I contacted Mr. John Webster in 2006 to help me get my brother into a prison located closer home so I could visit him. I told Mr. Webster that my brother had been wrongfully convicted and we had proof but government would not let us present our evidence due to defense attorney not doing his job.

Mr. Webster informed me that there shouldn't be a problem getting my brother in the prison that was closer home and he said he would help me find suitable attorney to help my brother prove his innocence. He also informed me that the terms of the supervised release imposed upon my brother were unconstitutional and that we would contest them.

So I managed to pay Mr. Webster $2,500 of my hard earned money to complete these tasks and he sent me paperwork to sign and he signed too. This paperwork simply stated the above and was an agreement that Mr. Webster would complete these tasks. I still have my copy of this agreement.

Mr. Webster has not fulfilled ANY of the agreement and will not answer or return my calls or reply to my emails or letters. I just lost $2,500 for nothing. I think Mr. Webster might have filed one petition to the BOP in Prarie, TX but that is hardly worth $2,500. I am asking that if he does not intend to honor our agreement then refund my money. I know he is deliberately ignoring me because for a solid two weeks I called at least twice a day and left messages on his machine to call me back. Nothing.

If you are thinking of hiring the NPSC (National Prison and Sentencing Consultants) to help you get your loved one moved to a closer prison or maybe a better prison, you better just save your hard earned money because they will gladly take your money and you will never hear from them again. My brother is still trying to get somebody to listen and see that he is not guilty of the charges and he can prove that his wife set this whole thing up but Mr. Webster is nowhere to be found. He does not care. He has already spent my money and never looked back.

John Webster of NPSC back to his old tricks!

AUTHOR: Jonathan - (U.S.A.)

POSTED: Monday, March 23, 2009

I would like to respond to the statements in Mr. Websters rebuttal.
Mr Webster said:
"Jonathan only explains a part of the story. We indeed were retained to seek a BOP internal transfer for his brother. I did explain orally and in writing
that such would in fact be very difficult due to the nature of the charges."

My response:
He told me repeatedly that there were other inmates at FCI *** with the same charges as my brother.
He also said "there's no reason we can't get him transferred to FCI ***" He went on to explain that FCI*** was really considered a low facility and not a camp because of it's FCI label. Therefore my brother would qualify.

Mr. Webster said:
"'As agreed we will seek to have his place of incarceration changed from FCI Ashland to a facility closer to his home in West Virginia. As I informed you on the phone
last evening, any type of sex offender can not be placed in a minimum security facility pursuant to BOP policy and that the best that will happen is a low security designation. I also explained that since it appears that he has already reportedly been designated, a re-designation is difficult but certainly not impossible and that we will endeavor to intervene and have him designated to FCI ****(omitted for confidentiality reasons)'"

My response:
Thanks a lot. Now everyone knows this is a sex offender from West Virginia. Thanks for your confidentiality. As for inmates that have already been designated, isn't that what your job is supposed to be? -- to get them RElocated? At least that's what it states on your website as one of the many things you do.

Mr. Webster said:
"Moreover, for two years we have continued to work on a transfer (at no additional charge) and we have reently been informed that due to disciplinary reasons and adjustment issues (so claims the BOP) that a transfer is unlikely. We can not be held repsonsible for inmate ondut that may negate our work."

My response:
For two years you have avoided my calls and never responded to my messages. "At no additional charge"? I think the charge was $2500. What more do you want? I also responded to your inquiry of any disciplinary actions against my brother by letting you know there are none. He has no disciplinary actions against him at all. He has never had one shot against him and I told you that in an email and also in our phone conversation after I filed this original report. His record since entering the prison system (for a crime he did not commit) is spotless.

Mr. Webster said:
"This has been explained to Jonathan and his brother. We truly understand his frustration but we dont believe that he has been 'ripped off' as alleged. We work very hard and do our best to accomplished the objectives for which we are hired. We very clearly explained the level of diffiulty that his brother's case presented and made it very vclear that we could not assure success. When we make a mistake we take responsibility. This is not one of those rare cases."

My response:
I will simply let your own paperwork speak for itself. Here is some of the text from the original paperwork you sent me.

"We will continue to pursue a redesignation and/or transfer throughout his period of incarceration such that he will ultimately end up in FCI ***. We will do so regardless of how long such a transfer may take. As I explained there is no additional fee for any future services in this regard.

Additionally, as indicated, we assist you and (name omitted) locate a suitable attorney for his appeal or assist his current court appointed attorney on any and all aspects of his appeal that fall within the ambit of our expertise. In particular, we question the propriety of the Special Conditions imposed by the Court and will bring that matter up with the attorney of record. As well, we understand that you believe that your brother is actually innocent of the charges and we will investigate all possible avenues to pursue that objective and work with and for his attorney of record to develope the factual basis for such a contention.

We look forward to working with you and (name omitted) to a successful outcome."

Mr. Webster, you have not completed ANY of the above. I have not received copies of any paperwork that you may have filed nor have you told me or my brother what is happening in his case. So if you say you wrote a letter to the BOP or that you spoke to anyone we just have to take your word for it. I have sent you an email on August 8 which I have yet to get a reply from. I have called you numerous times over the last 2 months and still you do not answer.

You are back to your old tricks again! If you would refund just half of my money I would drop this whole thing. Otherwise, I am going to every online forum, group, and website that I can and tell them all what kind of business you are operating! That includes FedCure, Prison Talk, Famm, and many more I belong to.

You should do the right thing and refund at least half of my money!

UPDATE: John B Webster - National Prison And Sentencing Consultants

AUTHOR: Jonathan - (U.S.A.)

POSTED: Thursday, July 31, 2008

Mr. Webster has contacted me and we spoke on the phone. He has told me that he will work on getting my brother to a closer prison and if he does not succeed then he will refund my money. He also showed interest in helping me find someone to try and prove my brothers innocence.

He apologized for not getting back to me and answering my calls. So at least he is interested in resolving this issue and I commend him for that. This report will be updated again when the issue is completely resolved one way or the other. Hoping this will come to a good ending.......

Jonathan only explains a part of the story. We indeed were retained to seek a BOP internal transfer for his brother. I did explain orally and in writing that such would in fact be very difficult due to the nature of the charges. We don not take on any new cases without a detailed retainer agreement explaineing the nature and scope of our servies. I have included the substantive paragraph from our retainer agreement/letter sent to Jonathan prior to accepting the undertaking:

"As agreed we will seek to have his place of incarceration changed from FCI Ashland to a facility closer to his home in West Virginia. As I informed you on the phone last evening, any type of sex offender can not be placed in a minimum security facility pursuant to BOP policy and that the best that will happen is a low security designation. I also explained that since it appears that he has already reportedly been designated, a re-designation is difficult but certainly not impossible and that we will endeavor to intervene and have him designated to FCI ****(omitted for confidentiality reasons)"

Since his brother was already in a low the best we could hope for was another low secuirty faility closer to his residene. As such, we also explaiend that such matters could take up to 18 months due to Bureau policy. Moreover, for two years we have continued to work on a transfer (at no additional charge) and we have reently been informed that due to disciplinary reasons and adjustment issues (so claims the BOP) that a transfer is unlikely. We can not be held repsonsible for inmate ondut that may negate our work.

This has been explained to Jonathan and his brother. We truly understand his frustration but we dont believe that he has been "ripped off" as alleged. We work very hard and do our best to accomplished the objectives for which we are hired. We very clearly explained the level of diffiulty that his brother's case presented and made it very vclear that we could not assure success. When we make a mistake we take responsibility. This is not one of those rare cases.
