I paid a "Matt Rohan" $3000 for him and his company, JMAX Direct (JMAX Solutions) to mail an offer to about 15 million OPT-IN email addresses. His company supposedly specializes in CAN-SPAM (U.S. law governing SPAM) complaint email marketing.

Before sending him any money, I made sure he was CAN-SPAM compliant and a law-abiding/legitimate mailer. He confirmed that he was in several email messages to me.

The email marketing trial I paid for was supposed to be completed in one month. Three months later, I realize he's not even half way done in completing his part of the deal. At this point, I gave him the choice of either refunding me on a pro rata basis OR fulfilling his side of the deal.

It's not been several months later, he and his company have yet to mail to half of the names they promised they would. I've sent him numerous emails asking him why he has yet to mail my offers. His typical response is that my offers "suck". I've once again asked for a refund and now firmly believe I will need to take legal action to obtain a refund. Since, I have all the email exchanged saved in addition to web statistics, I should have no problem defending my stance.

Also, FYI, the company's 1-800-679-JMAX (5629) phone number is typically down. Thus, I've grown accustomed to emailing him when attempting to reach him.

Though I doubt it'll come to this, perhaps we can discuss/pursue legal action together against JMAX and "Matt Rohan".

By the way, what tipped me off to find this link was when I viewed the author of the excel file he sent me, it stated Jason Chester, if you follow the SEC link, you'll see Jason CHester and Jmax Online being indicted.

Anyway, have you decided to file for legal action? I already had a collection agency collect my money back, I've also filed a report to the Illinois State Attorney General's Office.
