Well after signing our contract in July of 2003 ...yes that's nearly 3 years...we've finally found an attorney that is willing to help us and not just tell us that we are better off waitng for them to finish the house.

Our contract has a mediation/arbitration clause. Our attorney wrote to them requesting mediation/arbitration (among other things)and gave them 30 days to respond. They responded on the 30th day (surprise surprise) by saying they haven't forgotten about us and they would be responding asap.

Finally the lawyer had to call them back and say "look, time's up" They responded via fax the next day and just gave the whole run-a-round and never addressed the mediation/arbitration. So the attorney said that's it, we take them to court. It would be nice to have some others to go along with us...Joseph I will be calling you if that's ok when we know more about what is going to happen. sorry we couldn't do the channel 8 story. Our lawyer told us at this stage of the gaame to not do the interview. I'd love to see it when it comes out, please keep me informed.
A class action would be nice...
uggghh...who knows how long this will take...we've waited almost 3 years, every passing week seems like an eternity. I just want it to be all behind us and them to pay for what they have put us through.
