I was contacted by JA Cambece, on a credit card debt with Bank of America.

I tried to set up payments with them but they refused.
I am also in the process of possiby setting up an account with fredom debt relief to get me out of debt.
The eprson i spoke to wanted me to settle the debt by 5 o'clock but i don't have the money.

They called me at work and i asked them not to.
The person i spoke with wanted to speak with my HR dept. Not sure why.

They said something about my job being an asset. Can anyone explain to me what he mwant and what his purpose of speaking to HR was.

Has anyone been sued by them?

How long after initial contact do they move forward with legal action?

Also, does anyone have any advice as far as Freedom Debt relief?

Are they helpful?

Will they help me straighten out this matter?
Thanks

Yes they will sue you.

After you start getting calls, it's probably about 4-6mo before you receive a summons. Cambece is one of the larger firms in MA. I was sued by them.

When the summons comes, do not answer it with a yes!
Answer no and and also make them proove the debt is yours.
Look this up on the internet, you will find resources on how to answer a summons.
I just spoke to a lawyer yesterday in fact and he said the same thing
It will be coming though.

They are jerks and will harrass you just enough, but not enough to fully break the law...most times.

They have been fined once for unfair practices and another suit is pending.

To answer a few of your questions:
CCCS companies or debt relief companies are rip offs. I got gipped out of $2,000 a couple of years ago and know of several others who have also been riped off. Also Debt Settlement companies are not the answer either they will put all your funds into an account and never make a payment to your debt for 6months-4 years depending on the size of the debt in which in the mean time your account could be sold again you could continue to get calls and be riped off of more money.

You can most certainly set up payments if any company refuses you have the right as a consumer to send in whatever amount you can afford. Usually it is better if you take the amount and divide it over 12 months if it is over $1k. If it is under that try to get it done in 6 months. Settling is always the key even if you have to save for a little bit. Most generally you can settle a debt for 50% don't accept no for an answer just stay persistant with it till they give in and agree to let you do it.

Companies do have a right to put a deadline on when the balance needs to be paid even if it is the same day.

If you ask any company not to contact you at work verbaly then they are technically suppose to stop, but some places require it in writing.

Some collection companies will ask to speak to your HR dept to verify your employment. Your job can be considered an asset depending on the state they can garnish wages and freeze bank accounts to collect funds. Also if you own property that can be leaned against.

All Collection Law Firms Can Sue.

How long after initial contact do they move forward with legal action?
It depends it could be a month-6 months depending on the assests and amount of the bill....this varies company to company. Usually if the debt is under $1,000 most companies will not attempt to sue.

Also, does anyone have any advice as far as Freedom Debt relief?

Never EVER pay a third party debt collector!!!!

AUTHOR: Stacey - (U.S.A.)

POSTED: Tuesday, December 30, 2008

This is one of the WORST third party debt collectors - They buy old debts for pennies on the dollar then inflate the value to collect money from you

They are not a law firm but a collection agency
Here is some info from www.budhibbs.com - I know him and he is a good man (also a friend of my attorney)

I sued one of these bottom feeder collection agencies and won

For starters - you cannot be arrested for a debt
DO NOT talk to them on the phone - DO NOT make payment arrangements
