I applied for a new apartment and found that I had a debt listed under Hunter Warfield on my credit report and it just listed Landlords. Of course, I was denied the apartment due to this. The leasing agent was nice enough to give me the information for them. I contacted them immediately and spoke with a lady by the name of Lisa James. The first time I spoke with her she stated that I was being charged for 60 days of rent due to no notice being given when I left. I faxed her over the email which confirmed that I emailed my landlord back in May 1, 2008 stating that I would be moving out by July 1, 2008 which was 61 days notice. My landlord accepted this notice. Also, I advised her that my landlord really voided my lease since she allowed the other tenant who signed the lease to move out without an addendum to the rental agreement being signed by the original signers and I have been paying the rent up until I was unable to do so. I contacted the other tenant and she advised she has nothing on her credit for this agency which means it is only for me, which is not correct.
I contacted Lisa James again and she acted as if we never spoke. She then went on to say that the 60 days of rent was for not completing the entire lease. I asked her on what page of my lease this was stated. She advised she did not have a copy of the lease. I then asked her then how is her agency able to ruin peoples credit and don't have any clue on what they are talking about. She responded saying that when people do not complete their entire lease that they are charged 60 days worth of rent. I advised her again that this was not what my lease stated. My lease does not even state that once it is completed we go month to month. The lease states that a new lease will need to be completed at the conclusion of this lease. She then stated you still owe the debt, however we will have to contact our client and this could take 30-45 days to remove if the client approves it.
I then asked her what if her client does not approve it. She advised then we will still attempt to collect and I will receive a letter in the mail. I told her that is unacceptable and she stated that is how we do business. Instead of arguing with her I asked her about the other tenant that is on the lease. She said that they only have me on the account and I am solely responsible. I told her by law that is not correct. We both are solely responsible and I am not paying until everything is corrected. I am waiting to receive a response from them. If it is not what is correct then I will be contacting a lawyer and filing a lawsuit against them and their client. I have spent money applying at for new places and was denied due to this crap and it stops now. I have called them daily and all I get is they are working on it. I asked for a Supervisor and was told that no one was available. I asked her if I could leave a message and she advised no I had to call back.
This agency is clueless as the day is long. Please verify and keep good records when dealing with them. I would recommend recording them just like they record us.
