160$ for payment? What do you feed your children, if you have any, because personally mine are getting tired of rice and beans.
I don't have credit card debt, do you? I work fourty hours a week, and my husband works fourty hours a week trying to find a job, however with your agency trying to collect their debt and calling my home three and four times a day, placing my husband on hold while he is doing this is not expediting our success in becoming complete paying consumers in society once again.

5. Another thing about that payment issue, we have utility bills that won't wait either. The main things in life that one needs to survive are shelter, food, water and clothing. To maintain the shelter we need some help, food, we pay for that 100% because we are being told that with my husband's unemployment we make 200$ too much to qualify for food stamps, however once food is paid for we have 160$ left for what? We fall under a utility company that has a racket on the utility market where I live, which due to the sensitivity of the nature of this response, I choose, as you did to "protect" my identity. Back to that utility issue, they seem to have the same mentality as you do, if they work with you they want to add three to six hundred dollars on top of what you already owe. I do have to say that your comment about MOD being increased due to mandatory escrow, now there's a smart suggestion!!! ( that's sarcasm by the way)

6. Reading off your script is your job, but when I do my job I try to relate to the consumer in the best way possible to achieve the desired goal, you however work to achieve your protected goal, to keep your job, which in all essence, you are not doing a very good job of. If everyone in this economy in any form of consumer contact were to work together for a common goal to get everyone back on their feet, you wouldn't obviously have the job you do now, however you may have a better job that doesn't make you as bitter as you are now.

7. Know the consumer's situation before you call them, because when you repeat the same ignorant questions and insult the consumers by asking questions such as are you really looking for a job. Let me just say in response to that "How dare you?" In response to the question "why can't you make the payment? Our income has reduced significantly and if we can't afford to make a payment on a home that has been in our family for over thirty years, how do you think selling the home is going to benefit the consumer? By the way at some time in the near future, this consumer will be able to resume payments hence paying your paycheck. Why don't you chew on that issue for a while.

8. My children don't go to ballet lessons, or little league, we don't go out to eat, we live day to day to get by in this ever sinking economy that doesn't seem to have a light at the end of the tunnel.

I will close at this time, however, I could go on with this same line of thinking all day long. I do have to throw a name at you, so be advised NACA will be contacting you!!!!.

Don't bother going to the BBB of CA. Go to the Dept. of Corporations in CA

Hey there,

I have been this route for 2.5yrs, I have sent my case to the BBB of CA. They are very nice but have no power unless they get a substantial quantity of complaints about Homeq from the Dept. of Corp., the governing agency. You can fill out a report and hopefully everyone else will. You can also contact the Dept of commerce in your state. Don't waste time at the AG or the BBB they can't or won't do squat. In the future if we all get together someone will start a Class Action suit. I can't save my home or my credit dispite my efforts. But I will stand behind or with anyone that needs info. I don't give up easy.

I, Mark, (((ROR removed for security purposes))) North Carolina, in the County of Columbus, being 18 years of age or older, sound mind, under no due influence disposes and says:


1. In September 2007 during a random check of my credit report, I discovered a 30 day derogatory by Homeq, my mortgage company.
2. I immediately contacted Homeq and was told that this was a mistake because they saw that they had received my payment and it was incorrectly applied and entered and the erroneous reporting would be corrected.
3. I was subsequently contacted by Homeq and was told that I was 30 days late in July 07 and if I had proof otherwise to send them, they would consider removing the issue from my credit.
4. I immediately sent Homeq copies of the check for the month that Homeq claimed I was late.
5. Homeq subsequently sent me a letter claiming that my circumstance was unfortunate but the derogatory could not be removed from my credit file.
6. Homeq refuses to remove the alleged 30 day derogatory and is now reporting derogatories for 7/07 and 8/07 as well.
7. I have been with Homeq for 10 years and never had a delinquency.
8. My mortgage with Homeq is about to be paid off.
9. Homeq never sent me any notice claiming that I was delinquent thereby giving me any chance to respond or keep such from damaging my credit.
10. I believe Homeqs lack of default notice to me is a violation of the Fair Debt Collections Act.
11. Online challenges to the 3 credit bureaus have resulted in the response that the creditor has verified this debt as valid.
12. Requests to Homeq for my complete file and payment history along with the initial contract for mortgage have gotten no response.
13. I received a letter from Homeq on October 10, 2007 claiming my concerns will be investigated.
14. I applied for a loan with Bank of America to finance braces for my 9 year old son on October 18, 2007and was turned down because Homeq was showing 3 consecutive months as late.
15. Several telephone calls to Homeq resulted with me speaking with Michelle, Josie and subsequently Jen of Homeq on October 19, 2007 regarding the showing of additional payments as being late in August and September.
16. Jen claiming to be a consumer relations supervisor rudely told me that she had
contacted the 3 bureaus and corrected the additional 2 months late showing.
17. Jen also said that I, nor any attorney couldnt do anything about any late showing for July and that the other months late showing were the credit bureaus fault and not Homeqs.
18. I requested a payoff from Josie and sent a final payment of $83.93 on 10-19-2007.

I have emailed them both and they called me back - they must know they have done something wrong as they now have their attorney calling me.

I have the same problem as you - illegally reporting to the credit bureau, illegal fair debt collect . . . I could go on.

I also emailed the CEO of Barclays Capital who owns Homeq

Mark the best thing you can do is stay off the phone. The only thing you will get is lies. You need to write a "Qualified Written Request". You can google this and find out how to correctly format it. I recently sent one and am waiting for a reply. You are going to need a paper trail. You can ask for anything regarding your account in this letter and according to RESPA laws they have 60 days to answer the demands you are requesting. You will need this if you plan to hire a lawyer. The reason they are targeting you at this point is because you are about to pay them off and they know there is some equity in your home. This is the perfect opportunity for them to try and foreclose on you. Any information you request has to be in writing in order for it to hold up. Make sure to keep a hard copy yourself and send cc to your lawyer and anyone else that it might help to give it to. I don't know how you sent your payments. We sent ours electronically and that's where our problems began. All payments need to be sent certified with return receipt. Just keep in mind that they have no intentions of trying to work with you. This is how we all ended up in the mess we're in.
