  1. I am writing this on behalf of my wife Maura M.
  2. My wife was attacked by dogs and injured on July 21, 2013.  An ambulance that was not called by us, but by a Redondo Beach Fire EMT and not at our request, transported my wife and myself to an emergency medical provider known as Providence LCMMC in Torrance CA.   We didn’t request this hospital destination, rather the ambulance driver told me where he was taking her as we were on the way there.  I asked why we were going to that specific hospital, he said that is where the ambulance company goes.  In other words, this hospital was not chosen by my wife or myself.
  3. After emergency treatment on July 21, 2013, Hunter-Donaldson, LLC – a 3d party insurance contractor with Providence LCMMC --  filed a medical services lien under Cal. Civil Code Secs 3045.1-.6 on behalf of Providence LCMMC, for a $3000 medical services billing.  Note the amount of the bill is the round number $3,000, as opposed to a more specific amount.
  4. On information, research and belief, this billing by Providence LCMMC and lien filed by Hunter Donaldson LLC are for an inflated billing for services to my wife.  The primary charges (for xrays) are approximately 4 times the reasonable, necessary and customary charge for identical services in the region and other added charges are approximately 1-1/2 times what other service providers in the area charge as a reasonable and customary charge.
  5. Repeated promises (twice in the past 2 weeks) from Hunter Donaldson to get back to me to resolve this are not being honored.
  6. I’m very willing to resolve this but I don’t think I’m being treated very fairly.
  7. I’ve been a Cal attorney for over 30 years and a partner in two Los Angeles law firms, so I do have a sense of what is fair and what isn’t in medical billing practices.
  8. My wife has received a settlement offer for her injuries from an insurer (USAA) of the owner of the dogs that attacked my wife but my wife cannot and will not accept it until Hunter-Donaldson’s inflated claim for medical services by Providence LCMMC  is reduced and resolved.
  9. Hunter-Donaldson’s actions are preventing medical providers from being paid, including Providence LCMMC.
  10. Commencing in late July 2013, and continuing several times after that, I spoke to Sarah Garcia and Dorothy of Hunter-Donaldson to provide information about billing and services provided, and on November 12th, I spoke to Susan of Hunter-Donaldson at ext 1112.  I followed up with a fax to Susan of Hunter-Donaldson last week.  Sarah Garcia expressly informed me that Hunter-Donaldson would not reduce the billing or the lien claim until there was an insurance settlement offered and at that time Hunter-Donaldson would adjust the billing downward in light of the insurance settlement offer based on an internal formula of Hunter-Donaldson’s.  I told her that this was an express admission that the $3,000 medical billing and lien were specious and were trial balloons to see if the inflated claim amount could be recovered.  Sarah Garcia then informed me that Hunter-Donaldson’s policies prohibited her from discussing an adjustment of the billing with me prior to a settlement offer from the 3d party insurer and that the medical provider – Providence LCMMC – would refuse to speak to me about adjusting the billing downward and that I could only speak to Hunter-Donaldson, LLC about the bill.  Sarah Garcia also told me (falsely) that Hunter-Donaldson, LLC “is the hospital” and that the only party I could communicate with about the billing is Hunter-Donaldson, LLC.  I told her this claim was untrue and that she had already informed me that Hunter-Donaldson LLC is an outsourced vendor and 3d party insurance adjuster.  Sarah Garcia then denied this and said “we (Hunter-Donaldson) are the hospital.
  11. I explained to Sarah, Dorothy and Susan of Hunter Donaldson, LLC that, based on my research and examination of pricing of services by over 100 area medical providers, the billing from the hospital seemed to be very inflated and not a usual, reasonable and customary charge. 
  12. Based on research, I believe it is the case that the x-ray billings I have been presented with for $2442 are approximately 4 times what the majority of providers in the service area charge.  The emergency room charge of $556 is around one and a half times what many providers in the service area charge (i.e., around $300).
  13. Again, Hunter-Donaldson has noticed a lien of $3,000 but the Cal Civil Code sec 3045.1 says the lien is limited: 

"to the extent of the amount of the reasonable and necessary charges of the hospital and any hospital affiliated health facility, as defined in Section 1250 of the Health and Safety Code."

As I have expressed in several calls and written notices to Hunter-Donaldson, the amount of the charges is not reasonable and necessary in the 90277 geographic area. 

As such, the lien is not a lawful lien and, since Hunter-Donaldson refuses to reduce the bill appropriately or to communicate with me about it, I have no alternative but to file consumer complaints about it.

On June 22 I was in a motorcycle accident and was treated by Tacoma General Hospital a Multicare Health System facility.  No less than 24 hours after I was  released, true to their advertisement on their website, Hunter Donaldson started robo calling my cell phone.  (this may very well be illegal both federally and in the state of Washington).  Specifically the pre recorded voice mail says.  

"Hello this is a follow up call from Hunter Donaldson regarding you recent visit to the hospital We believe their may be other other insurance available to pay for the hospital bill.  By providing us with information to this visit we be able to resolve the bill quickly.  To provide information or additional information please call xxxxx.  To learn more about us please visit http://www.hdonaldson.org.  If we have reached this number in error please call to have your number removed.  Thank you and have a wonderful day"

Other insurance??? Why other insurance??? I am fully covered under a policy through an employer.

This is where it gets interesting.  Hunter Donaldson is named in a class action case in Washington State and has been accused of colluding with leadership at Multicare Health System to fraudulently obtain a notary license in Washington.  The alleged fraud was that a representative of this company used the home address of the President of Multicare Consulting to establish the residency necessary by state statute.  Then this President and 2 other multicare employees vouch for the good moral character of the Hunter Donaldson representative as well as their signatures were notarized by yet another Multicare employee.

What did they do with this Notary License?  Hunter Donaldson and Multicare seem to have made decisions in over 5000+ cases of trauma victim treatments to not bill a persons personal insurance.  Instead they filed liens against possible settlements if the trauma victim were to receive a settlement from their or the other parties accident insurance.  It appears unfortunately this is not illegal but it is a highly questionable activity.  The method use of that notary license to do so could possibly constitute 5000+ class c felonies in Washington State.

This gets even more interesting.  When I pushed back on Hunter Donaldson for their calls to me as well as questing this type of activity.  A collection agency like Hunter Donaldson had the nerve to file no less than 4 anti harassment petitions against me in King County District court.  A COLLECTION AGENCY.  Who may have defrauded 7000 + people to the tune of some where between 5 and 50 million dollars felt harassed when someone who stood up and said.  YOU will not do this me, nor will you quietly be able to do it to anyone of my fellow citizens.

BTW, they lost their petitions and were not successful in showing I harassed them.
