Our home is in the process of foreclosure...we have NOT been foreclosed on yet so we are the property owners.  HomeQ has set foreclosure dates and postponed them several times, which has been highly stressful!


My husband lost 2 businesses in this economy & I was out of work for almost a year.  But we both have full times jobs just no where near the $ that we were making.  HomeQ said there was nothing they would do for us, foreclosure was unavoidable.  Husband works 80 + hours a week on commission only!  It has been very difficult for us and highly emotional but we are hanging in there and trying our best to maintain dignity.   


My husband & I have a pet duck.  We've had her for 11 years & we love her like a person would love their cat or dog.  She is always with us outside doing gardening, chasing bugs and being beautiful.  She is black w/ irredescant green & blue feathers on her wings.  Her name is Shad.  She had her own house (a large secure duck-shed) that was clean, had lights, well hayed w/ food & water.  She even had a radio to keep her company after our other pet duck of 10 years past away this past winter from old age and that devastated me, but I still had Shad to love.


Because of the foreclosure process we've had to move  & found a place with a barn for Shad.  But the barn needed to be secured from foxes, fishercats & other creatures that would love a duck dinner.  At our old house we knew Shad was safe so we left her behind until we could secure the new barn.  We visited her several times a week & she always had plenty of yard & pool time w/ fresh food/water & bedding.  It has completely broken my heart to leave her behind and not have her with me but I knew she was safe.  This has been very difficult on my whole animal family but we are all doing what we can.  Our cat (18 years old) and dog (10 year old Great Dane) are adjusting to the new house.


As an old duck, she would always roam the yard for an hour or so and then waddle back to her bed...just not the young duck she once was but we loved her & cared for her.  Recently she took to sitting by my feet and wanting her neck rubbed & scratched.  She loved just sitting in the sun while I read closeby.  She was such a joy and I've learned so much from her quiet nature and personality.


I stress that no foreclosure has gone through and we are the current owners of the property.  HomeQ sent "someone" out to mow the lawn & prepare for an upcoming auction 3 weeks away. This "someone" called Animal Control about a duck in shed.  AC came & determined the duck was healthy, had food/water/bedding & was safe so there was no reason to remove the duck.  This all happened while we were away.


This weekend we were ready to move her to her new home.  But b/c it was raining yesterday (she doesn't like rain - so much for duck weather) my husband went to check on her & we were going to move her today (sunny Sunday).  When he got there Saturday, she was gone.  Only a note/ph # from AC to call but they weren't going to be open until Sunday. 


When we got to AC this morning, they confirmed they did not remove the duck for she was not in danger only they wanted to communicate w/ us about her being on the property.  They were surprised to hear she was removed. 


Our neighbor confirmed that the guy from the bank cut our lock & removed our girl in our cat carrier!  He left no note, I don't know who he is or where my girl is.  I've just spent all morning filing a police report & calling all the animal shelters & wildlife rescues & no one has recieved a duck or heard of a bank doing such a thing.  Not to mention the humiliation I felt reporting someone stole my duck...to me, it's a big deal...to them the first look is, "you're putting me on, right??"  Lovely professionals that they were, there is no easy way to file a complaint "My bank stole my duck!"


I am beside myself with worry!  I am physically sick & contemplating going to the ER for chest pain but I know it's anxiety.  The bank isn't open until tomorrow so I can't find out any info.  The police don't know anything and the animal shelter confirms there was no reason to remove the duck, only they wanted to know our plans to move her into her new home.


We are doing everything we can think of to get her home, to find out where she is!


How can this guy come onto our property, mow our lawn & steal our duck??  Aside from pressing charges, I am so beyond upset, beyond worry.  It's no different than if someone had a dog in the back yard in a kennel w/ food & water to come home & find the lock cut & their beloved pet gone!!!  And can I afford to miss work in this economy??  companies are laying off left & right!!  I'm afraid of loosing my job to take a day off to find my duck.  Do companies even have a Leave of Absense for missing ducks??  I don't know what to do, who to turn to, or what.


Can banks now tresspass on someone's property and make judgement calls on what is abandoned & not abandoned??  Can they help themself to an "abandoned" stainless steel fridges? or stoves?  light fixtures? Can they break down your doors and take your cats? or your beloved dog while you're at work? or in the process of moving?  If you leave your cat alone for the weekend w/ plenty of food/water & litter boxes, did you abandon Fluffly?


Our neighbor told him we did not abandon the house or the duck.  He got beligerant with her that he sees it all time working for the bank.  She told him to leave our duck alone.  We're not that close & she didn't have our cell #'s...I wish she would have called the police but the bank guy told her the bank owned the property (I stress, they do not!...yet).


As a kicker, we have a big dumpster in the front yard b/c we've been in the process of moving (no, we're not entirely out of the house yet!) and he told our neighbor to help herself in unloading all her trash (she had a basement flood) into our dumpster!  Wasn't he generous!!??


I want this guy fired! I want to sue him for this pain I'm going through! HIM and the bank!  I know this world is "sue happy"...I've never wanted to sue anybody for anything but I am SO ANGRY!  I can't stop crying! I can eat anything!  Can't anyone help me??

Our beloved pet duck was returned!  The bank admitted the duck should not have been removed as animal control determined she was well fed, watered, had fresh hay & was safe.  They also admitted their contractor ignored policies and did not file any notification w/ animal control that an animal was being removed from the propery.  I think they realized it was not in their best interest to not return our duck when the police notified them we were quite serious about pressing larceny charges!

It is extremely cruel to abandon an animal in a foreclosure but that was not this case nor was there evidence that abandonment was our intentions...in fact, there was plenty of evidence (as animal control could plainly see) to the contrary.

Regardless, our pet duck is in her new safe barn getting ready for winter. :-)

Although sypathetic about your pet, they did what was right! In this day and age as I am sure you have read-people are leaving their homes and PETS behind every day.

Your intentions to move your duck MAY have been good, but who is to know.

Shelters are full of abandoned pets, or they are running feral having been dumped off by their owners or even worse they sit starving waiting for their owners to come back to get them.

I hope you get your duck back, and for all of you who are losing your homes and can't have your pets... be humane turn them in to a shelter-they can't take care of themselves and you can't truly believe someone is going to come along and "discover" them often times IF someone does come along- they hide because they are scared and disoriented they may not be the "really cute friendly pet you left behind"
