Jefferson County Colorado Attorney's Office Laura Aguilar Laura Aguilar with Jefferson County Colorado Attorney's Office refuses to pay for services rendered Golden Colorado

On 4/25/13 I was contacted by Melissa Walter, legal secretary of Jefferson County Attorney's Office in regards to serving process.  She provided papers and two address' for service on a defendant.  I advised her that my fee for service is $75 per address.  She responded "OK great, I appreciate it!"  Attempts at the first address were made on 4/30, 5/2 & 5/3 and the address was determined to be invalid.  On 5/9 my office asked if they wanted us to proceed to the second address and we were advised to do so a month later on 6/7.  This same day it was discovered that the second address was invalid.  The client was contacted and advised the results.  On 6/21 Melissa Walter advised that she was no longer on this file and we should contact Laura Aguilar.  On 6/27 Gina Bolton resonded that Laura had been out of the office but she has prepared an affidavit for us to sign.  The affidavit was signed and mailed 7/1.

Invoices have been sent and this was the reply from Laura Aguilar, "Thank you Kelli. Payment on this invoice has been denied due to the original agreement not being kept and then the second service being completed without authorization from our office after we brought it to Davy’s attention that the original agreement was for him to attempt service at two addresses which he agreed to. He attempted service at one address then when we contacted him about the status of the second address he said he would only do it for an additional fee which was not part of the agreement. We did not authorize the second service at the second address and a month after the first service he then attempted service at the second address without contacting our office or requesting the approval to do so, he only did so after I contacted him to let him know that the affidavit of service he sent was reflecting an address different than the one he reported he had attempted service at.

As you can see from the original email chain, I quoted $75 per address.  The reason for the month delay was my office emailing the client and no response being given regarding authorization of the second address.  Now Ms. Aguilar believes that she shouldn't have to pay for anything.
