I was selling some items on Ebay when my listings were ended by Ebay stating this company contacted them. I then recieved an extremely rude email from the "attorney" for this company stating I was "blatantly manufacturing/selling counterfeit merchandise".

I have been selling on Ebay for over 4 years and have never knowingling sold anything counterfiet. She requested a ton of paperwork and good bit of money and gave me 7 days to comply. Meanwhile my Ebay account was suspended.

I emailed her back and explained that I did not know what she was talking about and she replied by stating that was a poor excuse and advised that I obtain counsel. I got another email stating that I owe her/her client $1600.

I don't know where she is getting this information from and she is telling me. She is threatening with legal action, attorney fees and initially with up to 20 years in prison and penalties of 2,000,000,000!!! All that over, as she put it, $1600. Is this for real???

I would have thought if you are an attorney there would be some form of legal documentation mailed out on actual letterhead. Even the email looks very unofficial-not on leterhead. What should I do? I can not afford an attorney as I have been out of work for 3 months now. Help!!

Ignore it.  


Most likely an ambulance chaser.

Until you get actual registered letters with her letterhead, none of it matters.

She probably goes to these companies and says "hey I'll start chasing money and give you 50% of whatever I get.  You don't have to pay me anything".  And they're like "ok, free money"

Then she sends threatening emails and letters.

If you aren't selling counterfeit stuff, you have nothing to worry about.  There's nothing wrong with selling your used items on ebay.

I had a situation with Bose and was contacted by Stacy. I looked over her and did my background work. She did take the bar and she is a rep for Bose. She has a very good reputation as she prior worked for WWE. My advise is you call her or email her and go over whatever it is you did and work something out. I have spoken with Bose as well as several attorneys and she is legit. You can either settle with her and walk away with less money in your pocket or get sued go broke and go to jail. Bose DOES NOT play around when it comes to selling their items without their permission. I have been up and down this road. if you have any questions. please let me know.

I have received to e-mails from her. One threatening letter about information I had to provide. I sent her back an e-mail telling her the information I knew. She didn't said anything about this e-mail and she sent me another one asking me for settlement fees and settlement aggrement she is going to send over the internet with my promise of never again selling Alvin and the Chipmunks products. Is this right? I just can't believe I had bought wallets for resale from a California Company and that they sold me products that are not supposed to be sell without authorization. I don't even know how to ask for prove that her client has the rights and trademarks to do it. What should I do? Should I contact Bagdasarian Production and ask them what is what is trademarked. Please help. I need to go back to sleep not thinking that a million dollars or prison letter will arrive to my house.
Can ebay help me some how to resolve the problem?

i am in the same situation any help would be great. She contacted me over bose earphones and listed many paperwork items that they wanted from me which i do not have. I am a high school kid and really dont get what she is talking about. What should i do? If i jsut pay the settlement will things be over? thats really all i want to do, is get this over with and go on with high school without having to worry about this all day. I do not have any more of these headphones, nor will i ever own anything with the bose name on it again. Someone please let me know what happened with their case, or what i should do!

I was given a deadline, via e-mail, of when to have information to her that she requested. I was advised, by an attorney, to disregard all e-mails and not do anything until hardcopy legal documentation had been sent to me. Also, I was told to absolutely NOT pay one red cent!!

The next week, her name and number appeared on my caller ID a couple of times but no messages were ever left. Nothing since then and that was a few weeks ago. I am just waiting to see what comes next.

I also received an email from this person. She wants $575 and sent me a settlement agreement. Have you heard anything from her again? Did she send you hard copies of the letter she sent you via email? My sister checked her out to see if she is in fact an attorney and apparently she took the bar in CT....she is filed under a different name. Her maiden name. I just find it odd that a huge corporation like Bose would hire a small time person like her to represent them in a trademark case.

if you google stacy papachristos she used to work as a legal atty for the WWE out of Stamford,Ct.....she no longer represents them...
You would have to get an actual letter with their letterhead in order for anything to take place...emails and phone calls can come from anywhere...it sounds to me like a competitor of yours or an angry employee from the WWE has reported you..because there is so much conterfit items produced and sold if its reported to ebay and they belive there is a chance of conterfit items they have to take the items off and suspend your account...
I would not worry about legal action against you, you would have already been notified ....
