OMG! I can't grip that there are so many more of you out there that have been or are going through what we are. Our case Started when IVAN rolled though and flooded us. I was in touch with this mortgage holder from day 1 letting them know what the status was with our case and FEMA.


As you can see the wall on the right is buckling, and the wall strait under the light has started to come down and is no longer supporting the house in that corner. Its very close to the electrical box.

Since it was taking so long to get FEMA in gear we took out from his retierment to cover our motgage. Then we had the damage from the flood to deal with and 2 young children in the home ages 1 and 3 at the time. We had to spend the money on fixing our furnace, Water heater, and more. Not long after that we had to put our house up on jacks as the foundation gave way and the house started to shift.

The county engineer came out to inspect the house (his second time out) and wrote up a paper stating that we should not be living here until such time as the foundation could be fixed due to the very real posibility of a fire as the electric pannel box was very close to 1 wall that was falling in on us. Though the city refused to give me a vacate order since they knew the damage to the rest of the home was extensive and it should be demo'ed and rebuilt. They didn't want to be help responsible for that.

By the end of the year I was very ill, and ended up in the hospital with a galbladder full of stones. My husband had to stay home from work to take care of our 2 little ones durring this time. As i got back on my feet he got back to work and again I came down very ill. I called the motgage holder to let them know why we had missed a payment sinse i do all the bills. They had no mercey.

Thinking it was just the flue I didn't complain much till one night i could not move. Back to the hospital we went and was told it was just a UTI so home we went. Still ill we went to my sergons office to be checked on for the past surgery and found i was truely very ill again. Back in the hospital I landed due to a very bad kidney infection (ecoli), This took a while longer for me to bounce back from and after 7 days was sent home with an IV every day for 9 days. again my husband had to take the time off work to care for the children while i was in hospital.

He had used up all his vacation time by now and we had no income until I got home to care fore the children. then it was a week before the first check came in. What do we do put food in the house for the kids?, pay on our utility's? car? or what. That little check can only go so far. We called the mortgage holder again to let them know what was going on but after the rudeness i had to deal with was not in any shape to do that again soon.

Now with the way the house is, our energy bills are through the roof, and we fight just to keep them turned on. Well as of monday 4/20/06 we will not have heat or hot water unless I boil it to use to clean ourselves and our children.

In talking with our mortgage holder durring all of this it has been extreamly hard to hear them say things like we should divorce and leave the home so i can go on public aid with the children, or tell me oh you have not tried to contact us at all, or even that I should stay up until after my children are asleep to call them when my medications for my seizures knock me out sometimes before my children go to bed!

Who do they think they are to treat people like this? We used all of my husbands 401K retierment funds, and tax returns to get them paid and even when we do that they act like we just don't want to pay our bills.(if that were the case why would we have done that?) Now they are raising our monthly payment to cover the forced insureance they put on the house 2,500.00 a year mind you. while we were looking to get our own and have now. Soon they will add our back owed property taxes onto our payment and that will surely make that payment to hard to pay at an increase of 300.00 a month.

It is 3:07 am EST right now and i am having trouble sleeping due to the stress they put on me/us. (even after taking my medication that normaly knocks me out in an hour.) If this mortgage holder is also banking with or part of a bank then why cant they work with people like us? Why force us out of our homes with all the increases?

As it stands right now we want our home! We got married here and had one of our children here. We are willing to work out a plan with them but it has to fit within what they know we can aford not push it way out of our reach! Though I would realy like a new mortgage company not some darn collection company like this one.

They are sending me papers for a shot sale on the home. well if they are willing to take less than we owe them than whats the deal here?.. are they in this just to force people out of their homes? thats how it seems to me at the moment.I just don't get it at all.

Companies like HomEq have ways of doing things! I had originally tried getting a loan modification back in October 2008 I knew I qualified for this because I had read what you needed to qualify for! I then proceeded to get one but we all know how rude HomEq employees are! (With the exception of one I dealt with 2 years ago) I am sure there are probably a 1% of good employees or perhaps are gone from that negative atmosphere!

Anyway, I was denied 3 different times! I then read on Ripoff Report from a former HomEq employee to try to go through a third party negotiator he saw that HomEq approved some modifications this way. So I did! Only to my surprise that HomEq told the third party that everything was going great and that all I was to wait for is paper work finalizing the loan modification! But HomEq decided to call the third party on Mon April 20, 2009 two days prior to my house being auction on Wed April 22, 2009! Of course, I could not do anything in 1 day! I was scammed out of my home! There is something very fishy about this company! They have a way of doing things! My house was bought by HomEq so they are the owners now!

My house went on trustee sale and HomEq bought my home! Fishy, huh? I have been talking to HomEq's CEO assistant and is willing to give me back my home but I have to pay late fees, attorney fees, etc; 13,000.00 to be exact! I want to believe him but I know that he is going to probably deny my modification as well and all of my effort would have been for nothing! I have to leave my house by June 19, 2009 if I do not come up with at least 6,500.00 before the 19th? My mothers whole life savings went into this home (50,000.00 to be exact!) All of of this rude comments from HomEq employees have no idea on what we homeowners go through with this company! But yet they can critique us!

I wanted to respond to your message because you mentioned a law suit? Are you still interested? Please let me know I have been communicating with other people having this problem or very similar problems! I will wait for a response. Thank you and have an outstanding day!

My husband and I refinanced our mortgage a few years ago. The mortgage was sold 2 months later to Fairbanks Mortgage Co. I looked up the company to find out about them and ran into this website. I was so scared and concerned about having this mortgage company from reading all the reports on their predatory practices, miss applied payments, forced insurance! I stayed with them for 2 years. My husband and I decided to refinance last year, just for peace of mind! We did not have a problem but were scared! We paid the pre-payment penalty and went ahead with the re-fi. My new mortgage has been sold yet again and guess what? I now am with Homeq Servicing! CAN YOU BELIEVE THIS!!! They are the old Fairbanks! I thought I would faint!!! I am not late or behind with my mortgage but I get harrassing phone calls that start the 2nd of each month asking where is our payment? you are in violation of your contract!

They call me home serveral times a day and call and harass me at work. I keep telling them that they will have the payment by the 15th as they ALWAYS do! They keep telling me that yes I do have a grace period but I am still in violation after the 1ST. Then why do I have a grace period? Can they harass me every month before the end of the grace period? This month I got a call on the forth and the woman DEMANDED to do a check by phone immediately!I told her that I would make the payment on my own and they would receive it prior to the 15Th.What can I do to stop these people from calling me several time a day for 2 weeks every month? The way our pay periods go, we can pay between the 13th and 15th every month.

I can't tell you what a blessing it is to have this issue done and over with. Yall might get a giggle out of this too.

We did the short sale and homeQ sent thier guy out to take pics and the whole bit.. Were they in for a shock!. I guess thier guy told them this house was a demo, just as I had been telling them (with proof) and they took the short sale.

They wanted a pay off of over 50,000 mind you more than we owed on our mortgage. and they took the short sale getting no more than 21,000. (I cant help but laugh at them now) They had to pay off property taxes (2 years worth) and all of that nonsence and we got 7 months free living out of it.

We are in a rental now and so much happier than we have been in the past 2 years. We have a much nicer home and love our landlords who know all about this mess. HomeQ can kiss it as we have gotten out from under them and could not be happier. Our landlords have also offered us this wonderful home on a rent to buy plan!!! This could not have worked out any better for us.

As for "J" from homeQ and the mean things she said to me, HA! HA! HA!.. who is laughing now my dear?

Typical Homeq Behavior

I'm guessing that "J" the beloved HomeQ Employee who enjoys writing such nasty and hurtfull comments, is probably a very lonely person. In order to have the hate and disgust that so easliy flows from their keyboard, they have never been in the drivers seat on one of life's many unexpected adventures! The beauty is...one day they will be! NO amount of preparing or insuring, etc can keep you from unexpected chaos!

This person so enjoys their ability to seat themself at their computer and dish out their contempt for those they feel are " beneath" them! Yet do they EVER offer any help or insite as to the problems listed in any of these complaints? The main concerns are always avoided with the same answer...."Read the loan docs"......We are told numerous times to refer to the loan docs and that we are sold to them because of "Poor financial history". Or, ...... MY personal favorite line!! "Pay your loan, you signed for it!!" (Dont you all like that one? )

However as "J" sits there lashing out at us, let me just say, HomeQ is currently under BANCRUPCY PROTECTION, hence they are UNABLE to pay their bills!!!!! THey have continued the same type of behavior for NUMEROUS years, only to evolve like cockroaches, change their company name and start again! They have been the money store, Fairbanks Capital, HomeQ, and I was just informed they are soon to be "Barclays", so the saga continues! (this last bit of info came from an employee when I was trying as I have for several months to straighten out my complaints with them!)

Now, as for them getting our loans because of bad credit, NOPE, I had a credit score in the 700's when they bought my loan! Companies that re-fi you will look at your history. If you have re-fi'd before and the previous company didnt "make a buck" on you, then they want to dump you as soon as possible because they arent going to get anything out of you if you continue to re-fi, unless you have a stiff re-fi or prepay penalty! SO......(enter Homeq) the lovely comments we have thrown at us about our shamely credit are BOGUS!!

As I said My score was in the 700's when they bought my loan, I am now in the 500's thanks to their incompetence! (And please dont get me wrong, I am not saying i have no fault here! I fell behind one payment due to unauthorzed charges that cleaned out my bank account. HOwever I also have 3 RETURNED checks that Homeq will not accept and am in the middle of ATTEMPTED forclosure) SO for those of you out there still dealing with these MESSES, keep your chins up! They claim to be the Biggest SUB-PRIME company, well I always heard "THE BIGGER YOU ARE THE HARDER YOU FALL"!

Just ignore good ole "J", what ever comments they have to offer aren't worth the effore of reading! They love to comment on how we have so much time to add comments on here, well if the employees we talk to on the phone could offer help, we wouldnt be here! I do have to say on their behalf, I would HATE to have a job where I had to sit and be nasty to people all day! Where my only duties were to write to people and tell them how pitiful I felt they are! We should all take a moment to realize how aweful this person's job MUST be! Homeq can pay an employee to be nasty and critical, but not to handle our issues when we call in?

SOmething is DEFINATELY fishy with this company!

By your own post it looks to me like you are the vampires talked about in posts I have seen. Your company is out to take over property, not work with people who may have trouble now and then. Like you said we don't pick you, you (pick) hunt people like us down.

I don't need your pity or anyones for that matter, But I sure will speak my mind anbout how your company has treated people and make it impossible for anyone to get things worked out. I was paying until things got so bad we could not make the raised payments anylonger thanks to your company. (2,500 forced insurance is a rip off in its self!) By the way I have just as much right to own a home as anyone so that comment you made about my health and renting was extreamly rude of you.

I hope one day you have a mortgage note carried by homeQ so you can see how it really works not just the way you think it works.

Dear lady you should check to see what the case is befor you remark on these threds. It's not my bubble that will burst. Your company had an offer on the table for a short sale for months now and have not taken it. Now they send out stupid foreclosure notices as if I care. If they don't want something back on the note that is there problem not mine.

Bankruptcy clears me of all of this mess so its not me that is getting screwed any longer. I have done every thing I could to work with your company and they yet again duck around doing nothing. I have another home now and wha la no stupid mortgage holder to deal with so kiss my grits! If your company would have let me pay up then this would be done and over with but no they said they would not take my money so thats on them not me. And by the way your company is A DEBIT collector even if you say they are not, though I dont really care since I no longer have to deal with them!!!!! They wont get a dime for this property if they don't get on the ball.

If you are planning on getting another mortgage, keep in mind, you may end up back at HomEq. We service loans of people who can not pay on time, have bad credit or unverifiable income. To tell people to stay away from us makes me wonder if you really understand mortgages at all. People don't choose us, we choose them.

It seems like you just want pity and you want people to think you are the innocent one. Next time you get a mortgage pay it, you signed for it. And if you already know you are sick, maybe you should rent.

As of now here is where we stand!... The motgage holder has refused payments from us at this point since things got so bad.



We have the home up for short sale, though as was stated in this ubove, it will not get near what they want for it and no one around wants to buy it. We also got flooded again with the flood of 2006 that made things much worse. (NOT CLAY SOIL) So we are going to do the only thing we can now and let homeQ have this dump. They rather deserve it after what they have put us through.



We will move on and start over in another state (not named) and find a better life for ourselves that way. For all of you out there just stay away from homeQ if at all possible and if your with them now I pray you never have a act of nature that puts you in the same shoes we are in as are the people who servived katrina.

Maybe stepping back for a better perspective is needed...?

I skimmed through OP's posts and the responses. The OP wants to keep a house that may be beyond salvage because if the saturated earth is shifting and destroying the foundation then the house may be hopeless. That earth is probably clay, which becomes unstable when saturated. If the earth becomes stable once the earth dries out, there may be a chance of salvaging the house by building a substantial new foundation under it, but the repair work will be expensive and the house will have a 'history' that will render it almost unsalable. I have looked at several houses that had foundation failures, and I passed on ALL of them.



Many times the standard homeowner's insurance contracts do not cover these issues; one often needs "flood insurance". These questions are why God invented lawyers....



I believe I would have bailed when the need to tap the 401k arose, because that 401k is your retirement. But that is water over the clay now.



Unless you can reach a compromise with the note holder I see little hope for keeping that house, and I agree with the post suggesting that destroying one's health is not a solution. My wife was in our local hospital for four (4) days this summer for a straightforward abdominal surgery, and the hospital bill ALONE was over $28,000. Then there were another $2600 in charges for the surgeon and anesthesiologist. The room was about $3100! The operating room added up to less than $2000 total. Where did the other $23,000 come from? Lots of other charges, like drugs dispensed to replace what my wife takes every day ($5600). We have full insurance so our cost was $150, and the remainer of these bills were reduced based on prior agreements the hospital had with the insurance people. What is my point?



You may have presently have medical insurance thru your husband's job (I hope so) but if you should become uninsured and your health is irreversably compromised by your "house situation", your future quality of life and your retirement could be severely harmed. I suggest you reconsider your options from a strictly economic viewpoint, and get good info w/r/t renting an acceptable apartment and so on so that you can make your best decisions based on economics. Write everything out on paper or in EXCEL on you computer as an aid in decision making.



Sympathy from other posters may temporarily make you feel better, but I cannot see how these sympathic posts will provide concrete improvements to your present situation and protect your future in a sustainable way. Maybe I am missing something.....

You Are Not Alone

Since Katrina (and in your case, Ivan) lives have changed in many ways. Many of us lost our jobs and to have someone in California tell you to "get over it" is adding insult to injury. I don't expect HomEq as a company to be my best friend...but why did HomEq make such an effort to buy up hurricane damaged homes? Our mortgage was purchased after the storm and after the estimates had come in for the damage. I have been astounded at the number of complaints against HomEq.



There also appears to be a common theme that resonates within almost every complaint: rude, unprofessional representatives and antagonistic, agressive business practices. However, given the fact that these are sub-prime loans these practices are tolerated and therefore, encouraged. I don't understand the rationale behind HomEq's business practices...this company seems to make an effort to alienate its customers.

I as the home owner am not in any way trying to get off without paying my debts! But as you can see from the many posts here about the company you work for, It's not just us this company has done this to. To tell me to stop thinking of what the company has done to me is rude like most the people I have talked with from your employer.



I will never forget this company and I will tell anyone and everyone about them. As for them ending up on top? I don't see how they will since they will not get what is due on the balance of the mortgage note of this property, infact they will get much much less! How is that good for them or good business?



The main thing I have learned in all of this is to check this site first before dealing with any mortgage holder/company. The hurricane was not my doing I can not controle nature. So in no way was this my mistake!

People like yourself don't know the full story and should not comment as you have, given lack of information. I am disabled, My husband works full time at the same job for the last 18 years.



I am a stay at home mother of a 2 yr old and 5 year old. We have tried to do the short sale as you mentioned but given the damage to the home and property form the hurricane (Ivan) 2 years ago sept. The home will not sell as it needs to be demo'ed and the land fixed.



You don't know the damage here so please hold comments unless you are willing to come see it yourself. We have tried doing every thing the mortgage holder has asked of us. We are at this time looking into moving on with our lives and leaving this place for them to deal with foreclosure or not. It has become a night mare not to mention a money pit.



Last tiem I looked this was AMERICA and land of the free, remember the right to free speach?.. this site is just for that so don't tell me not to share my experiance with anyone who would like to know about them. I don't understand people like you!

Instead of wasting your time on here writing your complaints about a company that is actually holding you to the legally binding contract you signed you could of been looking for a job to make the $ to save your house. Yes, Mortgage company will hold you responsible for the debt you created. It is the banks house until you pay it off. You could of always done a short sale. Stop thinking about whAT HomEq gets out of it. You couldnt pay your debt, of course they are going to end up on top. Hope you learn from your mistakes.

It's at its worst now, we have lost our home and are just waiting to be removed. (looking for some where else to live.) I have had to Place some of my dogs (2) and 1 other will have to be put down. I can't see how this could happen in America but it has. If we don't move on our own they are going to have us locked out of our home and keep all that we have left in the house.



They already have a realtor that is bringing people over to see the place (if we can't live here how could anyone else?) Now it's come down to fighting to keep our children ages 2 and 5 yrs since we dont have any where else to live. They could end up in foster homes if we don't find some thing soon. We have to stay where the work is or we wont even have an income. We have asked for help from all kinds of places and my husband makes to much money at his job to qualify for the little aid they would be able to give us. Thank You so much for your understanding, no one else seemed to!



Also for what you have done in battle, I know that came at a great cost to you and yours. Your a man to be proud of!!! It hurts to know all the katrina victoms will suffer this same injustice.

Keep your head up girl!!! I just went through Katrina here in Mississippi, Robert and other northerners will never understand the position you are in right now. I am going through the same thing with them. They will not return calls even from the credit bureaus when they are proven wrong. Don't give up, we all must fight, I have even filed complaints with the FTC, BBB, Congressman, and one Senator. I will not lay down and let these vampires take my home. I have even staged protests in front of Wachovia Banks and passed out leaflets at every turn. It forced Wachovia to close one of its branches down here. I will not stop until Homeq and it sister company Wachovia stop this. I fought for this country and have been wounded in combat twice. Is this what I fought for? You are what I fought for and the people who realize that these people are unreal. I know they will go to hell. I will pray for you and hope you will come out at the end.

You've spent a lot to keep a house that is, from an economic standpoint, worthless(*). You will be money ahead to quit paying any more, abandon the house, and live somewhere else. Set emotions aside and realize that there is no valid reason to try and stay.



First shop for somewhere else, and move pronto. There are degrees of "bad credit" and you probably still qualify for a lot of apartments. If you complete the short sale or file bankruptcy then there will be no further money owed on the old house and you can start life again.



(*) There are two things that may give the property some value. First is the value of the land, but that may be zero now that it is a known flood area. Second there is a slim chance FEMA will pay something for your damages. Hope you haven't been holding your breath on that.

Our House

Dear Robert,



I don't think you get the point here. This is our house. If we are forced out we will not have any where to go. HomeQ has taken every dime we have and we could not get even an apartment to live in with what they have done to our credit rating.



I understand they are a business, I am more than willing to work with them as they should be us. I am trying to make sense of why they won't though. A Quick Sale on our home may get them 8,500.00 now but why is it they are refusing to let us pay out our loan of 47,000.00?



My family has not been ill from living here, only I have so I doubt it is the homes fault I just have bad luck in that dept.



I understand they are not my friends and are a business but I have yet to run into any other business that treats people so rudely. That runs up prices just to force you out and from what i see on this site I am not the only one they are doing this to.



Nor have I run into a business that would take less that 75% of what you owe them for an item. We look to our future and see possibilitys that we won't have if this company gets away with what they are doing to us. We are not young people.



My husband and I are closer to 50 than 40 and there is not much time left for us to start over again. As said before we have no where to go if we do leave here and with a 5 yr old and 2 yr old.

Why are you doing this to your family?

It's just a house. Sure, you have memories of precious events that happened there but are they really worth destroying your health and that of your family? Your children, regardless of their ages are surely aware of how physically and mentally exhausted you are over your current situation. And to be frank, you are endangering you children for the sake of holding onto a house that is in need of extensive repairs and from your discription should be uninhabital.



Find a place that you are able to live that better fits your financial situation. You and your families mental and physical health will be much better for it.



It's just a house. Living somewhere else won't erase you memories but surely staying in the position you are now will only contaminate those memories.



Home Q Servicing isn't forcing you out of your home. They are a business. They aren't your best buddy or a family member whose shoulder you can cry on. I am sure you are only one of thousands of customers that are dealing with financial difficulties. Where do they draw the line?



Having said that, for your family and your own safety and welfare, forget about trying to save a house that by now surely will never be the same.
