I applied for a loan modification through Indymac, hoping to use the HAMP Program. During the whole application process I was in constant contact with Indymac. I was calling the bank 3 or more times a week. Every time I would contact them to ask about my application, they would instruct me that they had all my necessary paperwork and tell me it was being reviewed. I always asked if anything was missing from my application.

seven months or so go by and I was finally given a trial load modification. I was instructed to turn in my social security statement of benefits, which I did. I made all my trial payments and called 3 or more times a week to check on the status. Every time I once again asked if they had everything or if anything else would be needed. Every time I was told "yes we have everything we need, don't call us we'll call you"

Shortly after making my 3rd trial payment and 10 months into the process I received a denial letter. I said I was denied because the Statements from social security didn't match the direct deposits done by social security into my account. It turns out that social security made a mistake and overpaid my wife and I for a couple months so they were going to fix it by sending us a little less over a couple months. I informed several people at Indymac of this discrepancy on several different occasions. I was instructed by Indymac that all I had to do is once again turn in my statement of benefits from Social Security and that would be all that is needed to clear up this discrepancy.

I asked to dispute the denial and submitted all my paperwork once again. I called to check the status once again and was told "yes we have everything we need, if we need anything else we'll let you know" I was told to turn in more bank statements which I did. After trying to fax them in several times I decided to also mail in my paperwork certified mail, so I had proof they received it.

Ultimately I was told I could not dispute the matter and that there was nothing I could do. They told me that I never requested a dispute and I was outside my 30 days although I called well over 20 times within my 30 days asking to dispute the matter. Each time I was told it was being re-reviewed. It wasn't. I was ultimately turned down for a loan mod because they did not receive bank statements. which I had faxed and mailed certified mail.

The customer service reps tell me there is nothing they can do. When I ask to speak to a supervisor, I'm told either "they can't help you either" or "i don't have a supervisor" or " there is no supervisor available, but I'll have one call you back" They don't, no one calls. All the reps are concerned with is getting you off the phone. They will tell you anything to get you off the phone including "i've taken care of it, it's being reviewed again. check back in 5 days" whick is yet another lie from Indymac.

I am now going to lose my home due to Indymac's poor handling of my loan modification application and constant lies told to me by Indymac reps over the phone.
