I WENT TO FILE MY TAXES IN THE NEW BEDFORD OFFICE AND THEY SAID I NEEDED TO REFILE BECAUSE MY CHILD FATHER HAD CLAIMED MY CHILD WHO DOES NOT FALL UNDER THE GUIDE LINES TO CLAIM HIM BUT THEY LET HIM CLAIM HIM ANYWAY BECAUSE HIS GIRLFRIEND WORKS THERE AND SHE LIED TO THE IRS AND I DID NOT SIGN NO FORM TO LET HIM CLAIM MY CHILD AND HE GOT ALOT OF MONEY AND I HAD TO REFILE MY CLIAM AND THE PERSON WHO FILED STILL WORKS THERE SO THE PEOPLE WHO WORK AT JAKSON HEWITT IN THE NEW BEFORD OFFICE DO NOT GO BY THE RULES SO I AM A SINGLE MOTHER WHO LOOKS FOWARD FOR THE LITTLE MONEY AND I GOT RIPPED OFF AND WHEN I ADDRESSED MY PROBLEM TO THE OFFICE THEY SAID IT IS NOT THEIR PROBLEM, WELL IF THEY HAS HONEST PEOPLE WORKING FOR THEM THEN MAYBE IT WOULD OF NOT BEEN THEIR PROBLEM.

I agree 100%. There are alot of people who get upset at the tax service. But really, it isnt their fault. You have to speak with the father of your child. And then to the IRS. We are just middle men, we do with what we are given. There is no way to know, as a tax service, if the information is correct if given to us the way it is when it comes to children and who takes care of who through out the year..

File paper return

Or, you could file a paper return by the April 17th deadline with your child on it like a regular return and the IRS will make you prove you are the custodial parent and you would get your refund in 6 weeks instead of waiting to do a 1040X (amended return) and going thru all of that hassle, I personally did that for a single mother for 8 years and she got back all of her money due to the Father not having an 8332 form filed to be able to claim the kids and the three year refund statute does not apply to people in your situation.

It is NOT the fault of Jackson Hewitt!

Jessica,

Before I address a solution to your issue, **PLEASE** TURN OFF THE CAPS!! It is very hard to read and is considered extremely rude, and 10 lines of text with absolutely no puctuation is a record! Punctuating and forming sentences is really helpful in allowing us to properly read your post...Thanks.

Now, the Rip Off here is NOT with Jackson Hewitt, it is with your "Baby Father". Jackson Hewitt cannot knowingly file a false return.

You could go somewhere else and file, but that would now be illegal and trigger an IRS audit.

So, here's what you need to do:

1. Write a letter to the IRS Taxpayer Advocate's office. Explain the situation. Send this by certified mail, return reciept requested. Provide any proof to support that you are legally providing more than 50% of the support for the child.

2. File your return without claiming the dependent by the filing deadline, if you have not gotten a response yet from the IRS with a determination of who is entitled to claim the dependent.

3. If you get a determination after April 15th, then you need to file an amended return to get the difference back.

This is all very simple to do. And it is your only solution to keep yourself out of trouble with the IRS.

Jackson Hewitt did nothing wrong. They were bound by law. Your baby's father ripped you off.

You might need some proof of legal custody to get this resolved.
