Re: Auto Dealership Delivery Scam, loan document issues

On February 2, 2009, I went to Hubler Chevrolet to have my 2000 Chevy Blazer serviced. The service department told me that my engine was no longer good and that it would cost me $2800 to have the engine replaced. Last year, I also experienced some issues with this vehicle that cost me quite a bit of money. Although my vehicle was completed paid for ($0 balance), I opted to buy a new vehicle instead of repairing my 2000 Chevy Blazer.

As a background, I am a single woman (and purchased my vehicle alone). I moved to Indianapolis from Toledo, OH in 2007 to attend culinary school. The only relative or close friend that I have in Indianapolis is my sister. Therefore, I highly depend on having a reliable vehicle to get me to and from school as well as my place of employment. I pride myself of being a reliable student and dependable employee.

My sales rep was Joe Carapazza. I decided to buy a White 2009 Chevy Equinox. I was told that I was approved by Bank of America. There were numerous red flags in completing the paperwork, however, each time I asked a question, my concerns were easily explained away by the Greg Newlin, Finance Manager.

I am filing an official complaint because I believe that my overall Retail Installment Contract and Security Agreement and Vehicle Order Agreement were in someway unscrupulously and falsely documented. I have 2 different sets of this agreement; each has different financials listed on the documents, including increasing my annual percentage rate from 13.37% to 13.38%, without mentioning that fact. 1) Hubler Chevrolet knowingly and fraudulently committed Spot Delivery Scam. A month later stating my Bank of America financing fell through and that I would need to fax additional financial documentation 2) intentionally increased the MSRP of the 2009 Chevy Equinox therefore charging me too much for the vehicle and did not crediting my documents with accurate rebates and incentives 3) Charged me for an Extended Warranty, Credit Life, Credit Disability and Gap coverage. Hubler Chevy was aware that I had full coverage via American Family Insurance. I was under the impression that since I had a 2009 vehicle, my warranty was included. I did not notice that I was charged for this until my sister reviewed my paperwork.

Here are some facts surrounding this incident.

To begin, I signed the Retail Installment Contract and Security Agreement on February 2, 2009, however, when I received the paperwork; everything was dated January 31, 2009.
The MSRP was listed at $27,000+ (I can not remember the exact number) on the car window. On the original set of paperwork, Hubler Chevy listed the MSRP as $37,208.25. I was told that the sticker price always deferred from the actual price. I purchased this vehicle off of the showroom floor and did not add any additional features.
My uncle is a retired GM employee; therefore I was due to receive the GM employee/family discount. Based upon the varying paperwork, I am not sure if I received the exact amount or family discount that I should have received
On February 16th, Greg Newlin (Finance Manager) called me and asked me to return to their office. He stated I'm re-doing your paperwork and it will reduce your monthly payment by $20.00. I returned to the office to sign a NEW Retail Installment Contract and Security Agreement. Once again, I later reviewed this paperwork with my sister and we discovered that the financials listed on the documents were quite different (Please see attached).
During a 30-day period, I awaited receipt of any type of correspondence from Bank of America regarding my loan as well as a valid and transferable certificate of title. I attempted calling Bank of America regarding your payment book, but was unable to speak with a live representative because I did not have an account number. I never received anything from Bank of America
March 5, 2009, my temporary tags expired on this day. I went to the dealership to inform them that I had not received a valid and transferable certificate of title and to let them know that my tags expired today (March 5th). Since I hadn't received a certificate of title, I asked Greg Newlin if Hubler Chevrolet could issue another 30-day tag. Greg informed me that it was against the law for them to do so, however, they could put my old license plate from my 2000 Chevy Blazer on my 2009 Chevy Equinox, which they did. Greg stated that he would contact Bank of America to check the status of my paperwork (stating that he would have it sent to him and that I should be able to pick it up in a few days). I told him that I didn't feel comfortable driving with a plate that wasn't registered to my new vehicle. Greg said that I had paperwork for my new vehicle and should be fine. The receptionist suggested that I take my Hubler Chevy paperwork to the DMV to see if they would issue my new plates/tags.
On March 6, 2009, I went to the DMV (Beechgroove, IN) with my paperwork. They did not see any information regarding my vehicle for me to obtain my plates/tags. The DMV contacted Hubler Chevy and told them that it was there responsibility to give me a dealer plate until the information was updated in their system for me to obtain my plates/tags.
On March 6, 2009, Hubler Chevrolet provided me with a dealer plate (stating that I would only need the plate for a few days until my title information arrived at Hubler Chevrolet). This information never arrived and I never received any additional paperwork.
For me, the alarm siren went off in my head on March 19, 2009. Greg Newlin called to inform me that my financing fell through and that Bank of America was no longer doing auto loans. I expressed that it had been over a month since I signed the documents and that I would think that they received Bank of America's approval before I drove off of the lot. Greg stated that I was approved, then said that they were not doing anymore auto loans. Greg asked me to fax them some additional financial documentation to allow them to go through another bank/finance institution.
On Friday, March 20, 2009, Greg called to see if I had faxed any additional documentation. At that time, I told him that I would not fax any additional information because this should have been a done deal especially after a month. I have never heard of anything like this and I've purchased other vehicles. I told him that this had been one of the worst experiences in purchasing a vehicle that I'd ever had. I asked him to have Hubler Chevrolet cut me a check for the $1000 credit card down payment and to return my 2000 Chevy Blazer to me and that I would return their 2009 vehicle. Greg told me that he understood said that this had never happened to them either and that he would have Rob, (Manager), to call me. I shared with Greg that I felt that something fishy was going on and that something just didn't seem right. I informed him that I was going to file a complaint with the Better Business Bureau.
On Saturday, March 21, 2009, I received a denial of credit letter dated March 20, 2009 from Bank of America. I immediately thought that this was odd due to the fact I was told on February 2, 2009 that Bank of America approved my car loan.
As of the writing of this letter, March 24, 2009, Rob or anyone associated with Hubler Chevrolet have not returned my call.
On Friday, March 27th, approximately 6:45 p.m., I went to talk to Greg Newlin about the issue and to request that my trade-in vehicle, 2000 Chevy Blazer along with my down payment and all fees be returned to me. While waiting inside for Greg, my original sales rep, Joe, removed the dealer plate from the 2009 Equinox so that I would not be able to drive the vehicle back off of the lot. Greg got the Sales Manager, Rob, involved and I accused them of scamming me. Greg was extremely rude and nasty, later saying you can't get your car back because we sold your vehicle. Initially, they wouldn't tell me that my vehicle was sold until I continued requesting the return of my vehicle immediately. Rob stated that they couldn't do anything about the situation until Monday because their business offices were closed until then. Approximately, 8:18 p.m., Rob's recourse was to basically give me a used 1999 Chevy Blazer (outside and inside was horrible, damage on the outside of the body, door would barely close). Valuing my trade in at $2000 ($1000 for the vehicle, along with my $1000 down payment, however, the loan paperwork valued my vehicle at $3000). He asked me to contact him on Monday to give him the opportunity to sort things out. He also requested the keys to the 2009 Equinox, in which I gave to him.
Saturday, March 28th, I called Rob informing him that the check engine light had come on and that I would need a reliable vehicle to drive while his office sorted things out. Rob told me that they didn't have any vehicles at the time and to once again contact him on Monday.
Monday, March 30th, I spoke to Rob. He stated that I had 2 options: 1) come to their office, return the vehicle and accept a $2000 check or 2) wait until they found another vehicle for me to accept.

At this point, I do not want to do business with Hubler Chevrolet. I believe because I was a vulnerable, single woman, they took advantage of me by overcharging me, adding things to my contract that should not have been added, not allotting me appropriate discounts/incentives, falsely informing me that I had been approved by Bank of America, as well as revising my contracts to reflect different financials, an increased interest rate, etc. (after fully reviewing, the 2 contracts give you a sense that something is simply not right with the contracts).
