Innovation Builders has failed to refund the full amount of our earnest money.
Another case of mismanagement, miscommunication and overall bad customer service and failed promises from innovation home. They are slowly getting their with Grand homes. I visited an innovation model home in Mira Lagos (Grand Prairie) and spoke to the sales lady about building a plan with double stair case. I asked if they had any plan like that, and I was told Yes!
She went ahead and pulled out a plan (block out diagram) from a customer who was building the plan. Obviously I was excited. The plan I was shown, was a 62 1/2 ft. plan with the additional stair case and about 6300 sq. ft.
I was told my house would be exact the same save for a few modifications I made. On 11/3/2014, I signed a contract with an earnest money check of $7500 upon contingency of my current home being sold. I was assured I'll receive my full refund if anything were to happen. I went into contract on my old home on 11/25/2014, and closed 12/30/2014. The contract was executed by innovation builders on 11/25/2014.
The first block out from innovation was on 12/9/2014 (block out showed 6634 sq. ft.) and it was inaccurate. Items on my contract were missing. It took 3 weeks to get another block out from innovation on 12/31/2014 (block out showed 6546 sq. ft.). This block out was also incorrect.
**Warning to Potential Buyers** Innovation builder has only one architect on staff who does all their plans. You can imagine the nightmare having one person draw architectural plans for 4-6 different subdivisions.
Next block out was 2 weeks later 1/16//2015 (block out showed 6343 sq. ft.) and it was wrong. At this point, I was getting frustrated. Innovation had been drawing the same plan for over a 6 week period and still didn't get it right.
I was getting very frustrated and made it known to the sales manager. After the last block out on 1/16/2015, on 1/21/2015 I met with the sales manager, and she showed me a different block out. The square footage on this block out had dropped to 5600 sq. ft. I was very upset. Just as an example, per the innovation builder's standard plan that I was shown,
A standard bedroom was about 18 x 16 sq. ft. I paid for an extra bay window, but my master bedroom was just 15 x 15. I couldn't fathom how innovation builders could even present me this. We asked that the double staircase be not as curved, this created more square foot space, but innovation builders took it away. I asked that they return the space on the block out. Per my contract, it says "Add second staircase per **** England parkway (that was the reference) but they had deviated from that.
7 weeks into the process, we still had no final block out. I told the sales manager that since they couldn't get the plan right and so deep into the process, I'm being forced to go somewhere else. We signed a 7 month apartment lease, and at this time we were already behind. She said she would get us answers by Thursday.
On Thursday, we didn't hear anything back. On Friday, there was no news. At this point, I requested that the contract be cancelled because innovation failed to provide what they were supposed to. I was assured my full earnest money would be returned by the sales manager.
After several back and forth of inaccurate block out reviews, we lost all trust in Innovation's ability to provide us a house per the agreement in which we signed.
A similar plan built by Innovation with the same square footage as we were quoted yet, somehow through the process, the VP changed her mind. We were offered a smaller home at a higher cost compared to similar recent builds in the area. On January 28th, I was told by the sales manager via email from the vice president of operation for innovation builders that they were going to keep 20% of my earnest money for block outs, appraisals fees and management time and refund me only $6000 out of $7500. I reached out to the VP of operations for a full refund, but she won't give us our full earnest money back.

Innovation Builders executed the contract with the buyer on November 25, 2014. This contract was a contingency contract until January 23, 2015. Innovation Builders created a block out of the plan prior to the release of the contingency, as a good customer service gesture. If the buyer had cancelled prior to the release of the contingency, all earnest money would have been returned. Innovation Builders was notified by the buyer that the contingency had been released on December 22, 2014. A final block out was provided December 31, 2014. When a custom plan is created for a buyer, it is typical for there to be changes to the block out. The buyer requested a double stair case as part of the contract. It is specifically notated and agreed in the contract that this stair case will not increase the square footage of the house. A block out was sent to the buyer showing the changes from the contract. This block out was within the allotted square footage. After reviewing, the buyer requested 2 additional changes, which would result in an additional 200 square feet being added to the plan. To continue our efforts of good customer service and reach an agreement with the buyer, Innovation Builders offered the 200 additional square feet at no charge to the buyer. The buyer chose to cancel the contract. Per the terms of the contract, Innovation Builders is entitled to all earnest money. But as a gesture of goodwill Innovation Builders offered to refund $6,000 of the $7,500 earnest money. The $1500 retained covered actual expenses already incurred.
